The Person County Health Department, Environmental Health Division on May 15, 2003 (auger
borings) evaluated the above-referenced property at the site designated on the plat/site plan that
accompanied your improvement permit application. According to your application the site is to
serve a three-bedroom residence with a design wastewater flow of 360 gallons per day. The
evaluation was done in accordance with the laws and rules governing wastewater systems in
North Carolina General Statute 130A-333 and related statutes and Title 15A, Subchapter 18A, of
North Carolina Administrative Code, Rule .1900 and related rules.
Based on the criteria set out in Title 15A, Subchapter 18A, of the North Carolina Administrative
Code, Rules .1940 through .1948, the evaluation indicated that the site is UNSUITABLE for a
ground absorption sewage system. I regret to inform you that your request for an improvement
permit is DElvIED. The site is unsuitable based on the following:
1. Topography & Landscape Position (Rule .1940)
2. Soil Characteristics — Massive Clay mineralogy (Rule .1941)
3. Soil Wetness — Chroma II colorization (Rule .1942)
4. Available Space (Rule.1945)
These severe soil or site limitations could cause premature system failure, leading to the
discharge of untreated sewage on the ground surface, in surface waters, directly into ground
water or inside your structure.
For the reasons set out above, the property is currently classified UNSUITABLE, and an
improvement permit shall not be issued for this site in accordance with Rule .1948�.
You may also obtain the services of a qualified soil scientist/consultant to evaluate the property

which shows that the system will properly treat the wastewater, will not contaminate
groundwater or surface water, and will not discharge wastewater on the ground surface, as
required by Rule .1948(d). Your site has some other possibilities, but at this time the area that
we looked at cannot carry a conventional or innovative system of standard types: Please contact
a soil consultant or us and we can discuss some other options that are available.
You have a right;� to an informal review of this decision. On May 20, 2003, an informal review
was requested and completed by the Person County On-site Wastewater Program Specialist,
Michael Cash. You may also request an informal review by the N.C. Department of
Environment and Natural Resources regional soil specialist.
You also have a right to a formal appeal of this decision. To pursue a formal appeal, you must
file a petition for a contested case hearing with the Office of Administrative Hearings, 6714 Mail
Center, Raleigh, N.C. 27699-6714. To get a copy of a petition form, you may write the Office of
Administrative Hearings or call the office at (919) 733-0926. The petition for a contested case
hearing must be filed in accordance with the provision of North Carolina General Statutes 140A-
24 and 150B-23 and all other applicable provisions of Chapter 150B. N.C. General Statue 130A-
335 (g) provides that your hearing would be held in the county where your property is located.
Please note: If you wish to pursue a formal appeal, you must file the petition form with the
Office of Administrative Hearings WITHIN 30 DAYS OF THE DATE OF THIS LETTER.
Meeting the 30-day deadline is critical to your right to a formal appeal. Beginning a formal
appeal within 30 days will not interfere with any informal review that you might request. Do not
wait for the outcome of any informal review if you wish to file a formal appeal.

On July 11, 2003 Mike Cash, Joel Hicks and I did a soil / site evaluation of the
aforementioned property to determine its suitability for the installation of a sub-surface
sewage treatment and disposal system for a three-bedroom residence. Water must be
obtained from an on-site well.
The soils on the site have 0- 14 inches of a sandy loam or sandy clay loam surface
layer. The clay horizon was encountered at 12 — 24 inches. The clay was found to be
very firm by moist consistence and very plastic by wet consistence. In the rear of the
property a BC horizon or clay plus saprolite layer was found at 7— 18 inches which was
also determined to expansive clay mineralogy. Soil wetness conditions of colors of
chroma 2 or less were observed at 14 — 24 inches.
A portion of the property had been manipulated with some heavy machinery. These
locations include the right side behind the existing structure and along the left side of
the existing structure.
This site is unsuitable for a sub-surface sewage treatment and disposal system because
of unsuitable soil characteristics (.1941) and soil wetness conditions (.1942).

RECOMMENDATIONS
The owner has the following options that might allow the property to be used as desired:
1. The applicant may purchase Provisionally Suitable property to place the
wastewater system on.
2. The applicant may obtain an easement on a Provisionally Suitable property to
place the wastewater system on.
3. A wastewater system can be pursued under Rule .1948 (d). Written
documentation must be submitted to your office showing that the proposed
wastewater system can be expected to function properly. The data must
contain the following:
A. The effluent must be non-pathogenic, non-infectious, non-toxic, and non-
hazardous.
B. The effluent must not contaminate the ground water and surface water.
C. The effluent must not be exposed to the ground surFace or discharge to
surface waters where it could come in contact with people, animals or
vectors.
4. The Division of Water Quality may be contacted about securing a discharge
permit. The applicant is strongly advised to contact someone with knowledge
of discharge systems to evaluate the site before contacting this office.
5. The applicant or owner may have the site evaluated by a Licensed Soil
Scientist for a pretreatment system.

Dear Mr. Kernodle:
On May 5, 2004, Harold Kelly, Soil Scientist with the Person County Health Department and I
met on your site to determine if replacement of the original dwelling with a mobile home was
possible. On this day we observed that a mobile home had been set-up on blocks with footings,
plumbing connected to the septic tank, and an air unit had been connected. These actions were
performed without any permits from this office which is in direct violation with North Carolina
General Statute 130A — 336 (a) "No person shall commence or assist in the construction, location
or relocation of a residence, place of business or place of public assembly in an area not served
by an approved wastewater system unless an improvement permit and an authorization for
wastewater system construction are obtained from the local health department. The site was
evaluated in accordance with the North Carolina `Laws and Rules, or Sewa e Treat»ient, and
Disposal Systems' (15A NCAC 18A .1900). '
Previous evaluations of the property classified it as U�:suitable for the installation of a
subsurface wastewater disposal system for the following reasons:
(Rule .1940) Topography and Landscape Position
(d) Gullies
(Rule .1941) Soil Characteristics
(3) Expansive clay mineralogy. ',
(Rule .1942) Soil Wetness Conditions
(a) Indications of soil wetness within 24" of the soil surface.

These evaluations were conducted by Joel Hicks, Environmental Health Specialist, Michael
Cash, Program Specialist, both with the Person County Health Deparhnent, and by Kevin Neal,
Regional Soil Specialist with North Carolina Department of Environment and Natural Resources,
On-Site Wastewater Section on May 15, 2003 and July 24, 2003, respectively.
On May 5, 2004, the decision was made to deny the request to allow the existing system to be
placed into use due to the soils unsuitability, which was previously determined, site disturbance
with heavy machinery, and the lack of a repair area. Repair area is required of any lot or tract of

land "which is specifically described in a recorded deed or a recorded plat" after January l, 1983,
Rule .1945 (c (1)).
The property as it is recorded now according to the March 10, 2004 plat requires repair area.
The original tract of land owned by Ivery and Mary Royster which consisted of 3.749 acres and
was recorded in 1972 was repair exempt. The property was then subdivided twice more on
January 19, 1988 and May 7, 1999 and both of these parcels require repair area.
You may request an informal review of our decision from the Regional Soil Scientist, On-site
Wastewater Section, North Carolina Department of Environment and Natural Resources. The
Regional Soil Scientist would independently evaluate the property to determine if our evaluation
was done in accordance with State rules and regulations. Please contact our office if you would
like to pursue this option.
You may also obtain the services of a qualified private soil scientist/engineer, to independently
evaluate the property. Based on their findings, they may submit a wastewater system proposal to
the Person County Health Department. The proposal must be accompanied by documentation
and data which shows that the proposed system will properly treat the wastewater and will not
contaminate, or discharge directly into ground or surface water.
In addition, you have the right to formally appeal this decision to the Office of Administrative
Hearings. A formal appeal must be made within 30 days from the date of this letter. The
appropriate paperwork must be submitted to be Office of Administrative Hearings. Please
contact our office to obtain the necessary applications and mailing addresses or the forms may be
found at www.oah.state.nc.us/forms.htm.
Our findings only apply to site suitability for subsurface wastewater disposal systems. A surface
discharge system may an option for the proposed facility. Permits for surface discharge of treated
