Derrick Sims S.Ellis Hankins, County Attorney Charlie Palmer Patricia Gentry The Board of Commissioners for the County of Person, North Carolina, met in regular session on Monday, June 7, 2021 at 7:00pm in the Person County Office Building Auditorium. Chairman Powell called the meeting to order and requested a moment of silence for the 6,000 young men that died 77 years ago, in 1944, in France, now referred to as D-Day. Chairman Powell offered an invocation and Commissioner Sims led the group in the Pledge of Allegiance. DISCUSSION/ADJUSTMENT/APPROVAL OF AGENDA: Chairman Powell requested a Closed Session #1 to be added to the agenda related to economic development and for Item #3 for consideration to Grant or Deny a request to appropriate an estimated $1,899,000.00 to assist Project Famous to locate in Person County, NC, and to execute an economic development agreement at the appropriate time to be moved on the agenda to follow the added Closed Session #1. A motion was made by Commissioner Sims and carried 5-0 to approve the agenda with the adjustments as requested by Chairman Powell. PUBLIC HEARING: FISCAL YEAR 2021-2022 RECOMMENDED BUDGET: A motion was made by Commissioner Sims and carried 5-0 to open the duly advertised public hearing to hear public comments for the Fiscal Year 2021-2022 Recommended Budget. Chairman Powell asked the Clerk to the Board to announce who had signed up and to limit each individual to two minutes each. The following individuals appeared before the Board not necessarily speaking in favor or in opposition to the Fiscal Year 2021-2022 Recommended Budget: 3 June 7, 2021 2 Mr. Joseph Woody Jacobs of 107 Old U.S. 501, Roxboro said technology was no longer just one vehicle for success, it is the vehicle all possible success depends on and businesses demand technology innovation in response to a radically changing world. Mr. Jacobs stated broadening the horizon by investing in Advanced Technology makes the boldest ambitions achievable and the new future is on the horizon here in Person County. Mr. Jacobs asked the Board to build the future for Person County faster than the competition. Ms. Meredith Summey of 1512 Echo Road, Durham, and Human Resources Director for Polywood representing 325 employees to date stated her excitement about the possibility of an Advanced Technology Center noting how important it is to businesses to have employees trained which saves time and money. Mr. Charles Harvey of 426 Holly Springs Drive, Timberlake advocated for the Advanced Technology Center (ATC) as an industrial revolution 5.0 demands advanced technology and artificial intelligence for its workforce. Mr. Harvey asked the Board to invest in the ATC with a shared commitment for Person County’s future. Mr. John Seepe of 277 Barefoot Landing Lane, Semora inquired why the ask for an Advanced Technology Center was being considered along the 501 corridor and not located on PCC’s campus. Mr. Seepe stated the Airport was operating in the red, costing the county. Ms. Cindy Lynch of 395 Union Grove Church Road, Hurdle Mills asked the Board to take a look Person Industries’ expenditures and why the Recycling Center was operating at a loss of a half a million. A motion was made by Commissioner Sims and carried 5-0 to close the public hearing for the Fiscal Year 2021-2022 Recommended Budget. 4 June 7, 2021 3 PUBLIC HEARING: REQUEST TO APPROPRIATE ESTIMATED $1,899,000.00 TO ASSIST PROJECT FAMOUS TO LOCATE IN PERSON COUNTY, NC, AND TO EXECUTE AN ECONOMIC DEVELOPMENT AGREEMENT AT THE APPROPRIATE TIME: A motion was made by Commissioner Palmer and carried 5-0 to open the duly advertised public hearing for a request to appropriate an estimated $1,899,000.00 to assist Project Famous to locate in Person County, NC, and to execute an Economic Development Agreement at the appropriate time. Economic Development Director, Sherry Wilborn stated this public hearing was being held for consideration to appropriate an estimated $1,899,000 to assist Project Famous to locate a manufacturing operation in Person County, NC. This competitive, confidential project proposes to invest $61.6 million and to create 300 jobs over five (5) years with an annual average wage at or above $47,120. Ms. Wilborn said the Project, if implemented, has the potential to stimulate the attraction of new, and the expansion of existing, businesses within the County, to stimulate commercial activity, to generate additional tax revenue, and to enhance the tax base and economic vitality of the County. The financial incentive would come in the form of an annual cash grant over a ten (10) year period payable only after jobs and investment benchmarks have been met. Ms. Wilborn requested the Board to approve an appropriation of County General Funds to assist Project Famous to locate or expand in Person County with a financial grant incentive over a ten (10) year period at an estimated total cost of $1,899,000.00 and to authorize the Board Chairman to execute a written agreement at the appropriate time that complied with applicable legal requirements as advised by the County Attorney. There were no individuals appearing before the Board to speak in favor of or in opposition to the request to appropriate an estimated $1,899,000.00 to assist Project Famous to locate in Person County, NC, and to execute an Economic Development Agreement at the appropriate time. A motion was made by Commissioner Gentry and carried 5-0 to close the public hearing for a request to appropriate an estimated $1,899,000.00 to assist Project Famous to locate in Person County, NC, and to execute an Economic Development Agreement at the appropriate time. 5 June 7, 2021 4 PUBLIC HEARING: PETITION RZ-02-21 REQUEST BY GEORGE ANDERSON, ON BEHALF OF PROPERTY OWNERS JEFFREY AND MARYBETH CECIL FOR A REZONING/MAP AMENDMENT FROM RESIDENTIAL TO RURAL CONSERVATION ON 4.5 ACRES (TAX MAP & PARCEL A4-15) LOCATED ON KELLY BREWER ROAD: A motion was made by Vice Chairman Puryear and carried 5-0 to open the duly advertised public hearing for Petition RZ-02021, a request by George Anderson, on behalf of property owners Jeffrey and Marybeth Cecil for a rezoning/map amendment from Residential to Rural Conservation on 4.5 acres (Tax Map & Parcel A4-15) located on Kelly Brewer Road. Lori Oakley, Planning Director stated after the public hearing was advertised and letter mailed to the adjacent property owners, the applicant on May 28, 2021 requested to withdraw the rezoning request, petition RZ-02-21. By withdrawal of the application, there was no need to entertain public comments and no action was required upon closing the public hearing. A motion was made by Commissioner Gentry and carried 5-0 to close the public hearing for Petition RZ-02021, a request by George Anderson, on behalf of property owners Jeffrey and Marybeth Cecil for a rezoning/map amendment from Residential to Rural Conservation on 4.5 acres (Tax Map & Parcel A4-15) located on Kelly Brewer Road. INFORMAL COMMENTS: The following individuals appeared before the Board to make informal comments: Dr. Mike Lewis, Executive Vice President and Chief Information Officer with Trillium Health Resources, a local management entity (LME) that manages Medicaid mental health dollars for counties said Person County’s current LME, Cardinal Innovations was going to merge with another LME from Asheville, NC. Dr. Lewis requested the Board to give Trillium Health Resources an opportunity to serve as Person County’s LME with its wide array of services; he said Trillium currently serves as the LME for 26 counties. Mr. John Seepe of 277 Barefoot Landing Lane, Semora noted his experience as the County’s GOP Vice President attending the recent NC Republican State Convention in Greenville hearing from many GOP leaders. He requested the Board to work with each other showing respect, integrity of the process and communicating with citizens. 6 June 7, 2021 5 Mr. Avie Lester, Sr. of 7495 Virgilina Road, Roxboro, NC 27574 addressed the Board, on behalf of Person County NAACP and concerned citizens seeking information and a more definitive timeline with regards to plans to remove the confederate memorial from its present location on the courthouse grounds. Although this matter has come before this body previously and received positive support for removal, no action has occurred. Mr. Lester requested a public response for a status update about the plans for the removal of this Confederate memorial. Ms. Cindy Lynch of 395 of Union Grove Church Road, Hurdle Mills asked the Board about an item on the agenda to establish term limits for the Animal Services Advisory Committee. As written, Ms. Lynch said it appeared to be a three-year term limit meaning to her how many times a citizen can serve is one 3-year term and was not sure this was the intent. Mr. Chance Sanford of 400 Clayton Road, Roxboro responded to Mr. Lester’s comments noting the previous iteration of the Board of Commissioners voted to remove the statute under NC General Statute as it caused a public safety hazard. Mr. Sanford noted the County did not want to pay for the removal and relocation with county funds and it was up to the public to raise those funds. Mr. Sanford stated to date over $5,000 has been raised and he estimated $25K needed. Mr. Sanford invited anyone wishing to chip in to do so noting that he did not agree that the public should have to raise the funds. Mr. Sanford said before moving forward and progressing to the future, to fix some of the past transgressions. DISCUSSION/ADJUSTMENT/APPROVAL OF CONSENT AGENDA: A motion was made by Commissioner Sims and carried 5-0 to approve the Consent Agenda with the following items: A. Approval of Minutes of May 3, 2021, B. Approval of Minutes of May 17, 2021, C. Budget Amendment #18, D. Budget Amendment #19, E. American Rescue Plan Act Grant Project Ordinance Resolution, and F. Joint Use Agreement Renewal: Person County Recreation, Arts, and Parks Department and the Person County Board of Education 7 June 7, 2021 6 NEW BUSINESS: MORGAN STREET ROADWAY RECONFIGURATION: John Sandor, PE, District Engineer with Division 5, District 2 Office for the North Carolina Department of Transportation (NCDOT) stated by request of the City of Roxboro he was there to gain the County’s support as Morgan Street was due to be resurfaced this fall and it presented an opportunity to incorporate changes from the Semora Road intersection to the Chub Lake intersection. Reports of speeding have long been received by NCDOT along this section of road in town. The context of the road is a mix of residential/school/park/offices. There are several driveways accessing the road as well as several intersections with many local streets. In recent years, NCDOT constructed a mini- roundabout in an effort to help slow speeds along this corridor as well as address a crash problem at the intersection of Long Ave. There are also sidewalks on both sides of the street as well as several mid-block crosswalks. Mr. Sandor said there is currently over 30 feet of pavement and the road is striped with three lanes. The proposal is to consider restriping this road during the resurfacing project in the next 18 months to eliminate the center turn lane and introduce either on-street parking or bike lanes to help reduce the “wide” feel of the road, which is known to cause speeding. Below are two concepts that show the cross-section of the road which could be applied here. The below cross-section that shows on-street parking in this application could not include the bike lanes due to there not being enough pavement. 8 June 7, 2021 7 Mr. Sandor said roadway reconfigurations similar to the above options have been implemented across the country on like roads and have yielded great success with low cost. Studies have shown improved safety as well as reduced speeds. Capacity would not be changing with this recommendation, only the loss of the center turn lane. Where vehicles currently have a lane to wait to make a left and not block traffic, will now block traffic. Mr. Sandor added the current facility could accommodate a park option on one side with a bike lane on the other side. Commissioner Palmer, a resident on Morgan Street noted his frustrations and concerns about the vehicle speeds increasing since the roundabout was installed to which Mr. Sandor was sorry the roundabout had not affected to calm traffic as intended. ANIMAL SERVICES ADVISORY COMMITTEE: Animal Services Director, Kelli Oakley, on behalf of the Animal Services Advisory Committee requested that the Board of Commissioners establish terms for four citizen-at- large positions, effective July 1, 2021. The advisory committee requested that citizen positions 1. (Kay Farrell) and 2. (Cindy Martin) initially be a two-year term, and citizen positions 3. (Heath Gill) and 4. (Cathy Williams) be a three-year term, beginning July 1, 2021. Thereafter, three-year terms would apply to all members appointed to citizen positions. Upon approval by the Board, Ms. Oakley said the citizen term provisions would be added to the Animal Services Advisory Committee Rules of Procedure. A motion was made by Vice Chairman Puryear and carried 5-0 to establish terms for the four citizen-at-large positions on the Animal Services Advisory Committee, as presented. 9 June 7, 2021 8 CHAIRMAN’S REPORT: Chairman Powell reported his recent conversations with Representative Yarborough, Representatives of Ted Budd’s Office, the Governor’s Office, and Representative Thom Tillis regarding Person County receiving its share of federal funding to be used primarily for economic development and broadband. MANAGER’S REPORT: County Manager, Heidi York reported the Board approved a Project Ordinance for the American Rescue Funds in the Consent Agenda; she stated her plan once the budget for the upcoming year has been adopted, will be brought before the Board to provide input on how the expend those funds by the deadline of 2026. Ms. York reminded the Board that their first budget work session was scheduled for June 8, 2021 starting at 2:00pm in the Commissioners’ Boardroom; she asked if commissioners had specific questions or would like departmental directors available to answer questions, to please let her know. Ms. York recognized the transition Person County will be facing with Cardinal Innovations, the county’s current LME noting she will be keep the Board abreast as updates are available. COMMISSIONER REPORT/COMMENTS: Vice Chairman Puryear thanked the Person County Veterans Council for a great Memorial Day event to honor all fallen heroes noting it was a very sensitive day to the County’s gold star families. Commissioner Palmer thanked the Administrative staff for the hard work on getting the budget ready for the Board’s review. Commissioner Gentry concurred with Commissioner Palmer’s comments noting the state mandates the county processes in the budget and other areas, i.e. the public hearing for a confidential project. Commissioner Sims thanked all individuals that made public comments; he thanked staff for putting the budget together noting the budget work sessions will be a time to work together toward an adopted budget. It authorizes the provision of emergency medical, rescue, and/or ambulance services in the Person County Fire Protection District and enables Person County to levy property taxes for such purposes. The resolution takes effect July 1, 2021. The Person County Board of Commissioners established the Person County Fire Protection Service District, effective July 1, 2018, to provide and fund fire protection services in the unincorporated areas of Person County. Generally, in order to provide multiple services within a single district, the services need to have been identified in the report generated on the proposed district and adopted in the governing board’s resolution establishing the district. G.S. 153A-309 provides an exception to this process. If a service district initially was established for fire protection purposes only, the Board of Commissioners may adopt a resolution to permit the service district to provide emergency medical, rescue, and/or ambulance services and to use service district tax proceeds to fund these services. The Roxboro-Person County Rescue Squad responds to emergency calls within Person County that require specialized equipment and technical skill for patient rescue, including water rescue and land search and rescue. Fire district taxes provide a funding source for the Rescue Squad. The Roxboro-Person County Rescue Squad is a non-profit organization, distinctive from the Person County EMS Division. The EMS Division is funded through the County’s General Fund and serves as the lead agency for the emergency medical services system in Person County and is responsible for coordinating all system participants in Person County; encompassing both public and private sectors including the medical first responder program. Expanding the services permitted in the service district supports the Board of Commissioners desire to fund rescue services with service district tax proceeds in accordance with G.S. 153A- 301(a). Submitted By: Keith Duncan, Fire Marshal 40 A RESOLUTION OF THE PERSON COUNTY BOARD OF COMMISSIONERS  TO PERMIT THE PERSON COUNTY FIRE PROTECTION SERVICE DISTRICT TO  PROVIDE RESCUE SERVICES  WHEREAS, Article 16 of N.C. Chapter 153A, of the North Carolina General Statutes, authorizes  counties within North Carolina to define service districts in order to finance, provide, or maintain for the  districts one or more of the following services, facilities and functions in addition to or to a greater extent  than those financed, provided or maintained for the entire county; and  WHEREAS, N.C. General Statute §153A‐301(a) provides that the county may define  a service district for the purposes of fire protection and rescue services; and  WHEREAS, pursuant to N.C. General Statute. § 153A‐302(c), the Person County Board  of Commissioners held a duly noticed and advertised public hearing on the proposed Person  County Fire Protection Service District on June 18, 2018 and adopted a resolution  defining said district on June 4, 2018.  WHEREAS, N.C. General Statute §153A‐309 provides if a service district is established for fire  protection purposes under G.S. 153A‐301(2), and it was not also established for rescue purposes under  G.S. 153A‐301(7), the Board of County Commissioners may, by resolution, permit the service district to  provide emergency medical, rescue, and/or ambulance services, and may levy property taxes for such  purposes under G.S. 153A‐307.   NOW, THEREFORE, BE IT RESOLVED BY THE PERSON COUNTY BOARD OF COMMISSIONERS THAT:  1.The Person County Fire Protection Service District may provide emergency medical, rescue, and/or ambulance services, 2.The Person County Board of Commissioners may levy property taxes for such purposes, and 3.This resolution shall take effect at the beginning of fiscal year starting July 1, 2021. The FY22-FY23 contract template has been updated to incorporate new fire tax disbursements (resulting from redrawing district lines following the decertification of Woodsdale VFD), audit requirements, and other minor changes. The contract template has been reviewed by county management, Emergency Services staff, the county attorney, and the Fire Chiefs Association. The FY22 Manager’s Recommended Budget includes funding in the following amounts, which will be inserted into the contract for each department following approval by the Board of Commissioners. Submitted By: Keith Duncan, Fire Marshal Attachments: 1.Fire Protection Contract template 2.Rescue Services Contract template 42 Page 1 of 6   State of North Carolina  Person County  Fire Protection Contract    This agreement, made and entered into this 1st day of July, 2021, by and between Person  County, North Carolina, a political subdivision of the State of North Carolina, hereinafter called  “County” and the Volunteer Fire Department, a nonprofit corporation organized under the  laws of the State of North Carolina, hereinafter called “Department.”    Witnessed:    WHEREAS, Department has agreed to provide continuing fire and rescue protection  service within its primary area of coverage, and other areas on the basis of mutual aid contracts  with other county fire and/or rescue departments for the benefit of the citizens of Person  County; and    WHEREAS, G.S. 153A‐11, 153A‐13, and 153A‐233 authorize County to provide  Department with financial support for the above‐described services; and will compensate  Department in the amount of $$$$$$$$$ as determined annually during County’s budgeting  process; the amount to be paid when all required documentation has been received and  concluded to be in good standing during the term of this agreement as outlined herein; and                  WHEREAS, this agreement shall become effective the 1st day of July, 2021, and will  provide for automatic extensions every two (2) years with an increase in payment of 2% every  odd year beginning 1st day of July, 2023 of their annual budgeted amount awarded by the  Board of Commissioners, subject to the continued legal existence of the Fire District and the  VFD, the agreements and requirements and the termination provisions herein; and    WHEREAS, County desires that the Department furnish fire protection during times of  emergencies/disasters providing services as outlined below and in Section II C (9) of the current  version of the Person County Emergency Operations Plan and provide other lifesaving and  property protection measures as necessary for and within the District; and    NOW THEREFORE, in consideration of the mutual benefits to the parties hereto, and  based upon the mutual covenants contained herein and the considerations stated herein, the  parties do hereby covenant and agree as follows:    I. PURPOSE OF AGREEMENT AND DEPARTMENT IN USE OF FUNDS.  A. Purpose of Agreement: County shall provide funds to Department for the provision of  continuing fire and rescue protection as follows:  1. Department agrees to furnish and provide continuing fire and rescue protection  service to all citizens of its service area and all real and personal property lying  within the boundaries of the service areas.  43 Page 2 of 6   2. Department agrees to send, upon call of any person within the service area, the  available equipment necessary to answer the call and the available personnel to  operate such equipment in the judgment of the Chief of the Department or his  designee.  3. Department agrees to maintain its equipment in accordance to the standards  prescribed by the North Carolina Department of Insurance, Fire and Rescue Division.  4. Department agrees to maintain a level of personnel and have these personnel  trained as required by the North Carolina Department of Insurance, Fire and Rescue  Division.  5. Department shall be in complete operational control of its fire and rescue vehicles  and fire and rescue program including full control over volunteers, assistants and  employees.  6. Department shall provide emergency medical care as outlined in the Person County  First Responder Guidelines as a part of the Person County EMS System plan.  7. County shall operate a communications system at current levels to alert the  departments and other agencies of emergencies which occur in the County. The  County Central Dispatch shall be responsible for the dispatch of fire and rescue  departments within the primary and mutual aid areas of coverage, Department will  communicate with County Central Dispatch and other departments on the  countywide approved frequency and tactical channels.   8. Department will actively solicit and advertise for operating as well as capital funds.  9. Department complies with all financial and reporting requirements as outlined in  Section III of this Contract.  10. Department must provide documented progress towards improving the ISO rating  with a written plan submitted to the Person County Fire Marshal by July 1 of each  year to include proposed date of inspection. (Does not apply to departments that  have lowered their ISO rating to a 4.)  11. Department shall maintain certification by the North Carolina Office of State Fire  Marshal as defined in NCGS Chapter 05.    B. Reimbursement for Services during Emergencies/Disasters. Reimbursement for Fire  Department services provided in this section only applies when the state and/or federal  governments issue a declaration of disaster for the affected areas of Person County, and  only those services deemed reimbursable under the disaster declaration are eligible per  rates as determined by the state and federal governmental agencies issuing the disaster  declaration.    These additional duties listed below may become eligible for reimbursement if and  when the state and/or federal government have a declaration of disaster, depending on  what terms and services they allow reimbursement:    Section I B (1) County Volunteer Fire Departments:    1. Assists law enforcement and County Emergency Management with warning and  44 Page 3 of 6   notifying the affected population of an existing or impending emergency.  2. Plans for coordination of firefighting activities throughout the County during  disasters.  3. Supports rescue operations.  4. Provides support personnel to assist in traffic control.  5. Provides direction and control during hazardous materials incidents.  6. Provides fire protection for shelters.  7. Assists in search and rescue operations during emergency/disaster situations.  8. Identifies equipment and manpower limitations, and develops mutual aid  agreements for the procurement of needed resources during emergency and  disaster events.  9. Assists with debris removal.  10. Department agrees to be a Point of Distribution (POD) site for the County during  emergencies/disasters, upon the call of the County Manager and/or Emergency  Management Coordinator to the Chief. Consideration will be given if the POD site is  affected by the disaster or emergency.    C. Description of Department’s Service Area. Department’s service area is defined in  Exhibit A, attached hereto and incorporated herein by reference.    II. TERMINATION OF AGREEMENT; BREACH OF AGREEMENT. Each party shall have the  right to terminate by giving the other party one (1) year written notice of   termination.  In the event of termination, Department agrees to refund to County all monies received  by Department under the terms of this agreement which Department retains as of the  effective date of termination. In addition, Department shall provide County with a  financial accounting, as required by County, for all funds received by Department and  on‐hand up to the date of termination.    If Department fails to conform to any one of these terms or conditions contained in this  agreement, County shall thereupon notify Department in writing of such breach. Upon  receipt of such notification of breach, Department shall have thirty (30) days within  which to correct such breach, during which period County will take no further action. If  such breach is not corrected within such time, County may then take such corrective  action as is necessary under North Carolina law, including withholding or reduction of  funds committed, but not yet paid by County, recovery of funds previously paid by  County to Department, but not used by Department, and/or immediate termination of  this agreement.    III. DEPARTMENT FINANCIAL AND REPORTING REQUIREMENTS. Reports in this section  shall be provided to the County prior to the disbursement of any funds by the County to  the Department unless otherwise noted.    A. Financial Review. Within ninety (90) days after June 30 of each year, Department shall  provide County with an annual financial review (receipts and expenditures) and  45 Page 4 of 6   accompanying supporting information for the preceding fiscal year that covers July 1  through June 30. The accounting shall be provided by a third‐party licensed accounting  firm or CPA approved by Department’s Board of Directors. The document shall be signed  by an official authorized by the board and show the use of funds spent and the amount  and location of the remaining balance.    B. Certificate of Insurance. Department shall furnish the County a certificate of insurance  annually and will further insure that the county receives notice in the event said policy  or policies are to be cancelled.    C. Member Roster. Department shall provide annually to the County a current and  complete roster of state certified firefighter members of the department to include  contact numbers for the Chief and Assistant Chief(s), and shall update the list  throughout the year as changes occur.    D. Blanket Bonds. Department shall secure and maintain a blanket bond on all persons  who have access to or authority to disburse funds belonging to the Department. Such  blanket bond shall be in the amount of not less than the revenues to be distributed by  the County to the Department as approved by the County for the upcoming year. Proof  of such bonding shall be provided to the County prior to disbursement of any funds by  the County to the Department once this requirement becomes effective.    E. Financial Records and Retention. Department shall establish fiscal control and  accounting procedures in accordance with generally accepted accounting principles. The  Department shall keep all records on site for a minimum period of five (5) years. All  State and county required reports and rosters shall be submitted by the requested  deadlines.    F. County Access to Financial Records. Department shall allow the County Manager or  his/her designee to inspect the financial books and records of the Department at  reasonable times during regular business hours of the County. The Department agrees,  upon request, to supply such financial books, records and information or verification as  may be reasonably requested by the County. The Department shall maintain a written  accounting system which provides adequate documentation of all of its receipts and  disbursements including, but not limited to, those related to the expenditure of funds  received pursuant to this agreement.    G. Funds Disbursement. Annual funding will be disbursed once the signed contract is  received and all requirements of Section III of this document are satisfied.    IV. COMPLIANCE WITH APPLICABLE LAWS. Department agrees that in carrying out  activities of any kind funded with monies made available under the provisions of this  agreement, it shall comply with all local, state, and federal laws, standards and  regulations.  46 Page 5 of 6     V. INDEPENDENT CONTRACTOR. Department understands and agrees that in entering into  this agreement and providing services, it is acting as an independent contractor; neither  Department, nor its employees, members or personnel shall be deemed or construed to  be employees of Person County. Department shall maintain workers’ compensation  insurance of such accident and other insurance as it deems appropriate for the  protection of its employees, members, or personnel and shall maintain insurance  coverage at all times.    VI. INDEMNITY AGREEMENT. Department shall indemnify and save harmless County from  any and all liability and expenses including attorney’s fees, court costs and other costs  incurred by County caused by the negligence of the Department, its agents and  employees.    VII. ASSIGNMENT OF THIS AGREEMENT. The parties agree that this agreement is not  transferable or assignable by either party without the written consent of the other party  to this agreement.    VIII. NON‐WAIVER OF RIGHTS. It is agreed that County’s failure to insist upon the strict  performance of any provision of this agreement or to exercise any right based upon a  breach thereof, or the acceptance of any performance during such breach, shall not  constitute a waiver of any rights under this agreement.    IX. ENTIRE AGREEMENT. This agreement constitutes the entire understanding of the  parties and contains all of the terms agreed upon with respect to the subject matter  hereof. No modification or rescission of this agreement shall be effective unless  evidenced by a writing signed by both parties to this agreement.    X. The following amounts are hereby appropriated in the General Fund for the operation of the county government and its activities for the fiscal year beginning July 1, 2021 and ending June 30, 2022, in accordance with the chart of accounts heretofore established for this county and by function as listed below: Section 2. The appropriations to the Board of Education for current expense, firstly, shall be made from any funds that are dedicated to the use of the schools and secondly, shall be made from general county revenues to the extent necessary and for capital expenditures shall be by project, as listed in the categories in the budget of the Board of Education, to the extent of the amount available for capital appropriations. This rate of tax is based on an estimated total valuation of property for the purpose of taxation of $4,720,000,000 and an estimated collection rate of 97.50%. In addition to these revenues, the Reserve for Stormwater Utility Management $ 364,000 103 Page 6    County is also including registered motor vehicle tax revenues collected by the North Carolina License Plate Agencies, which is budgeted to generate $2,878,560 in revenues. Section 27. There is hereby levied a tax at the rate of $0.0275 per $100 valuation of property listed for taxes as of January 1, 2021 for the purpose of raising revenues from fire service protection district taxes included in "Ad Valorem Taxes" in the Fire Tax District Fund in Section 15 of this Ordinance. This rate of tax is based on an estimated total valuation of property for the purpose of taxation of $4,035,000,000 and an estimated collection rate of 97.50%. In addition to these revenues, the County is also including licensed motor vehicle tax revenues collected by the North Carolina License Plate Agencies, which is budgeted to generate $89,330 in revenues. Section 28. Charges for services and fees by County departments, excluding those established by state statute, are levied in the amounts set forth in the attached Fee Schedule. (Attachment 1) Section 29. The budget officer is hereby authorized to transfer appropriations within a fund as contained herein under the following conditions: a. She may transfer amounts between objects of expenditure within a department and between departments within the same functional area without limitation and without a report to the Board of Commissioners. b. She may transfer amounts up to $10,000 between functional areas of the same fund with an official report on such transfers at the next regular meeting of the Board of Commissioners. c. She may not transfer any amount between funds or from the regular contingency appropriation within any fund, except that she may transfer any amount from the Information Technology Systems Fund for technology-related items and the Fleet Management Fund for the appropriation of vehicles without a report to the Board of Commissioners. Section 30. The County Manager, or her designee, is hereby authorized to execute contractual documents under the following conditions: a. She may execute contracts for construction repair projects which do not require formal competitive bid procedures. b. She may execute contracts for: (1) purchase of apparatus, supplies and materials, or equipment which is within budgeted department appropriations, (2) leases of personal property for a duration of one year or less and within budgeted departmental appropriations, and (3) services which are within department appropriations. c. She may execute grant agreements to or from public and nonprofit organization that are within budgeted appropriations, unless grantor organization requires execution by the Board of Commissioners. d. She may execute contracts, as the lessor/lessee of real property, which are of one-year duration or less, if funds are within budgeted appropriations. e. She may execute contracts for consultant services, which consultant fees are estimated to be less than $10,000 and if funds are within budgeted appropriations. 104 Page 7    Section 31. The Finance Director may make cash advances between funds during the fiscal year without reporting to the Board of Commissioners. Any advances outstanding at fiscal year-end must be reported to the board except those involving funds where grant revenues or unreimbursed debt proceeds arise from prior county expenditures. The Finance Director may also approve amendments at the end of the fiscal year in order to maintain budgetary compliance for the Social Services Representative Payee Fund and Sheriff’s Execution Fund without a report to the Board of Commissioners. Section 32. Copies of the Budget Ordinance shall be furnished to the Budget Officer, the Finance Director, and the Tax Administrator for direction in the carrying out of their duties.
