The Board will need to address the Findings of Fact in Section 155 of the Person County Planning
Ordinance and whether this proposal is in keeping with the Person County Land Use Plan. The
Findings of Fact in Section 155-3 (b) are as follows:
1.That the use will not materially endanger the public health or safety if located where proposed
and developed according to the plan as submitted and approved.
2.That the use meets all required conditions and specifications.
3.That the use will not substantially injure the value of adjoining or abutting property, or that the
use is a public necessity, and
4.That the location and character of the use if developed according to the plan as submitted and

Future Land Use MapThe Future Land Use Map for Person County depicts this area as Rural which promotes the protection of agricultural lands and natural resources while allowing low density residential development. Rural future land uses permit neighborhood-scale commercial development at and within 1000 feet of major intersections. Typical rural commercial enterprises, Agricultural and agricultural-support uses are to be permitted throughout this area without limitation.13
Special Use PermitSUP-05-21 – Planning Staff Analysis■The parcel is zoned RC (Rural Conservation) and B2 (Neighborhood Shopping). A communications tower is an allowed use in these zoning districts after obtaining a Special Use Permit.■A reduction in setback to at least one-half the height of the tower is allowed due to the tower being self-supported. A certified fall zone letter is required, has been submitted and is on file.14
Special Use PermitSUP-05-21 – Planning Staff Summary■The proposed site plan meets the requirements of the Person County Planning and Zoning Ordinance regarding Radio, Telephone and Transmitting Towers, specifically Appendix C, Note 9.■The proposed tower has gained approval from the Federal Communications Commission and that the “construction and placement of the tower will not interfere with public safety communications or with the usual and customary transmission or reception of radio, television or other communications services”. Approval letter is on file.15

Quasi-Judicial Zoning Decision: The special use permit requires a quasi-judicial public hearing. Witnesses

The case also requires the review of four Findings of Fact from Section 155 of the Planning Ordinance.
Summary of Information:
The applicant is requesting to construct a wireless communication tower 305’ tall on property zoned RC
(Rural Conservation) and B2 (Neighborhood Shopping) that is located within the Falls Lake Stormwater
area. There is an existing 250’ tall telecommunications tower on the adjoining parcel to the west that is
located approximately 1300’ from the proposed new tower.
The proposed wireless communications tower will be triangular, self-supporting, and sits within a 60’ x 60’
area enclosed by a 6’ high chain link fence. The entire leased area is 100’ x 100’ and will be accessed from
Pixley Pritchard Road by a 30’ wide gravel access utility easement. The enclosed 60’ x 60’ area will house
the tower base as well as equipment areas for future carriers.
A reduction in setback to one-half of the required height is allowed per the Person County Planning and
Zoning Ordinance, Note 9, if the applicant provides a letter from an engineer certifying that the fall zone is
to be less than the height of the tower.
The Person County Land Use Plan identifies the site as Rural, which allows for low-density residential
development (lot size minimum 1 acre) or allowing higher density residential development utilizing
conservation subdivisions. Rural type neighborhood-scale commercial development at and within 1,000

feet of major intersections as well as agricultural and agricultural-support uses are also allowed. Typical
rural commercial enterprises should be permitted throughout this area without limitation.
Appendix O of the Joint Comprehensive Land Use Plan lists goals and objectives for the county including
the following:
Guiding Principle 4: Celebrating Our Rural Character and Lifestyle
Objective 1 (5) Provide enhanced services for rural communities.
Planning Staff Summary: Planning staff recommends that if the Board approves the request, the following
condition be placed on the Special Use Permit:
1. The applicant is to obtain all necessary permits (zoning, and stormwater) for the wireless
communications tower project and adhere to all requirements listed in the Person County Planning
and Zoning Ordinance.
The Planning Board no longer reviews special use permits.
Recommended Action: Vote to approve, approve with conditions, or deny the requested Special Use
Permit.

The proposed location of the telecommunications tower will be in harmony with the area and in general conformity
with the comprehensive plan since the tower is proposed in a R-C zone and the leased area will allow for continued
use and enJoyment of the other areas of the property.
SITE PLAN REQUIREMENTS
Ten {10) printed copies and one {1) digital copy of a site plan prepared by a North Carolina registered land surveyor,
engineer, or architect must be submitted with this application. The site plan, drawn to scale, shall depict the following:
1. The boundary of the lot(s} to be developed labeled with bearings and distances, total gross land area, location of
easement(s), utilities, adjacent road name(s} and number(s};
2. Name of project, property owner and applicant, vicinity map, north arrow, scale, date of plan preparation and
subsequent revisions dates;
3. Topography of site, at contour interval no greater than ten (10} feet, location of perennial and intermittent waters,
100-year floodplains;
4. Location and approximate size of all existing and proposed buildings and structures within the site and existing
buildings and structures within five hundred feet adjacent thereto;
S. Proposed points of ingress and egress together with the proposed pattern of internal circulation;
6. Existing and proposed parking spaces;
7. Proposed provisions for water supply and sewage disposal;
8. If the site. is located in a designated drinking water supply watershed, the plan shall also:
a. Depict the location of existing (labeled according to the date of establishment) and proposed impervious
surfaces and respective totals in square feet;
b. The total land area of the lot(s) outside of the road right-of-way(s) in square feet. The property owner and/or
applicant shall have the burden of proving that the proposed special use will not materially injure the value of
adjoining or abutting property.
9. In addition to requirements listed above, a Special Use Permit site plan for a radio, telephone or television tower must
show compliance with Note 9 of the Planning Ordinance. (Amended 7/1/2002}
10. In addition to requirements listed above and those listed in Section 81 of this Ordinance, a Special Use Permit site plan
for a camper/recreational vehicle park must show compliance with the following:
a. A minimum lot size of two acres is required.
b. Density to be 2500 square feet for each tent or trailer space.
c. A minimum undisturbed fifty-foot buffer from all property lines .
d. Each campsite shall contain a stabilized parking pad of either pavement or gravel and one off-street parking
space.
e. A sanitary source of drinking water shall be not more than 200 feet, toilet facilities not more than 400 feet
and wash houses not more than 1500 feet from any tent or trailer space. This provision shall not apply where
community water and sewer connections are provided to trailers having self-contained kitchens and

EXPLANATION OF REQUEST
Petition SUP-05-21 - A request by the applicant, Parallel Infrastructure, LLC (Kelly Young) on behalf of
the property owner, Estate of Lonnie Luxton and Carol Luxton, to construct a new 305’ tall self-supported
wireless communications tower on 69 acres located at 700 Pixley Pritchard Rd. (Tax Map and Parcel
number A84-14) in the RC (Rural Conservation) and B2 (Neighborhood Shopping) Zoning Districts.
LOCATION AND CURRENT LAND USE
This tract is located at 700 Pixley Pritchard Rd in Timberlake, NC and is zoned RC (Rural Conservation)
and B2 (Neighborhood Shopping). It is within the Neuse Watershed and Falls Lake Stormwater Area, and
is a mixture of woodlands and pastureland. The property contains one single-family dwelling and a family
cemetery plot.
Condition and land use of the surrounding properties are:
To the North – Wooded areas and several single-family dwellings, RC (Rural Conservation) zoning.
To the East – A mixture of wooded areas and pastureland, one single-family dwelling on the adjoining
tract, RC (Rural Conservation) zoning.
To the South – Mostly wooded vacant tract of land, part RC (Rural Conservation) and part B2
(Neighborhood Shopping) zoning.
To the West – A mixture of wooded areas and pastureland, several single-family dwellings, part RC
(Rural Conservation) and part B2 (Neighborhood Shopping) zoning. There is also an existing 250’ tall
telecommunications tower on the adjoining parcel to the west that is located approximately 1300’ from
the proposed new tower.
LAND USE / SITE PLAN
The property is zoned RC (Rural Conservation) and B2 (Neighborhood Shopping), and the Person
County Permitted Use Table lists a Radio, Telephone and TV Transmitting Tower or Wireless
Communication Tower as an allowed use within the RC (Rural Conservation) and the B2
(Neighborhood Shopping) zoning districts with a Special Use Permit.
The proposed wireless communications tower will be triangular, self-supporting, and sits within a 60’

COMPREHENSIVE PLAN
The Person County Joint Comprehensive Land Use Plan identifies the proposed tracts as Rural. Rural is
defined as:

The Rural future land use category is intended to promote the protection of agricultural lands and
natural resources while allowing low-density residential development (minimum lot size of one
acre). Cluster or conservation subdivisions, which permit higher density residential development
while setting aside land for preservation, should also be permitted in Rural areas. The Rural future
land use category should permit neighborhood-scale commercial development at, and within 1,000
feet of, major intersections, (examples include Timberlake, Olive Hill, Hurdle Mills, etc.).
Development regulations should limit floor area of retail and similar uses in these rural commercial
nodes. Agricultural and agricultural-support uses, along with other typical rural commercial
enterprises should be permitted throughout these areas, without limitation.
Appendix O of the Person County Joint Comprehensive Land Use Plan lists Guiding Principles and
objectives for the County including the following relevant statements:
Guiding Principal 4, Objective 1- Celebrating Our Rural Character and Lifestyle.
Objective 1 (5) – Provide enhanced services for rural communities.
PLANNING STAFF ANALYSIS
The parcel is zoned RC (Rural Conservation) and B2 (Neighborhood Shopping) and a wireless
communications tower is an allowed use in both zoning districts after obtaining a Special Use Permit.
A reduction in setback to at least one-half the height of the tower is allowed due to the tower being self-
supported. A certified fall zone letter is required and is on file.
A significant portion of this tract is identified by FEMA as being within the AE Flood Zone, or as having
a 1% chance of flooding. According to the site plan for the tower, the tower itself will be located completely
outside of the flood zone.
PLANNING STAFF SUMMARY
The proposed site plan meets the requirements of the Person County Planning and Zoning Ordinance
regarding Radio, Telephone and Transmitting Towers, specifically Appendix C, Note 9.
The applicant has provided a letter of approval from the Federal Communications Commission and that the
“construction and placement of the tower will not interfere with public safety communications or with the
usual and customary transmission or reception of radio, television or other communications services”.
Planning staff recommends that if the Board approves the request, the following conditions be placed on
the Special Use Permit:
1. The applicant is to obtain all necessary permits (zoning, and stormwater) for the wireless
communications tower project and adhere to all requirements listed in the Person County Planning
and Zoning Ordinance.

In approving an application for a special use permit, the Board of Commissioners may attach fair and
reasonable conditions to the approval. The petitioner will have a reasonable opportunity to consider and
respond to any additional requirements prior to approval or denial by the Board.
The Board shall issue a special use permit if it has evaluated an application and determined:
1. That the use will not materially endanger the public health or safety if located where proposed and developed
according to the plan as submitted and approved;
2. That the use meets all of the required conditions and specifications;
3. That the use will not substantially injure the value of adjoining or abutting property, or that the use is a public
necessity;
4. That the location and character of the use, if developed according to the plan as submitted and approved, will
be in harmony with the area in which it is to be located and in general conformity with the Comprehensive
Plan.

The Board of Commissioners for the County of Person, North Carolina, met in
regular session on Tuesday, January 18, 2022 at 9:00am in the Person County Office
Building Auditorium.
Chairman Powell called the meeting to order and offered an invocation.

PETITION TA-03-21, A REQUEST BY THE PERSON COUNTY PLANNING

the Person County Board of Commissioners, to revise the Person County Solar Energy
System Ordinance.
Planning Director, Lori Oakley stated all state statutes and planning ordinance
requirements have been met for this public hearing and requested that her staff report be

Ms. Oakley outlined the concerns related to solar energy systems as follows:
Industrial Use -There are no changes proposed to where solar facilities can be located.
Buffer Height – The buffer height was increased to 6 ft. from 3 ft. at the time of planting
while reducing the buffer width from 150 ft. to 100 ft. That reduction in width will allow
for better fire protection around the perimeter of the site while still maintaining the integrity
of the buffer since the height was increased.
Battery Storage - An additional section was added regarding battery storage and it states
that any battery storage containing Poly Flouro-Alkyl Substances (PFAS) technology must
be noted in the application. The Planning Board requested the words (Polyflouroalkyl
substances) be added to Section 3.1E2c. It is a class of chemical compounds that are used
in a variety of industries for their ability to create coatings that are water repellant. PFAS’s
are resilient within the environment and typically do no break down over time. An example
of a PFAS is Teflon. The new section does state that if a project uses PFAS, it must submit
a containment plan and a separate decommissioning plan for those battery storage areas
containing PFAS’s.
Decommissioning – Person County already had a well written decommissioning section
comparable with other jurisdictions. We added that the decommissioning bond needs to
be reviewed every five years by an engineer to determine that it is still valid and takes into
account any inflation.
Size Limitation - I could not find any jurisdiction that had a size limitation on SES and I
did not feel comfortable selecting an arbitrary number. The Planning Board discussed this
topic at length and did propose additional language regarding a size limitation and distance
separation. They proposed to add Section 2.3 Height and Size Limitation B to read: The
maximum size of a level 3 solar energy system shall not exceed three hundred (300) acres
as measured around the perimeter of the immediate perimeter of the panels and shall not
be located within one (1) linear mile of an existing level 3 solar energy system.
Effect on the Environment & Wildlife - Research is scarce on how solar facilities affects
wildlife. Solar facilities have the potential to deter, attract or be imperceptible to different
wildlife species. I did include a requirement for any relevant studies/reports/documentation
that might be required by staff or any board member as it pertains to field surveys for state
and federal listed species protected under state and federal law. As for the environment, a
Phase 1 environmental site assessment shall be submitted with all level 3 applications. A
Phase I environmental site assessment looks into the history of a property. The resulting
report provides a detailed summary of the environmental history of the property and
findings about potential recognized environmental conditions. Also, under the additional
information section that can be requested by staff or board members, there is also several
environmental reports that can be requested including geological reports, surface water
reports, soil surveys and an environmental constraint analysis. An environmental

constraints analysis screens proposed developments for potential issues that may pose a
constraint to successful implementation.
Photovoltaic Heat island effect - This question has been raised across the US not just in
NC and it continues to be studied and examined. As renewable energy continues to surge,
will large-scale facilities produce a “heat island” effect, and there is just not definitive data
at this time to support that. In fact, some models have suggested that solar energy systems
can actually have a cooling effect on the local environment depending on the efficiency
and placement of the panels. This area of concern will be continued to be monitored as
solar continues to increase.
Loss of Farmland - This topic brings me to the term agrivoltaics, the simultaneous use of
areas of land for both solar power generation and agriculture. While not as common in US,
other countries are raising panel heights slightly in order to grow crops underneath and
animals are grazing along the solar panels and I believe we have some of that occurring
here in Person County.

Speaking in favor of the request by the Person County Planning Dept., on behalf of
the Person County Board of Commissioners, to revise the Person County Solar Energy
System Ordinance were the following:
Mr. Ray Foushee of 8930 Hurdle Mills Road, Hurdle Mills stated opposition to
reducing the 150 ft. buffer to 100 ft. as presented; he noted his preference to have the buffer
remain at 150 ft. as well as to add on the 50 ft. right-of-way for emergency vehicles. In
addition, Mr. Foushee requested the Board to consider setting the maximum size at 150
acres.
Mr. Paul Lynch of 395 Union Grove Church Road, Hurdle Mills requested the
Board to consider when setting the maximum size of the solar facilities to define in actual
acreage as defined by boundaries versus the perimeter of the panels. In addition, he wanted
the Board to increase the 1-mile space between level 3 solar energy systems.
There were no individuals appearing before the Board to speak in opposition to the
request by the Person County Planning Dept., on behalf of the Person County Board of
Commissioners, to revise the Person County Solar Energy System Ordinance.
A motion was made by Vice Chairman Sims and carried 5-0 to close the public
hearing for the request by the Person County Planning Dept., on behalf of the Person
County Board of Commissioners, to revise the Person County Solar Energy System

CONSIDERATION TO GRANT OR DENY REQUEST TO REVISE THE PERSON
COUNTY SOLAR ENERGY SYSTEM ORDINANCE:
Commissioner Gentry stated that the solar power has to be sold to a power
company, which she believes is an industrial use, and by so, she feels the solar systems
should not be zoned for use in RC (Rural Conservation.) Commissioner Gentry advocated
to change the five-year review by an engineer to a shorter period, i.e., 2 or 3 years.
Commissioner Puryear asked staff to bring to the Board any proposed fee(s) that
would go along with the Solar Energy System Ordinance, i.e., an annual inspection fee.
He agreed with Commissioner Gentry and other board members that 150 acres would be
good as a maximum; he stated that 100 acres would be sufficient in his opinion to which
other commissioners agreed as well.
A motion was made by Commissioner Puryear and carried 5-0 to postpone
consideration to revise the Person County Solar Energy System Ordinance to the Board’s
next meeting, on February 7, 2022.
County Attorney, Ellis Hankins said staff would bring back two versions of the
ordinance, 1) the proposed ordinance as presented on this date, and 2) the ordinance with
the Board’s proposed amendments. He confirmed another public hearing was not required
for the amendments suggested by the Board.
Planning Director, Lori Oakley confirmed with the Board the key changes proposed
by the Board of Commissioners were as follows:
5-year engineer review to 2 or 3 years
Remove from RC (Rural Conservation) zoning
Keep 150 ft. buffer with an additional 50 ft. open space for emergency vehicles

COMMUNITY SERVICES BLOCK GRANT APPLICATION OVERVIEW:
Ms. Alexis Franks, Telamon SE Director of Workforce and Career Services
presented to the Board its intent to re-apply for Community Services Block Grant (CSBG)
funding from the North Carolina Office of Economic Opportunity for program year 2022-
2023. This funding will allow Telamon’s Project PRIDE to continue to provide support to
low-income residents in North Carolina counties of Caswell, Person and Rockingham who

What are Community Services Block Grant Funds (CSBG)?
CSBG funds are federal dollars that are used to address the causes and conditions of
poverty in communities. North Carolina’s Division of Social Services’ Office of
Economic Opportunity administers these funds in our state. CSBG funds are allocated to
Community Action Agencies.
What are Community Action Agencies (CAA)?
CAA is the national name for the entities that are designated to carry out CSBG-funded
services in all 50 states and Puerto Rico. In North Carolina CSBG funds are designated in
all 100 NC counties. Telamon Corporation is designated to receive CSBG funds to serve
three (3) NC counties: Rockingham, Caswell, and Person. An 18-member Advisory
Council, with membership from these three counties, provides oversight of the CSBG
allocation.
Why Are Public Meetings Held?
As a CAA, Telamon must follow a process governed by NC Administrative Code 10A
NCAC 97B.0402(3). The process requires us to inform communities about how we
propose using the CSBG funds that we have been allocated, and to solicit citizen views
and comments.

What is Telamon’s Plan for Spending this CSBG Allocation?
Telamon plans to use the funds to continue the existing Project PRIDE program. To
provide support to program participants in becoming more self-sufficient. Available
support includes financial literacy workshops and counseling, assistance with education
and employment goals, and case management to help participant overcome obstacles to
better employment and further their education.

Franks stated Telamon currently serves 20 families with plans to reach up to 32 families as

goals for each family is customized based on the need(s), i.e., childcare, educational

WEBSITE REDESIGN UPDATE:
IT Director, Chris Puryear provided a website redesign updated noting staff have
been working diligently with the website vendor for the last three (3) months. The first
step was to gather information via vendor-conducted surveys of website users and other
stakeholders, a heat map study, and user testing. The survey indicated that most people
use smartphones to access the website and only do so when looking for specific
information. They also indicated that they would like to see clearer language and less
information overall. The heat map indicated that the “employment” and “GIS” links were,
by far, the most clicked links on the homepage followed by the search feature. The user
testing showed that users not familiar with the inner-workings of county government have
difficulty completing tasks such as finding the requirements for a marriage license and
overall difficulty navigating the website.
Mr. Puryear stated the designers were able to address the requests and needs
indicated by the citizens and other website users in the new website design. The new layout
features more user-friendly menu titles, a service finder to quickly locate services, and a
fully integrated search feature. The designers also incorporated more relevant “call to
action” buttons along the bottom of the main image on the homepage for easier access to
regularly requested information.
Mr. Puryear said staff are continuing to work with the vendor for minor adjustments
and are on schedule for delivery of the final product in April of 2022.

AMENDMENT TO THE RESOLUTION ESTABLISHING 2022 SCHEDULE OF
REGULAR MEETINGS FOR THE BOARD OF COMMISSIONERS:
County Manager, Heidi York noted the Board of Commissioners took action to set
its regular schedule of meetings for 2022 at its November 15, 2021 meeting. Since that
time, the NC Supreme Court moved the March 8, 2022 Primary to May 17, 2022. Due to
this recent change, and the fact that the Person County Office Building Auditorium serves
as a One-Stop site and an official polling site, the Board of Commissioners will need to
change the location of its May 2, 2022 meeting to its Boardroom 215. Also due to this
recent change, the Auditorium is now available for the Board of Commissioners’ to hold
its March 7, 2022 meeting in the auditorium.
As retreat planning is underway, the Board has the option to hold its annual retreat
either in the FEMA Shelter Room as was adopted in November or to change the location
to be held in the Kirby Upstairs Main Hall, should this location be preferred.
Clerk to the Board, Brenda Reaves asked the Board to consider the changes as
presented and take action to adopt an Amended Resolution Establishing 2022 Schedule of
Regular Meetings so to cause copy of such to be distributed and posted.

NUISANCE ORDINANCE DISCUSSION:
Planning Director, Lori Oakley informed the Board that the Ordinance Regulating
Automobile Graveyards and Junkyards in Person County (“Junkyard Ordinance”) was
originally adopted on September 21, 1987 and re-adopted on April 6, 2015. In September
2021, Ms. Oakley stated staff updated the Board on the existing on-going violation on the
Yarboro property and requested guidance as to how the Board would like for staff to
proceed with the Junkyard Ordinance. Ms. Oakley noted at that time, two possible
violations existed on the Yarboro property and they have since been remedied. As of
December 2021, Ms. Oakley further noted the Yarboro property was in compliance with
both the Junkyard Ordinance and the Planning Ordinance.
Ms. Oakley said the Board previously expressed an interest in possibly amending
the Junkyard Ordinance and including an amortization schedule as well as directed staff to
explore other avenues of enforcement. Staff discussed the issue with County Attorney’s
law partner, Kevin Hornik, who suggested implementing a nuisance ordinance. Staff feels
that the nuisance ordinance might be the best avenue to enforce junk-like violations while
still allowing individuals who have brought their property into compliance over the years
to still be in compliance. Ms. Oakley said Mr. Hornik stated that his law firm could also
draft the nuisance ordinance for Person County.
Ms. Oakley requested Board consideration to direct staff on how the Board would
like to proceed in this matter. Options include:
1) A possible text amendment of the Junkyard Ordinance to include an amortization
schedule
2) A new nuisance ordinance
3) To leave the current Junkyard Ordinance as it is currently written and do not draft
a nuisance ordinance
It was the consensus of the Board through discussion that a new nuisance ordinance
would address and resolve issues for the general public’s health and safety purposes.
A motion was made by Commissioner Gentry and carried 5-0 to request the
Brough Law Firm to draft a new nuisance ordinance with staff’s assistance for the Board’s
consideration.

HUMAN RESOURCES SOFTWARE PROPOSAL:
County Manager, Heidi York stated Person County was in need of upgrading its
human resources technology. Ms. York said the current software vendor, NeoGov, which
supports job applications, postings, and tracking of applicants, has offered the County
several needed enhancements and upgrades with additional modules, which would be
considered in the upcoming FY23 proposed budget. However, NeoGov was substantially
increasing their pricing after the first of this year. Ms. York noted that staff worked
creatively to obtain the significant savings over the next three years, and wanted to bring
this opportunity to the Board for consideration in an effort to be the best stewards of
taxpayer dollars. Through the informal bid process under G.S. 143-131, as suggested by
the County Attorney, several potential vendors were invited to submit proposals, but none
were able to meet our needs. Should the Board wish to make this investment, it would
require a mid-year budget appropriation and pre-audited agreement for commitment of
funds. Should the Board not desire to authorize this purchase of software at this time, there
is a 60-day out clause in the proposed agreement with no penalty.
Human Resources Director, Miranda Harrison provided an overview of the
modules that staff are considering include:
Perform – This is a performance management platform that allows for
competencies and goals to be tracked throughout the year with automatic reminders
and the ability for employees and supervisors to engage with the system by adding
periodic notes at pre-set check-in times.
eForms – This function allows for electronic fillable forms that we can run reports
off of (examples include PAFs, teleworking agreements, volunteer leave, shared
leave, parental leave, safety/injury forms, requisitions, orientation forms, etc). The
system allows electronic approval routing along with reminders to be set up. While
things like this up can be set up in Munis, everything must be entered manually
from a paper form and there are no reminders (you have to log-in to see what needs
your approval); eForms in NeoGov can be exported so the information can be
imported into Munis rather than manually entered.
Learn – This platform allows us to access hundreds of training courses on a
variety of topics. We currently have access to a portion of this platform for
courses related to safety and risk management through our risk management pool.
If we add the full Learn module it will include more courses and will allow us to
integrate with the Perform platform (so we can track courses through individual
development plans).
Onboard – This is a portal where employees can be assigned onboarding actions
from HR or other departments with associated due dates (or exit actions – this can
be used for onboarding and off-boarding). It has areas to upload videos or checklists
and can be customized to brand the onboarding experience specific to Person
County. It can be available for employees prior to their start date, all the way up to
their first year anniversary, with pre-established checklist activities for certain
times throughout their first year on the job.

Single Sign On (SSO) – This allows everyone to have one log-in for all the different
NeoGov modules. The single sign-on enhances the user experience and also cuts
down on admin time resetting passwords.
NHI – This is a set-up fee that is required. It is the part of the implementation
process where we would ensure everything in NeoGov can be integrated with
Munis (this is most important for things like PAFs) so that we don’t have to do
double entry.
Prioritizing the options, Ms. Harrison said the county could gain the most value
from the eForms and Perform modules. NHI is also a vital component. The Learn and

Ms. York stated should the Board wish to direct staff to move forward, an
appropriation from Fund Balance would be required to be approved by budget amendment.
Ms. York said the County may have an opportunity to reimburse these funds back to Fund
Balance if the Finance Director finds that the County is eligible to use American Rescue
funding.
County Attorney, Ellis Hankins noted staff worked to lock in pricing for significant
savings during the holiday period with the December 31 deadline; he added the County
Manager had authority to execute contracts with limitations, therefore he recommended a
contract to lock in the lowest pricing with a 60-day provision for the Board of
Commissioners to approve, or if not approved, there was no cost or obligation on the
County’s part.

proposal as presented by staff. Mr. Hankins noted the next steps would be for the Board
to approve a budget amendment to appropriate the funds and formalize the contract with

CRIMINAL HISTORY RECORD CHECK ORDINANCE REPEAL/REPLACE:
Human Resources Director, Miranda Harrison presented a Criminal History Record
Check Ordinance to the Board for consideration to repeal and replace for a more efficient
government. Ms. Harrison said Person County Government regularly conducts criminal
history record checks through North Carolina State Bureau of Investigation, Division of
Criminal Information Network (SBI/DCI) as part of the County’s pre-employment
screening process. The Criminal History Record Check Ordinance was adopted May 4,
2009 to allow Person County Government to utilize the SBI/DCI Network for this purpose.
Ms. Harrison stated added language in the proposed Criminal History Record
Check Ordinance would allow Person County Government the option to establish vendor
partnerships with alternative criminal history record check providers beyond SBI/DCI. She
said having vendor options is an essential need for Person County to ensure efficiency
within our pre-employment screening process. Historically, the time to receive results
through SBI/DCI was two weeks or less. Recently, the results have begun to take 4-6 weeks
or more, significantly delaying new employee start dates. Ms. Harrison noted other industry
leading vendors offer criminal history record check services with a turnaround time of less
than one week for results.
The proposed new language requires the Board’s adoption at its First Reading by
unanimous vote or the proposed language would require a Second Reading at the Board’s
next regular scheduled meeting at which time a majority vote is required for adoption. Ms.
Harrison requested the Board to repeal the Criminal History Record Check Ordinance
adopted May 4, 2009 and adopt the Criminal History Record Check Ordinance as
presented.

CHAIRMAN’S REPORT:
Chairman Powell reported that Cardinal Innovations and Vaya Health have now
merged effective January 1, 2022; he added the transition was going very well and
applauded Cardinal Innovations’ recent donation of Chromebooks to area schools:
Roxboro Community School (80 units), Roxboro Christian Academy (40 units) and Bethel
Hill (75 units.)
Chairman Powell voiced ongoing concerns related to the lack of service by
CenturyLink in Person County. County Manager, Heidi York and Assistant County
Manager, Katherine Cathey shared in the Chairman’s frustration noting the County’s
contact at CenturyLink was no longer valid and they would try to obtain new contact
information to share. Commissioner Gentry shared her method to file an online complaint
with the FCC and asked if the IT staff could provide a link on the County website for
citizens.
MANAGER’S REPORT:
County Manager, Heidi York reported the Board would hear at its next meeting an
update on the recent broadband study.
COMMISSIONER REPORT/COMMENTS:
Vice Chairman Sims reported positive news where Roxboro Savings Bank’s
donation with the City of Roxboro would complete the Roxboro Pocket Park and that a
ribbon cutting for the Palace Pointe new ownership was held on January 14, 2022.
Chairman Powell added that was good economic news that Palace Pointe was sold to a
private entity, which had opened up for business shortly thereafter.
Commissioner Gentry said she had recently obtained satellite internet which was
working out great. She noted she would be attending an IAIA meeting soon with a report
to the Board thereafter.
There were no reports from Commissioners Puryear and Palmer.
Clerk to the Board, Brenda Reaves announced the Roxboro Area Chamber of
Commerce notified the County that they were rescheduling the Awards Banquet from
January 20th to February 3rd due to the impending weather at the Tunnel Creek property.

Summary of Information:
The Person County Health Department’s proposed new fee is associated with COVID-
19 vaccinations. The proposed fee is for the administration of the COVID-19 Pfizer
pediatric third dose vaccination for ages 5-11 and will be utilized to submit claims to
insurance companies in an attempt to cover the cost of the vaccine administration.
The proposed new fee will allow PCHD to bill the administration fee for the COVID-19
Pfizer pediatric third dose vaccination. Individuals will not be charged a fee. Medical
providers are not allowed to bill for the vaccine as it is provided by the federal
government.
The Board of Health approved the Fee Schedule Amendment on Monday, January 24,
2022, and in accordance with the North Carolina General Statute 130A-39(g), the Board
of Health requests the approval of the Board of Commissioners to implement the
proposed fees which are attached.

Agenda Title: Consultancy Agreement for Professional Services with Economic
Leadership, LLC
Summary of Information: The current EDC strategic plan will end in 2022. Most grant
programs related to economic development require an existing plan, and it takes months to do the
necessary analyses to draft a new plan. Since the EDC anticipates applying for relevant grant
opportunities and needs a new guiding document later this year, the EDC voted unanimously at
the January 25th planning session to request authorization from the Board of Commissioners for
the County Manager to enter into contract with Economic Leadership, LLC, an experienced and
reputable economic development consultancy firm, on behalf of the EDC. The full proposal is
attached, and in addition to the Strategic Plan will also include a workforce analysis that will assist
in marketing and recruitment. All deliverables are due by May 31, 2022, and there are ample
existing funds in the ED budget to cover the cost.
Recommended Action: Authorize the County Manager to sign the appended proposal from
Economic Leadership, LLC.

This serves as a proposed Consultancy Agreement between the Person County Economic
Development and Economic Leadership LLC of Shallotte, NC for services described below.
The scope of work will be performed for Person County Economic Development,
(hereinafter referred to as the Client) by Ted Abernathy, Managing Partner of Economic
Leadership LLC, and other supportive staff (hereinafter referred to as the Consultant.)
The Consultant agrees to complete the scope of work for the Client as described below. The
project will take approximately four and a half months and be completed for a budget of
$37,000 for all work specified, inclusive of all materials and travel expenses. A specific
timetable will be mutually agreed upon by the parties, with work beginning on or about
February 7, 2022.
Plan Deliverables
The Person County Economic Development project will include:
• A comprehensive review of all existing economic development strategies (local, regional
and state).
• Development of an in-depth economic assessment of Person County that will shed light
on the County’s current economic reality, the impact of emerging global trends, new
economic changes from COVID-19 and a rigorous review of the quantitative data for the
County.
o A qualitative overview of the existing information on major employers, area
assets, available real estate including the mega site and regional trends and
competitiveness. This review will compare the performance of the County with
state and national averages. This overview will include important economic
development metrics such as job growth, total earnings, location quotients, top
occupations, establishments, and population growth of the overall study region.
o We will then dive deeper into the County’s economy by tracking performance of
specific industries and traded clusters, using materials recently completed for
RTRP.
o Additionally, we will identify emerging sectors and suggest future target
industries.

stakeholders
o Up to three business focus groups
o An on-line electronic survey of board members to gather current opinions and
suggestions
• The development of a short (approximately 10-12 pages) assessment of trends
impacting Person County’s economic competitiveness in the coming years.
• An organizational capacity assessment with recommendations for future capacity and
focus.
• An assessment of the County’s current incentive policy with future recommendations
based on best-practice research.
• Finally, our report will provide a SWOT Analysis, opportunities to diversify the county
economy, future challenges, and growth opportunities. The final product will be a multi-
year strategic action agenda and matrix with responsibilities, timelines, expectations
(metrics), and costs.
• A final presentation to all stakeholders will be provided, determined by the Client.
• Additional or revised deliverables may be added if the scope and costs are agreed upon
by both parties.
Approach to Strategic Planning
An economic development strategic plan answers three basic questions: what is Person
County’s current economic situation, what do local stakeholders want the county’s future to be,

and what actions can the community and Person Economic Development realistically take to
move Person County from where it is to where it aspires to be.
Successful economic development plans are influenced by specific new realities:
▪ Identifying and achieving a differentiated competitive advantage, the economic
development goal of all successful places, requires a combination of factors. These
include the depth of workforce talent; the business climate, including costs and
regulatory issues; both solid physical infrastructure and the connective infrastructure;
shovel-ready sites, and buildings ready to go; and the quality-of-life factors that appeal
to talented workers and engaged residents.
▪ Overwhelming global trends such as rapid urbanization, evolving globalization and
ubiquitous automation and robotics are rewriting the economic landscape. Regional and
local work, education, innovation, health, retail and employment hubs, can create
economic transformation for a much broader region, but they also must continuously
compete as both capital and labor become more mobile.
▪ Coordination, leadership, and a focus on Return-On-Investment is the key differentiator
between places that succeed and those that decline. Successful efforts must have
aligned leadership, clear objectives, realistic expectations, sufficient resources and
talented staff to succeed.
Phase One of our strategic process is the information stage, where we establish a common,
agreed upon, current reality the region. We will use a combination of global competitiveness
trends, recent business investment criteria and economic development delivery best practice
research to establish the Client’s current competitive position. Our approach begins with three
filtering criteria:
▪ Compass - the vision, mission and values Person County has already established,
including its expectations for economic development.
▪ Context – Person County’s current and potential strengths and weaknesses, compared
to the competition, and given those realities, what is a realistic course of action. This is
information that is researched and developed by the Consultant. Finally,
▪ Change - the group of factors outside the Person County’s control that will change
competitiveness soon and create the parameters of what is realistically achievable. This
is information provided by Consultant and can be used by the Client during both the
planning and implementation phases of the project.
During phase one, we will analyze and summarize data from multiple sources. Competitiveness
comparisons that establish the strengths and weaknesses of the County, a broader trend
analysis of business investment decision criteria (including workforce, infrastructure, business
climate, demographics, cluster or sector growth) and near-future anticipated changes that
could impact future competitiveness will be examined. Stakeholders will be engaged where
appropriate.

Phase Two will reaffirm the desired and expected economic future for the Client and develop
specific goals, objectives and actions to move the place from its current economic and
competitive position to where it wants to be in three to ten years. Actions that will be detailed
over the first three years will establish a foundation for success over a longer 10 to 20-year
economic horizon.
The Economic Leadership team will work with Person County Economic Development to
evaluate potential actions based on four factors: control, impact, resources, and time. By
incorporating these four factors we can better ensure that the actions recommended are
possible and that the outcomes are achievable.
Finally, Phase Three is the action stage and this is where many economic development strategic
planning processes fail. Without the capacity and structure to act, no plan is achievable. The
Consultant will develop the framework for delivery of services to improve the odds of
successful implementation.
Economic Leadership’s Community Competitiveness Model
Materials - The Consultant will provide needed material as appropriate related to facilitated
sessions. The Consultant will provide an electronic copy of the final report and such files that
the Client may reproduce the report as needed.

Travel - Travel costs are included in the proposal cost.
Facilities - For mutually agreed upon meetings and facilitated sessions, the Client will provide
facilities and will support the arrangement of the meetings.
Termination of this Agreement - If the Client decides to terminate the program prior to
completion, the Client will notify the Consultant immediately. Upon notification of the Client’s
early termination, Consultant will deliver an invoice to Client requesting reimbursement for any
costs incurred for the project to that date.
Confidentiality – The Consultant agrees to keep confidential all information relating to the
business of the Client.
Project Completion - The project will be completed on or about May 31, 2022 but may be
extended upon mutual agreement of the Client and the Consultant.
Payment of Costs - The Client will pay fees of $37,000 based on agreed upon schedule.

Summary of Information: G.S. 105-369(a) requires that Tax Collector report to the Board
the amount of unpaid 2021 taxes that are a lien on real property during the first meeting in
February. This is simply a checkpoint for the Board as to the progress that the Tax Office is
making on collections and a way to alert the Board if collections are down.
We don’t see any issues with making the budgeted collection rate of 97.5%, however there is 1
large bankruptcy in the amount of $291,597 that will affect the final collection rate by .66% if
this remains unpaid.
As of January 28, 2022, our collection rate was 94.63 %, with unpaid county taxes for tax year
2021 of $1,881,466.66.
Recommended Action: Accept the report. No motion needed.

The newspaper advertisement is required under G.S. 105-369(c) and can be placed anytime

delinquent real estate bills.

Agenda Title: Fee Schedule Amendment – Transportation
Summary of Information: When the FY22 Budget was adopted, Person Area Transportation
System (PATS) was unsure if it would receive Rural Operating Assistance Program (ROAP)
funds from the State of North Carolina. Therefore, ROAP revenues and fees were not included in
the FY22 Budget.
On Nov. 23, 2021, the county was awarded FY22 ROAP funds and now needs to reinstate the
ROAP mileage rate. The FY21 rate was $1.40 for both general users and Elderly and Disabled
Transportation Assistance Program (EDTAP) users. The proposed fee is the same amount as the
FY21 approved fee.
Recommended Action: Approve the reinstatement of the ROAP mileage rate in the amount of
$1.40 for both general and EDTAP users.

Agenda Title: Consideration to grant or deny request to revise the Person County Solar
Energy System Ordinance (Petition TA-03-21) and a Proposed Zoning Permit Fee and an Annual
Inspection Fee
The proposed text amendment (Petition TA-03-21) requires legislative review by the Board. The
Board of Commissioners held its public hearing at its January 18, 2022 meeting and took action to
take consideration of this item at its February 7, 2022 meeting.
Summary of Information: On August 16, 2021, the Person County Board of Commissioners
adopted a 6-month moratorium on level 3 solar energy systems (greater than 10 acres) to allow
staff time to review the current requirements and make adjustments accordingly.
Staff reviewed solar energy system ordinances across the state (including Beaufort County, Warren
County, Stanly County, Nash County, Carteret County, Granville County and Orange County) and
then drafted revisions to the ordinance. The draft ordinance was then sent to the following
boards/committees for review: Economic Development Commission, Airport Commission and
Farm Bureau.
The following is a summary of the commentary received from the aforementioned groups:
-Economic Development Committee: No suggested changes.
Farm Bureau: The consensus among the board is the concern about the cleanup and
removal of decommissioned solar panels and the long-term effects on the soil after
removal, as well as concern of anything being left behind and not disposed of properly or
not disposed of at all. They are still opposed to solar panels taking over or monopolizing
productive farmland. They feel that as the nation’s population is expanding, the need for
more farming would increase and they felt that solar sites could be bad for future
agricultural production.
-Airport Committee: No suggested changes other than updating the website for solar glare
studies.
Staff is proposing the following changes to the ordinance:
No changes to where level 3 solar energy systems can be located (other than reformatting
the Table to match the Table of Uses in the Planning Ordinance).

No changes to setbacks (other than reformatting the Table to match the Planning Ordinance
setback table); however, a 100’ setback from a well was added.
Buffer width reduced from 150’ to 100’ while planting height of trees increases from 3’ to
6’ at the time of planting.
Aviation notification to other agencies increased from 30 days to 45 days prior to public
hearing. All special use permits/conditional district rezoning application along with
aviation requirements will also be submitted to the Person County Airport Commission.
Decommissioning bond amount shall be reviewed by an engineer every 5 years.
Conditional district rezoning language was added just to clarify a process that is already
allowed.
Additional information shall be included with the special use permit / conditional district
rezoning application including but not limited to: a copy of the lease agreement, battery
storage information, a Phase 1 environmental analysis, and any other relevant
studies/documents requested by staff and/or boards.
A fire response and emergency response section was added to ensure proper emergency
response coverage along with the requirement of an emergency response plan that must be
filed with the Fire Marshal.
Prior to receiving a Certificate of Compliance, a noise level certification letter shall be
submitted.
An annual inspection shall be required by staff to ensure continued compliance.
Planning Staff Recommendation: Planning Staff recommends approval of TA-03-21. The
proposed text will address board member and community concerns and better regulate solar energy
systems.
Planning Board Recommendation: At the Planning Board meeting on December 9, 2021, the
Board recommended unanimous (4-0) approval of TA-03-21 with the following changes:
Table 2.1 – Change “S” in the chart to “S/CD” to better reflect that it includes both a special
use permit and conditional district rezoning.
Section 2.3 – Change the title to “Height and Size Limitation” and include a “b” that reads:
o B. The maximum size of a level 3 solar energy system shall not exceed three
hundred (300) acres as measured around the immediate perimeter of the panels and
shall not be located within one (1) linear mile of an existing level 3 solar energy
system.
Section 3.1-E.2.c – include what PFAS means in parenthesis (Polyfluoroalkyl substances).
Board member James had concerns about limiting the size of a level 3 solar energy system and the
impact it would have on economic development for the county. Board member George had
concerns about requiring a one-mile separation in between level 3 solar energy systems and how
it would affect an adjoining property owner who might want to develop a solar energy system in
the future. Both board members voted to approve the text amendment as written with the Planning
Board’s recommended changes in order to move it along in the process due to the time-limited
moratorium.

At the Board of Commissioners’ January 18, 2022 meeting, there was a consensus for the
following changes:
Table 2.1 was amended to prohibit level 2 and level 3 solar energy systems in the RC (Rural
Conservation) zoning district.
Table 2.2 was amended to require a 200’ setback for all level 2 and level 3 solar energy
systems from the property lines and/or right-of-way lines. This setback will include area
for a 150’ buffer and 50’ of open area for emergency access.
Section 2.3(b) was amended to state that the maximum size of a level 3 solar energy system
shall be 100 acres.
Section 2.4(b) was amended to require a 150’ vegetative buffer.
Section 2.6(d) was amended to require an engineer to review the decommissioning bond
amount every 3 years.
Solar energy system applications for a conditional district rezoning or special use permit already have a fee
that accompany them that is comparable to other jurisdictions. Staff recommends adding a zoning permit
fee for level 2 and 3 solar energy systems and an annual inspection fee for level 2 and 3 solar energy
systems. Staff proposes the following fees:
Zoning permit for level 2 and 3 solar energy systems: $1,000 per megawatt with a minimum fee of
$2,500 (this is the same as Nash County, NC)
Annual solar energy system inspection fee (for level 2 and 3 systems): $300 (This is the same as
Stanly County, NC)
Planning Staff Recommendation: Planning Staff recommends approval of the proposed fee schedule.
Recommended Action: Vote to approve, approve with modifications or deny the requested text
amendment and the fee schedule as proposed. The Board must also include a Statement of
Reasonableness and Consistency with the motion.
Statement of Reasonableness and Consistency:
The text amendment request is consistent with the Person County and City of Roxboro Joint
Comprehensive Land Use Plan and future planning goals and objectives of Person County. It is
reasonable and in the public interest as it will provide clear regulations in the Person County Solar
Energy System Ordinance.
The proposed text amendment meets the Comprehensive Land Use Plan Guiding Principle 2,
which states to facilitate sustainable economic growth.

The maximum size of a level 3 solar energy system shall not exceed three hundred (300) acres as measured around the immediate perimeter of the panels and shall not be located within one (1) linear mile of an existing level 3 solar energy system.■Section 3.1-E.2.c – include what PFAS means in parenthesis (Polyfluoroalkylsubstances).120
PLANNING BOARD RECOMMENDATION CONTINUED■Board member James had concerns about limiting the size of a level 3 solar energy system and the impact it would have on economic development for the county. ■Board member George had concerns about requiring a one-mile separation in between level 3 solar energy systems and how it would affect an adjoining property owner who might want to develop a solar energy system in the future. Both board members voted to approve the text amendment as written with the Planning Board’s recommended changes in order to move it along in the process due to the time-limited moratorium.121
BOC REQUESTED CHANGES TO DRAFT ORDINANCE■Table 2.1 was amended to prohibit level 2 and level 3 solar energy systems in the RC (Rural Conservation) zoning district.■Table 2.2 was amended to require a 200’ setback for all level 2 and level 3 solar energy systems from the property lines and/or right-of-way lines. REASONABLENESS AND CONSISTENCY STATEMENT AND COMPREHENSIVE PLANThe text amendment request is consistent with the Person County and City of Roxboro Joint Comprehensive Land Use Plan and future planning goals and objectives of Person County. It is reasonable and in the public interest as it will provide clear regulations in the Person County Solar Energy System Ordinance. The proposed text amendment meets the Comprehensive Land Use Plan Guiding Principle 2, which states to facilitate sustainable economic growth. 123

Summary of Information: At its March 1, 2021 Budget Retreat, the Board of Commissioners
established improving broadband infrastructure and connectivity as a top priority for Person County.
The board expressed an interest in conducting a study to assess the current status of broadband
services, opportunities to improve, and strategies to extend broadband throughout the county.
On March 15, 2021, the board approved a proposal by ECC Technologies, Inc. to: (a) refresh and
update the 2015 telecommunications infrastructure inventory study, including an Outside Plant
(OSP) study, (b) map the current status of available broadband service within the county, (c) review
the county’s fiber project – its suitability and positioning to support new broadband initiatives by
others, (d) review RiverStreet and State of North Carolina survey information and (e) consult with
the county to review options and next steps including service provider options.
The Executive Summary is attached, and the full report will be finalized prior to the board’s annual
retreat. Jeff Brooks, Sr. Director – Consulting with ECC Technologies, will present the study
findings and recommendations to the board. Board members may ask questions and discuss next
steps.

Introduction
Broadband access has become one of the foundational resources allowing a community to compete and
thrive in the 21st century.
Broadband enables business, education, medicine, government, and public safety to perform their
functions efficiently. It is a critical component of economic development and a community’s ability to
attract and retain industry. Recent surveys show high-speed broadband is now as important to job
creation and business locations as good transportation and skilled labor.
Broadband is today considered infrastructure as critical as roads, electricity, and water. Inadequate
broadband has become a barrier to community growth, competitiveness, and economic development.
This has led to something called “The Digital Divide.”
Person County has commissioned this study in part to understand its rural area broadband capacity, as
well as explore opportunities for possible broadband expansion to help the County overcome this Digital
Divide.
The Digital Divide
On Feb. 8, 1996, the Federal Communications Commission (FCC) created the Telecommunications Act to
establish competition and facilitate growth in the telecommunications industry, which previously had
been a government-regulated monopoly.
Despite the success of increasing competition and encouraging innovation, a technology gap has occurred
between communities with access to affordable broadband service and those without. This division is
termed the “Digital Divide.”
Existing Infrastructure
Despite the increased need for broadband service, rural areas of the country with access to the Internet
still rely largely on aging copper-based infrastructure. As a result, users may not have Internet availability,
or be limited to dial-up, DSL, or satellite connections for access.
Unfortunately, upgrading copper’s limited bandwidth to the high bandwidth capacity of fiber has not been
an area of focus for the telecommunications industry. The incumbent providers are reluctant to invest in

expensive telecommunications infrastructure upgrades without support from grant funding as these
projects do not show profitability.
Efforts to Close the Digital Divide
Over the past year three years, the North Carolina GREAT Grant and the FCC Regional Digital Opportunity
Fund (RDOF) programs have awarded or will be awarding a total of $712,712 in Person County. The USDA
ReConnect program has not provided funding for Person County as of the date of this report.
In 2019, NC Wireless/River Street applied for $1.9M and was awarded, according to the NC BIO website,
$560,300 for areas in Person County. As a requirement of the grant, NCW/RiverStreet added another
$301,700 to the project for a total of $862,000, which will serve 392 households and 11 businesses north
of Hyco Lake and north of Moriah.
According to the other award reviews, Spectrum will be receiving over $75K from the FCC RDOF program
to connect 933 new locations in the County in the coming years.
NC GREAT Grant
Under the current North Carolina budget, $1.2B will be made available for Broadband funding. Of that
amount, $350M has been allocated for the next round of GREAT grant awards. The rules for the next
round of GREAT grants have changed in accordance to the recently passed NC Bill 947, as discussed below.
American Rescue Plan (ARP) Funding
On March 11, 2021, a national $1.9 trillion COVID-19 relief package was signed into law including funds
which can be used for broadband infrastructure development at state and local levels.
The Interim Final Rule states eligible projects should reliably deliver minimum speeds of 100 Mbps
download and 100 Mbps upload. In cases where it is impracticable due to geography, or a project is not
financially feasible the speeds can be 100/20 mbps with the ablility to upgrade.
Underserved areas are defined as locations which do not have wireline connections that reliably deliver
at least 25 Mbps download speed and 3 Mbps of upload speed. Under this program, not all homes in
designated unserved or underserved areas will be served due to the potential expense of extremely hard
to serve address locations.
State House Bill 947
Filed on May 11, 2021, the HB947 bill called “The GREAT Broadband Expansion Act” is legislation
directed at establishing the state’s Completing Access to Broadband program and support
broadband expansion through the GREAT grant program utilizing federal American Rescue Plan
Act Funds.

Preceding Projects in Person County
In 2014, ECC conducted a broadband study to identify the state of the telecommunications industry in the
County. Based on the results of the study a number of recommendations were developed to help the
County move forward with broadband initiatives.
In 2016, the County developed and made public a broadband survey campaign to collect information from
residents and businesses to understand areas of need. In the same year the County released an RFP to
identify a service provider partner to work with to develop last mile solutions in underserved areas.
An agreement with NC Wireless (now RiverStreet) resulted in an investment by the County of $250,000 in
grant funds and NC Wireless matching that with an additional $275,000 to deliver last mile services via
fixed wireless technology to end users.
Beginning in 2017, the County began construction of a fiber backbone to connect the public safety towers
and a number of county and city government and other facilities. Construction was completed in early
2021. The network consists of 52 miles of 288 strand cable at a cost of $3M. The network was “overbuilt”
to allow for potential service providers and end users.
Economic Development
As discussed throughout this document, the majority of concern about inadequate broadband services
relates to residents and small business. The lack of sufficient broadband availability also affects the local
economic developer’s ability to locate and attract employers and employees.
Commission of the Study
In March of 2021, Person County, North Carolina, contracted with ECC Technologies, Inc. (ECC) to perform
a number of tasks including mapping current broadband infrastructure to the extent possible and being
prepared to consult with the County on potential next steps.
The inventory component included fiber optic and coaxial cable and tower infrastructure within Person
County. ECC’s Outside Plant (OSP) team drove specifically identified roads in the County and, to the extent
possible, physically identified and documented the County’s existing broadband infrastructure.
As per the agreed upon scope of work, ECC did not drive populated/incorporated locations as our focus
was on the rural areas of the County. Summary maps are included in the full report including information
about fiber optic and coaxial cabling, central office and remote terminal locations, and vertical assets.
Much of the data/information has also been placed into an interactive electronic geographic information
system (GIS) database which will be provided to the County.

Broadband Infrastructure Overview
In the Appendix to the complete report, is a section which provides additional detail about each of these
technologies. This section is expecially useful for users of this report with limited technical backgrounds.
Telecommunications Service Providers in the County
Voice, video, and data services are provided to County residents and businesses by a variety of companies
using a range of technologies and infrastructures. Services can be provided, as previously discussed, over
copper wire, coaxial cable, fiber optic cable, wireless technologies, and satellite.
The incumbent telephone company, or ILEC (incumbent local exchange carrier) and the incumbent cable
TV providers are the primary owners of telecommunications infrastructure within the County. There are
several Competitive Local Exchange Carriers (CLECs) offering commercial services.
Additionally, there are two (Wireless Internet Service Providers [WISPs]), three satellite providers, and a
number of cellular companies providing access within Person County.
Each of these providers use different methods of delivering services to their customers, resulting in
varying speeds and reliability. Typically, fiber provides the fastest, most reliable speeds, while coax,
copper wire, wireless, and satellite provide lower speeds and are less reliable.
Copper wire is an older technology with limitations inherent to its structure; wireless speed and reliability
are dependent on distance from the infrastructure and clear line of sight; satellite can be compromised
by weather or obstacles like foliage. These factors are important to bear in mind when determining
whether businesses and residents truly have adequate access to effective Internet services.
Incumbent Local Exchange Carriers (ILEC)
The major ILEC providing service within the County is CenturyLink, with Frontier Communications
providing service in a very small area near the southern border. An ILEC is subject to certain federal and
state regulatory oversight for certain services.
CenturyLink
CenturyLink’s territory represents over 99% of the County, including the County seat of Roxboro. The
carrier has fiber routing through the area connecting to their Central Offices (COs) in the County as well
as ones bordering the County.
CenturyLink offers DirecTV, voice, data services, DSL, cloud services, and managed services to the
businesses and residents in the County. According to its FCC 477 filing they offer DSL from 1 to 940 Mbps
down and 0.25 to 940 Mbps up for both residential and business service.

Frontier
Frontier is the incumbent telephone company for a very small area along the southern border of the
County. Frontier has one Central Office located in Durham County that serves Person. According to its
website and the FCC 477 database, Frontier can provide DSL based Internet service that ranges from 1 to
12 Mbps download and 128 Kbps to 1 Mbps upload depending on customer location, as well as phone
and TV service (DISH).
Competitive Local Exchange Carriers (CLEC)
Competitive Local Exchange Carriers (CLECs) are telephone companies which compete with the Incumbent
Local Exchange Carriers (ILECs). CLECs arose as a result of the Telecommunication Act of 1996, which was
intended to promote competition among long distance and local phone service providers.
The term is used to differentiate between new or potential competitors and established local exchange
carriers. ECC identified two CLEC type companies with facilities in Person County: Level 3 and Windstream
as facilities based providers.
Level 3/CenturyLink
Level 3 (acquired by CenturyLink in 2017) reported they are providing fiber-based services to non-
residential customers in selected blocks in Person County.
Windstream (Earthlink and Paetec)
Windstream is a national CLEC that provides competitive service (CLEC) in some marketplaces. According
to its FCC 477 filing report, Windstream provides copper-based and fiber service to a few non-residential
customers in the Roxboro area.
Cable Provider
Cable providers offer their service via fiber optic or coaxial cable. Spectrum Communications (formerly
Charter) is the sole cable TV provider in the County.
Spectrum operates a hybrid fiber/coaxial-based network system in the County, which gives it the
capability to provide dedicated business-based fiber services including ethernet, voice, video, managed
services, and high bandwidth residential service over coaxial cable.
According to its FCC filing, Spectrum provides residential “triple play” services of voice, Internet and cable
TV at prices starting at $99 in the area. Speeds of 940Mbps are offered to both residential and business
customers. Business service packages start at 200Mps and include business voice services with no
contracts.
Both fiber and coax can be used to provide broadband service. This is shown on the map in the full report,
which shows the extent of coaxial service within the County.

Wireless Internet Service Providers (WISPs)
Wireless Internet service providers (WISPs) are not cellular providers but use radio frequencies to transmit
signals from a tower to a receiver at the home or business and generally rely on line-of-sight to transmit
a clear signal. Most WISPs utilize unlicensed spectrum in the 5.8 ghz frequency space. This is an efficient
spectrum for usage but is compromised by line of sight requirements and certain limitations on the
concurrent number of users at high speeds.
Most fixed wireless equipment manufacturers now represent themselves as coexisting with fiber as a
component of a hybrid solution, rather than a fiber alternative or replacement.
RiverStreet (NC Wireless)
RiverStreet Networks is based in Wilkesboro, NC and is a subsidiary company of Wilkes
Telecommunications. Wilkes is a telephone cooperative in Wilkes County, North Carolina that utilized
federal grants awarded in 2009 to expand fiber based services through that county.
According to its FCC 477 report, utilizing fixed wireless technology, RiverStreet provides a maximum speed
of 25 Mbps down and 3 Mbps and provides service in certain areas of the County for residential and
commercial users. According to its web site, slower speed (3Mbps) services start at $34 per month.
Person County has been working with RiverStreet (NC Wireless) following a 2017 award from the County
to expand wireless services in underserved areas. RiverStreet has further partnered with the Piedmont
Electric Membership Corporation (PEMC), an ECC client, to utilize the fiber backbone owned by PEMC to
assist in service expansion in the County.
US Cellular
US Cellular is the other fixed wireless provider identified in this study and in addition to its cellular service,
offers 2 Mbps using unused cellular bandwidth, with coverage throughout most of the County. Due to its
very limited bandwidth offering, US Cellular is not considered a viable broadband option in the County.
Satellite Services
Satellite providers use geostationary satellites orbiting the Earth to transmit signals from the Network
Operations Center (NOC) to a satellite dish mounted on a business or residence. Line of sight is required.
According to their 477 reports, both Hughesnet and Viasat claim 100% residential coverage into Person
County. As with all satellite providers, one of the greatest issues with service is latency. This proves
problematic when users are engaging in time sensitive activities, such as video conferencing or voice calls.

Cellular Service Providers
There are four national cellular service providers with complete or partial coverage in Person County with
varying connection speeds. The providers’ website coverage maps for AT&T Wireless, T-Mobile, Verizon
Wireless and US Cellular show they provide 4G and 5G GSM and LTE coverage.
Cellular providers use radio frequencies to complete phone calls, send text messages, and transmit data
from the nearest cell tower to the phone in use. Cellular frequencies are licensed with fixed bands
assigned by the FCC to the providers. Therefore, one provider is unable to “step on” another providers’
frequencies and impact service to their subscriber.
Regional Wide Area Networks
Microelectronics Center of North Carolina (MCNC)
In 1985, in collaboration with the State of North Carolina, MCNC began creating the statewide North
Carolina Research and Education Network (NCREN) to provide the first broadcast-quality, two-way
interactive, multipoint video and audio system in the United States. Their fiber route is located through
the central section of Person County routing east and west and collocating in Roxboro. This 144-strand
count fiber has a number of alternative service providers on it today, including RiverStreet, Conterra, and
others that provide service anywhere along the MCNC route.
ECC Technologies is the sole authorized commercialization partner for MCNC.
Person County Proprietary Fiber Network
As previously discussed, the County undertook a project several years ago to construct a proprietary fiber
network. That network is in operation today.
Piedmont Electrical Membership Corporation Fiber Network. (PEMC)
Piedmont has constructed a significant fiber network to support electric company operations. PEMC has
consistently expressed no interest in providing direct internet services to their member owners.
However, they have stated their interest in supporting expansion of broadband in the counties they serve
and view the availability of their network as an asset to such efforts by other providers.
FCC Based Data Regarding Broadband Availability
As previously discussed, broadband providers must submit data to the FCC twice each year on their
broadband deployments. Form 477 is the FCC nomenclature which establishes the format of the data
submitted. This FCC data is only granular to the census block level; meaning if as few as one location within
a block is served by any provider, the whole block is reported as being served.

Outside Plant Inventory
A vital part of the project which supports broadband availability gap analysis is the Outside Plant (OSP)
inventory work which consists of several integrated steps.
Initial Planning
In planning the OSP work, ECC reviewed its previous Person County study. The ECC team accessed prior
notes, the GIS database, and other data from the previous study to build the baseline for the current
study. ECC further requested current GIS information from the Person County GIS team which was then
integrated into the baseline database to expand the dataset and enrich the current map views.
ECC further acquired data from third party sources. Some of these are proprietary database sources
which provide verified GIS data; others are public sources including the FCC, and the NC State BIO group.
The result of this work is the creation of the “map book” and drive plan. This is an electronic record
utilized by the OSP team in the County. The “map book” is not only electronic, but it is also reduced to
paper and placed in a three ring binder for use during the outside work.
Outside Plant Inventory
This map was provided to the County for review and acceptance prior to any OSP work. Once
approved, the OSP team began the fieldwork. The team validated existing fiber and documented new
fiber. They further looked for intersections where new fiber was spliced into existing cabling – the new
fiber routes were then followed and documented.
With incorporated areas having cable coverage, those areas such as Roxboro, were excluded from the
OSP work for reasons of time and expense.
End User Surveys
In considering areas within Person County service gaps, it is important to first analyze households and
non-residential entities. Feedback from County residents is a critical componet in the evaluation of
unserved and underserved locations.
Assessment
Three separate surveys have been conducted within the county to garner input from residents. The
County conducted a proprietary survey; the State of North Carolina Broadband Infrastructure Office
maintains an ongoing assessment, and RiverStreet Networks also completed a demand assessment.
Existing Services
Maps in the full report provide additional detail about the availability of lowband DSL and high band
coaxial based Internet access in Person County.

Summary of Options
The study has confirmed there are areas within the County without access to acceptable broadband
services or the infrastructure to support the delivery of such services. Like other communities, the County
has the option to request providers implement their own programs via RDOF, NTIA, Reconnect, or other
means.
Due to certain performance components of these programs, the programs will not provide terrestrial
coverage of all of the unserved areas and some buildouts may require a six-year wait or longer.
Assumptions ECC is making with respect to potential solutions are that the County does not want to be a
service provider and deliver broadband service to any premises.
Person County could play a supporting role by considering opportunities to incentivize providers to
expand services to the unserved areas of the County. The County has held constructive conversations
with existing and alternative providers as a first step in reviewing such opportunities.
In taking a leadership role, the County has several options in which to accomplish its goals of 100%
broadband availability. We believe and recommend that any options considered by the County should
include partnerships between the County and service providers working together.
Understanding basic concepts relating to networks, as outlined in the full report, is helpful when
considering potential options. In any of the options presented below the County should consider the use
of Non-Provider infrastructure installed in the County as an incentive for investment; in other words,
utilize the existing asset owned by the County. Additionally, the County should require a minimum 100
Mbps x 100 Mbps service be installed to an end user.
Option 1
The County can potentially self-fund the build-out of fiber or fixed wireless infrastructure needed to
provide unserved end users with broadband access. The County would need to partner with a reliable
established broadband provider to operate the network and manage the customer experience.
This option would have a significant level of expense and could represent a direct burden to the taxpayers.
It does, however, allow for a shared revenue relationship which would allow the County to recover some
of the construction and operating costs.
Several communities across the U.S., mostly cities and some villages, are implementing this model. It is
widely known as Municipal Broadband and examples in North Carolina include the cities of Salisbury and
Wilson. ECC does not recommend this as an option for Person County.

Option 2
The County can consider releasing an RFP or enter into a direct negotiation with service providers to create
partnerships with broadband service providers. These partnerships would serve to solicit grant funds to
pay for infrastructure needed to expand broadband to unserved areas. The next round of the North
Carolina GREAT Grant funds may be insufficient to construct enough new network to completely close the
broadband gap in the County; but could provide a significant jump start for service providers.
Option 3
The County could consider the use of American Rescue Plan (ARP) or newly approved Infrastructure funds
to incentivize a service provider to advance buildouts and services. As described in Option 2 above, it is
indeterminate at this time if the amount of funds available is sufficient to build new network to all
unserved areas of the County.
Use of Non Provider infrastructure
Within Person County are fiber assets owned by Person County, PEMC and MCNC. Each of these fiber
assets offer the County and its potential partners opportunities to reduce the costs and the time
associated with building out middle mile fiber. Each of these fiber assets can potentially be utilized by a
viable provider willing to use the fiber and build from the fiber to extend service into unserved areas.
Access to nonprovider fiber enables providers to focus the bulk of their costs on building last mile
solutions. From a financial standpoint, the use of fiber owned by Person County, PEMC or MCNC would
provide an financial advantage in justifying investment into the County by providers.
If considering expansion of existing fiber assets, the County can further consider how the fiber could
benefit anchor institutions such as municpal government, education, healthcare, etc.
Use of County fiber infrastructure could qualify the County to create an Open Access fiber model which
could provide cost savings and shared operations expense to the County in support of the fiber network.
Conclusion
In this study, ECC has identified areas within the County that continue to be unserved and underserved
(gaps). We have provided, at a summary level, options to assist in closing these gaps such as building out
needed infrastructure and providing service and releasing RFP’s, seeking partnerships with providers to
install the needed infrastructure and services.
The County and community at large have resources that may be brought to bear. Such resources include
access to installed County owned fiber, Rights of Way, and vertical structures such as communications
and water towers. As discussed in the full report, several options for funding may be available to the
County such as state grants, newly approved Infrastructure funds, and County general funds.

Expansion from the current County fiber network could offer new and competitive solutions to anchor
institutions within the County such as healthcare, education, government and businesses. Attracting
these anchor tenants for the County’s fiber network provides ongoing funding to help support the fiber.
ECC believes the next steps are to meet with the County team to discuss in detail the options available
and help select the appropiate path forward.

GLOSSARY
BACKBONE. Backbone, in the context of networking, refers to the highest speed and widest bandwidth
point of a communications circuit or path. In most cases, all information central to the users is connected
to the backbone (e.g., shared databases or servers).
BANDWIDTH. Bandwidth is the amount of data that can be carried by a circuit between two points of a
network. Bandwidth is typically measured in Hertz (cycles per second), bits per second or kilobits per
second (shortened to Bps or Kbps). The top speed of today’s modems is 56,000Bps or 56Kbps.
The wire connecting a private home to the telephone company carries up to 128,000Bps while one strand
of fiber optics can carry 20,000,000,000 (20 Gigabits). A 20Gbps fiber optic strand can interconnect
357,000 telephone calls.
8 bits equal one byte of data – a byte is generally the same as one character – for example the letter “a.”
BROADBAND. Broadband is a descriptive term for evolving digital technologies that provide consumers
a signal switched facility offering integrated access to voice, high-speed data service, video-demand
services, and interactive delivery services.
CATV (Cable Television System). A broadband communications system capable of delivering multiple
channels of programming from a set of centralized satellite and off-air antennae, generally by coaxial
cable, to a community. Many cable-television designs integrate fiber-optic and microwave links.
A service through which subscribers pay to have local television stations and additional programs brought
into their homes from an antenna via a coaxial cable.
CENTRAL OFFICE (CO). A CO is a major equipment center designed to serve the communications traffic
of a specific geographic area. CO coordinates are used in mileage calculations for local and interexchange
service rates. A Central Office usually has less than 100,000 telephone lines within its wire boundary. COs
are usually owned and operated by LECs.
CLEC (Competitive Local Exchange Carrier). A CLEC is a telephone company that competes with the
incumbent telephone company. The formation of these organizations is a direct result of the
Telecommunications Act of 1996.
COAXIAL CABLE. A type of cable used for broadband data and cable systems. Also known as “coax.”
Coaxial cable is composed of an insulated central conducting wire wrapped in another cylindrical
conducting wire. It is usually wrapped in another layer and an outer protective layer and has the capacity
to carry great quantities of information.

DARK FIBER. Dark Fiber is fiber optic cable, typically between end user locations, that the end user owns,
lights, and operates.
DSL (Digital Subscriber Line). DSL is technology that allows for the simultaneous transmission of voice
and Internet data over a single telephone line. Central Offices that have DSL technology can support DSL
services to customers within approximately 18,000 feet of the Central Office.
DSL is delivered either asymmetrically (ADSL) or symmetrically (SDSL). ADSL lines have download
transmission rates higher than upload rates and are typical for residential or business users that receive
much more Internet content than they send. SDSL are for businesses that generate and receive large
amounts of Internet data.
DOWNLOAD SPEED. The rate at which data is transferred from the Internet to the user’s computer is
termed download speed. This speed is typically stated in Megabits (1,000,000 bits) per second or Gigabits
(1,000 Megabits) per second.
FIBER OPTICS. The technology of guiding and projecting light for use as a communications medium. Hair-
thin glass fibers that allow light beams to be bent and reflected with low levels of loss and interference
are known as “glass optical wave guides” or simply “optical fibers.”
This cable comes in two types, single mode and multimode, each with its own unique place in
communications. Single mode FO cable is typically used where long distances and very high speeds are
required, while multimode is used for intra-building communications and places where lower bandwidths
are required.
FIBER-OPTIC CABLE. A cable containing one or more optical fibers.
INCUMBENT LOCAL EXCHANGE CARRIER (ILEC). An ILEC is the local telephone company that provides
service to business, organizations, and residences within the LATA. The ILEC is responsible for the
development, maintenance, and support of cabling infrastructure necessary to provide
telecommunications services within the LATA.
INTERNET. A widely used public computer network, initially developed by the U.S. military that links
smaller computer networks and allows users on different electronic-mail systems to communicate with
one another on a global scale.
INTERNET PROTOCOL (IP). In TCP/IP, a connection Internet layer protocol that provides a best-efforts
datagram delivery service. Note the functional layer (TCP/IP) corresponds to the OSI model network layer.
The Internet layer provides routing and relaying functions that are used when data must be passed from
a host to some other network in the Internet. It operates in the source and destination hosts and in all the
routers along the path between the hosts.

ISP (Internet Service Provider). A company that provides access to the Internet to individuals or
companies. Some ISPs lease connections from Internet backbone providers.
LANDLINE. Traditional wired phone service.
LAST-MILE. Last Mile is used to describe the final connection to a building, as differentiated from the high
capacity circuits extending across a city or County. The connection from the cable television trunk cable
to your house is considered a “last-mile” connection.
NETWORK. Any connection of two or more computers that enables them to communicate. Networks may
include transmission devices, servers, cables, routers, and satellites. The phone network is the total
infrastructure for transmitting phone messages.
RF (Radio Frequency). RF refers to the electromagnetic waves operating between 10KHz and 3MHz
propagated without guide (wire or cable) in free space.
RIGHT-OF-WAY. Right of Way (ROW) refers to a designated space alongside a street or other access (such
as a railroad line). An entity wishing to install fiber optic cable between various sites/locations must first
obtain the rights to a path along those routes. As the cable may be installed underground or on poles,
right-of-way access may be granted by a city, a private landowner, or the owner of poles such a cable
company, a telephone company or power company. Cities typically require written permits— usually for
a fee.
SERVICE PROVIDER. A telecommunications provider that owns circuit switching equipment.
UPLOAD SPEED. The rate at which data is transferred from the user’s computer to the Internet is termed
upload speed. This speed is typically stated in Megabits (1,000,000 bits) per second or Gigabits (1,000
Megabits) per second.
WAN (Wide Area Network. WAN is used to extend LAN connectivity beyond a city or County, usually
through common carrier facilities.
WIRELESS. Wireless describes a means of sending signals (voice, video or data) “over the air” rather than
using cables. To date, wireless bandwidth rates (capacities) are significantly lower than wire rates. There
are significant new developments in wireless, many of which will come to market in 2014 and beyond.
