AGENDA ABSTRACT
Meeting Date: December 2, 2019
Agenda Title: Approval of Bonds of the Finance Director, the Register of Deeds, the Tax
Administrator and the Sheriff
Summary of Information: Chapter 161(Register of Deeds) and 162 (Sheriff) of the North
Carolina General Statutes requires the Board of County Commissioners to approve the official bonds
at the first meeting in December. The Bonds are a continuation of existing bonds and were secured
by the County Human Resources Director, who also serves as Insurance Liaison. The Human
Resources Director provided information that the Sheriff’s bond, in the amount of $25,000, is for the
length of his term. The Bonds of the Register of Deeds in the amount of $50,000 and $100,000 each
for the Tax Administrator and Finance Director (amount of each Bond is dictated by legislature).
Recommended Action: Approve the Bonds of the Finance Director, the Register of Deeds, the Tax
Administrator and the Sheriff

The Board of Commissioners for the County of Person, North Carolina, met in
regular session on Monday, November 18, 2019 at 9:00am in the Person County Office
Building Auditorium.
Chairman Newell called the meeting to order. Commissioner Powell offered an
invocation and Vice Chairman Jeffers led the group in the Pledge of Allegiance.
Commissioner Puryear was absent until 9:36am.
DISCUSSION/ADJUSTMENT/APPROVAL OF AGENDA:
A motion was made by Vice Chairman Jeffers and carried 4-0 to approve the
agenda.
RECOGNITION OF LOCAL GOVERNMENT DAY:
Chairman Newell welcomed the Person High School students enrolled in civics and
economics participating in Local Government Day to observe the Board of County
Commissioners in session. Chairman Newell, Vice Chairman Jeffers and Commissioners
Clayton and Powell proceeded to introduce themselves and shared general information
about the office of a commissioner and general government. County Manager, Heidi York,
Clerk to the Board, Brenda Reaves and County Attorney, Ron Aycock also introduced
themselves.
Ms. Faith Harris, a student present in the audience, served as the Person High
School students’ spokesperson to ask the Board of Commissioners questions related to the
process of election for the office of county commissioner, what services are provided in
the County and its annual budget, as well as what are the priorities in the County. She also
shared comments of environmental concerns for livestock on farms where solar panels are
constructed and should the solar panels have leakage.

NEW BUSINESS:
SECOND READING TO ADOPT NOVEMBER 2019 SOLID WASTE DISPOSAL
FRANCHISE ORDINANCE:
Chairman Newell called for the Board to take action for its Second Reading to
Adopt the November 2019 Solid Waste Disposal Franchise Ordinance. County Attorney,
Ron Aycock reminded the group that North Carolina state law requires the Board of
Commissioners to vote on adoption of a Solid Waste Disposal Franchise Ordinance at two
consecutive regularly scheduled meetings. Mr. Aycock noted the First Reading to Adopt
the November 2019 Solid Waste Disposal Franchise Ordinance took place at the Board’s
November 4, 2019 meeting following the required public hearing with unanimous vote.
Commissioner Clayton commented on the history of the landfill noting the original
intent was for the landfill to close after 20 years. He added that state legislature has
changed causing the Board to continue its contract with Republic until such time the
landfill will be full which is estimated in about 15 years. Commissioner Clayton said this
action was after much discussion and looking at other options, such as transfer stations
taking the waste to Granville County’s new landfill. Commissioner Clayton stated he had
voted to place funding into a water and sewer fund in the case waterlines in the area near
the landfill become polluted.
A motion was made by Vice Chairman Jeffers and carried 4-0 to adopt the
November 2019 Solid Waste Disposal Franchise Ordinance.

PERSON COUNTY RECYCLING CENTER/POLYWOOD PARTNERSHIP:
Amanda Everett, Person Industries Director told the group that she and other
County and State representatives visited Polywood’s corporate offices in Syracuse,
Indiana. She shared the following presentation with the Board reviewing current projects,
future prospects, and recycling center needs as she had previously presented with
Polywood.

Polywood General Manager, Dave Grider and Stacey DeBaun, Plant Administrator
for Polywood Roxboro introduced themselves and told the group they looked forward to
partnering with the County’s Recycling Program as they review their needs for equipment
and an anticipated expansion.

LICENSED CLINICAL SOCIAL WORKER FOR PERSON FAMILY MEDICAL
CENTER TO WORK IN PERSON COUNTY SCHOOLS:
Interim Assistant County Manager, Laura Jensen stated in Fiscal Year 2021, mental
health funds that previously were used for supplementing a psychiatrist through Cardinal
Innovations will no longer be needed as the State of NC moves to managed care. Due to
maintenance of effort requirements, Person County must still allocate these funds for
mental health purposes. Ms. Jensen stated Person Family Medical Center proposed to use
a portion of the funds to hire a full time licensed clinical social worker to work in Person
County Schools to address mental health issues. Person Family Medical Center would
provide clinical supervision for the position, bill insurance for some services if appropriate,
and provide quarterly reports on the number of clients served. Privacy of clients would be
protected through an agreement meeting HIPAA requirements. Ms. Jensen noted that
Person Family Medical Center proposed beginning the position in the current fiscal year,
using $25,000 of unspent mental health funds to advertise, hire, and train a new employee
with funding to continue the position requested to be included in the Fiscal Year 2021
recommended mental health budget at $50,000.
Mr. Glenn Martin and Ms. Martha Pickett of Person Family Medical Center told
the group that this partnership presented a great opportunity for Person County Schools to
make referrals for appointments to help address mental health issues of students.
A motion was made by Vice Chairman Jeffers and carried 5-0 to approve $25,000
of mental health funds to advertise, hire and train a new employee for the current Fiscal
Year and to include in the Fiscal Year 2021 recommended mental health budget at $50,000.

OLD HELENA SCHOOL INCLUSION ON STUDY LIST FOR POTENTIAL
NOMINATION TO NATIONAL REGISTER OF HISTORIC PLACES:
Interim Assistant County Manager, Laura Jensen stated that on October 10, 2019,
the National Register Advisory Committee for the State Historic Preservation Office
determined that Old Helena School was potentially eligible for nomination to the National
Register of Historic Places as well as added to the Historic Preservation Office’s Study
List. The next step in the process would be to prepare a formal National Register
nomination document, which thoroughly describes and evaluates Old Helena School’s
physical characteristics, documents its history and assesses the significance of the school
in the community, and demonstrates how the school meets National Register criteria for
evaluation. The formal nomination document must be supported with professional quality
photographs, maps, and other materials, and must be prepared according to federal and
state guidelines. Due to the high standards expected for formal nominations, most are
prepared by private consultants. For discussion purposes, a cost proposal was prepared by
an experienced National Register consultant who has prepared nominations for other
historic school properties. Ms. Jensen said the consultant’s estimated fee for preparing a
nomination was $6,685. She added that further proposals can be solicited at the direction
of the Board.
Ms. Jensen asked the Board to review the State Historic Preservation Office’s
information and guidelines for formal nominations to the National Register of Historic
Places, as well as the proposal from a National Register nomination consultant, and direct
staff as appropriate.
County Manager, Heidi York stated should the Board pursue the application
process, the County would be responsible to preserve the building, make necessary
renovations and would not have the ability to tear down the structure for other uses.
Commissioner Puryear asked the projected capital expenditures for this project to
which Ms. York said $7-$10M was an estimate to bring the building up to code, abate the
asbestos and lead paint issues and make the structure ADA compliant.
Chairman Newell recounted his personal experience with a potentially eligible
building he owned noting the process obligated the owner to restore to the original
condition. He noted he was not in favor to limit the County’s option without a definite
plan for the property.
A motion was made by Commissioner Clayton to proceed with hiring the
consultant to submit an application; Commissioner Clayton withdrew his motion from
consideration so that the Board may review further.

JOINT COMPREHENSIVE LAND USE PLAN CONSULTANT SELECTION:
Planning Director, Lori Oakley informed the Board that on September 6, 2019, staff
released an RFP (Request for Proposals) for a joint Comprehensive Land Use Plan Update
for Person County and the City of Roxboro. Six consulting firms submitted proposals
including: Benchmark, HCP, N-Focus, Stewart, Withers Ravenel and Summit. Ms. Oakley
stated all of the proposals that were received were under the approved amount budgeted by
the county and city for the update to the Comprehensive Land Use Plan. She added the
budgeted shared costs were $125,000 by the County and $60,000 for the City of Roxboro.
Ms. Oakley said staff from both the County and City evaluated each proposal and
ranked the RFP’s according to the criteria that was listed in the RFP. The highest scoring
firm was Benchmark followed by Stewart. N-Focus and Withers Ravel tied for third. Ms.
Oakley noted the next stop was for staff to conduct phone interviews with the four highest
scoring firms. Based on the RFP submittal and the phone interview, Ms. Oakley noted
Benchmark scored the highest among all of the firms for both the RFP proposal and the
phone interview. Benchmark was set apart from the other firms in their experience working
with several jurisdictions on a comprehensive land use plan as most land use plans are
performed for a single jurisdiction (a county or city). She further noted Benchmark has
worked on 20 multi-jurisdictional plans over the past 10+ years, most recently for Lee
County/City of Sanford/Town of Broadway, NC and Alleghany County/City of Covington,
VA. Benchmark also proposed a very extensive public participation process to engage
citizens.
Ms. Oakley recommended that the Board select Benchmark as the consulting firm
to perform the update to the Comprehensive Land Use Plan for Person County and City of
Roxboro. She added that the City of Roxboro will make their selection at their meeting on
December 10, 2019.
A motion was made by Commissioner Clayton and carried 5-0 to go with staff
recommendation to select Benchmark as the consulting firm to perform the update to the
Comprehensive Land Use Plan for Person County and the City of Roxboro, contingent
upon the City of Roxboro taking action to select Benchmark.

RESOLUTION ESTABLISHING 2020 SCHEDULE OF REGULAR MEETINGS
FOR THE PERSON COUNTY BOARD OF COMMISSIONERS:
County Manager, Heidi York stated North Carolina General Statute 153A-40
requires the Board of Commissioners to hold a regular meeting at least once a month.
Before the Board is a Resolution Establishing 2020 Schedule of Regular Meetings with all
regular scheduled meeting being held in the Board’s usual Boardroom, Room 215 in the
County Office Building unless otherwise posted. As recommended on the Schedule of
Meetings, to accommodate attendance, Local Government Day Board meetings will be
held in the County Auditorium as the same for the Budget Public Hearing.
Ms. York said the proposed Schedule of Meetings presented no conflict with
National Association of Counties’ Legislative or Annual Conferences nor the North
Carolina Association of County Commissioners’ Annual Conference.
Ms. York requested Board consideration of the proposed meeting dates and to take
action to adopt a Resolution Establishing 2020 Schedule of Regular Meetings so to cause
copy of such to be distributed and posted on the bulletin board and county website.
A motion was made by Commissioner Powell and carried 5-0 to adopt a
Resolution Establishing the 2020 Schedule of Regular Meetings for the Person County
Board of Commissioners. The adopted 2020 Schedule of Regular Meetings are as follows:

CHAIRMAN’S REPORT:
Chairman Newell asked his fellow commissioners to gather in the Boardroom
briefly for a group photograph.
MANAGER’S REPORT:
County Manager, Heidi York reported that she, Chairman Newell and Vice
Chairman Jeffers would be participating in a telephone conference call meeting with the
YMCA Danville representatives and consultant for the Marketability Study.
COMMISSIONER REPORT/COMMENTS:
Commissioner Puryear apologized for his tardiness to the Board meeting noting an
unforeseen situation that required his immediate attention and presence at the bank. He
then introduced himself to the students in the audience.
Commissioner Puryear commended the Veterans Council for their outstanding job
in relation to the Veteran’s Day activities at the Museum, a parade and a Veteran’s Ball.
Vice Chairman Jeffers read a thank you note from Jason Torian, Chair of the
Environmental Issues Advisory Committee, thanking the commissioners for the funding
assistance with respect to their booth at the Personality Festival. With this funding, they
were able to raise awareness about the litter issues in the County and to distribute anti-litter
information and promotional items to hundreds of Personians that attended.
Commissioner Powell announced the NC Dept. of Transportation Dedication
Ceremony honoring World War I Veteran and Person County native, Lt. George H.
Yarborough, Jr. with a highway dedicated in his honor for his service would be held in the
County Office Building Auditorium this date at 2:00pm and not at the Museum as
originally scheduled due to the inclement weather.
Commissioner Clayton had no comments.

AGENDA ABSTRACT

Agenda Title: Fire Marshal Position
Summary of Information: The Volunteer Fire Chiefs in working with the Chairman and Vice
Chairman of the County Commissioners are requesting consideration of a Fire Marshal position.
Person County has had such a position in years past, but in FY2012, the position was eliminated at
the suggestion of the fire chiefs and the duties were reassigned. In reviewing the minutes of June
2011, the Manager had recommended reducing the Fire Marshal position to 60% part-time status,
but the Board voted to eliminate the Fire Marshal position and increase the then part-time Fire
Inspector position to full-time. Since then, the contract with the City of Roxboro has been amended
to provide for all fire investigation services throughout the county, the full-time Fire Inspector works
under the direction of the Inspections Director, and the County’s Emergency Services Director has in
his job description to serve as a liaison between the volunteer fire departments and the county. The
County currently pays the City $500 per month to provide for fire investigation services, as amended
in 2012. A copy of this contract amendment is included.
Surrounding counties have been studied to review their duties for a fire marshal and copies of their
job descriptions have been obtained. A spreadsheet with their salaries is included. Person County’s
former fire marshal job description is also included.
Recommended Action: Receive the information and provide direction to the Manager.

General Statement of Duties
Performs technical and public safety work in providing fire prevention, investigations of
suspicious fires, training and serving as a liaison with volunteer fire departments, Federal, State, and
County agencies in promoting overall fire prevention efforts within the County.
Distinguishing Features of the Class
An employee in this class performs varied tasks to include coordination with volunteer fire
departments, investigations of suspicious fires, fire inspections, and public education. Employee is
responsible for the fire prevention programs to ensure compliance with State and local fire laws, codes,
rules, and regulations. Employee performs large and small scale investigations for suspicious fires
and prepares documentation for presentation in criminal and civil court. The employee also conducts
fire education and safety programs. Considerable independence and judgement are required in fire
inspections and investigations. Considerable public contact requires that the employee exhibit tact and
diplomacy in coordination of volunteer fire programs in the County. The employee is subject to
hazards associated with fire investigation in extreme cold weather, and exposure to various hazards
such as high heat, chemicals, and in the proximity to moving mechanical parts, electrical current, and
working in high places. Employee is also exposed to atmospheric conditions and blood borne
pathogens, is sometimes required to wear a respirator, and may be required to work in close quarters.
Work is performed under general supervision and is evaluated through observation, conferences, and
written reports concerning the quality and effectiveness of work performed.
Duties and Responsibilities
Essential Duties and Tasks
Investigates fires of suspicious origins; coordinates investigations with local fire departments,
NC Department of Insurance, local law enforcement, and SBI; conducts interviews, gathers evidence,
prepares reports and testifies in court.
Prepares and maintains records and reports of own and departmental activities; assists
volunteer departments with training and regulatory compliance and record-keeping.
Inspects contractor's plans to ensure compliance to fire code.
Provides liaison, coordination and technical guidance for volunteer fire departments, and with
the NC Insurance Department.
Instructs various segments of the community on fire safety through education of the existing
codes, laws, and regulations.
Prepares and administers work unit budget.
Supervises and participates in fire code inspections and enforcement; performs plan review;
works with businesses and places of public assembly to insure fire safety and prevention.
Provides public and media information regarding fires, fire safety and related matters.
Responds to structure fires and may participate in incident command, safety, and/or fire
suppression.
Coordinates fire district boundaries and maintains fire contracts with county fire departments;
works with volunteer departments to identify and encourage actions that will improve ISO fire ratings;
provides assistance to fire departments in grant identification, development and administration.

Agenda Title: Taxpayer appeal of land/homes on Durham Rd
Summary of Information:
Madison Boulevard and Durham Road (Northern Section) is mainly a commercial district.
Today, there are only 13 single family dwellings on this just over 3 mile strip of highway. Most
of these single family dwellings are over 70 years old. There are 3 other single family dwellings
located along this strip that are now used for commercial purposes (used car sales, insurance
agency, and hair salon). During November 2019, 2 single family dwellings were torn down.
The highest and best use of land on this strip is commercial, as proven by current uses. The
value of a property with a single family dwelling is mostly land value.
Summary of events:
1.The taxpayer purchased 3 properties on 10/19/2018 for $127,000. All 3 properties are
considered improved parcels, with single family dwellings, built in 1923. The taxable value at
time of purchase was $221,776 for all 3 properties.
2.Shortly after purchase and as early as November 20, 2018, the taxpayer obtained building
permits for various improvements to the properties (heating/air systems, plumbing, electrical
panel replacement, etc.).
3.The taxpayer may appeal the assessed value of their property during January of each year,
which is considered an informal appeal. The taxpayer did not file an informal appeal during
January, 2019, even though his purchase price was lower than the taxable value.
4.The taxpayer may also file a formal appeal while the Board of Equalization and Review is in
session, which occurs during the month of April. The taxpayer did not file a formal appeal with
the Board of Equalization and Review.
5.Shortly after January 1, 2019, staff visited the properties in order to assess any changes in
taxable value based on the building permits/improvements. Based on these visits, the taxable
value increased to $244,853 for all 3 properties. Staff did not enter the dwellings, but verified
that improvements to the properties were in progress. The total increase in the taxable value
was $23,077.
6.The tax office mailed tax bills on or around July 23, 2019, which also served as notice to the
taxpayer that his taxable value had changed.
7.The taxpayer filed an informal appeal within 30 days of receiving their tax bill.
8.Staff meet with the taxpayer.
a.The taxpayer shared a “Residential Property Valuation Request Form-26037” that had been
completed by Fidelity Bank on October 4, 2018 prior to purchase. This report was an Internal

Evaluation and not an appraisal. Also, the report was clearly marked as CONFIDENTIAL and
stated that “This report may NOT be relayed to or relied upon by persons outside of the Bank”.
b. The on-going improvements, the status of the improvements as of January 1, along with other
repairs that needed to be done were discussed in detail with the taxpayer.
9.Based on the information exchanged during the informal appeal, the tax office adjusted the net
total taxable value to $223,347, which lowered the total taxable value of all 3 properties by
$21,505, and made the increase in the 2019 taxable value $1,571. Notice of the new taxable
value was mailed to the taxpayer on October 17, 2019.
10.On October 25, 2019, the taxpayer “hand delivered” his formal appeal forms. On the appeal
forms, the taxpayer indicated that the value as of January 1, 2019, and based on the January 1,
2013 schedule of values, should be $45,000 for each of these properties, for a total value of
$135,000.
11.On November 25, 2019, the tax office returned the copies of the “Residential Property
Valuation Request Form-26037” that had been provided to our office to forward to the Board of
County Commissioners as part of this appeal and taxpayer evidence. The copies were returned
based on the statement that the report was “CONFIDENTIAL”. These may be provided by the
taxpayer if he has been given permission by Fidelity Bank. There were numerous attempts by
the tax office and the taxpayer to get permission to include the taxpayer’s evidence.
Summary of facts:
1.The report provided by the taxpayer is not an appraisal, however, it was a “Residential Property
Valuation Request Form-26037”. This report is “CONFIDENTIAL” and should only be used for
loan purposes, as stated in the report on numerous occasions.
2.Also, the “Residential Property Valuation Request Form-26037” states that the properties were
inspected and found to be in average condition with no evidence of necessary repairs that have
not been done. However, later in the same report, it states that the properties were in poor
condition with extensive repairs needed.
3.A purchase price of 3 properties on October 18, 2018 does not provide clear evidence to dispute
the re-appraisal that was completed for January 1, 2013.
4.The land value of the 3 properties is consistent with other properties in the area, which is
supported by sales around the valuation period of January 1, 2013. The total taxable value of
$223,347 has a total land value of $163,900 with improvements valued at $59,447.
5.The taxpayer has not submitted substantial evidence to show that the January 1, 2013 Schedule
of Values was not properly applied in the valuation of his 3 properties.
6.The taxpayer has not submitted any evidence that shows what the value should have been on
January 1, 2013, as required by law.
7.The Real Property Value Changes in Non-Reappraisal Years are governed by North Carolina
General Statute 105-387 as attached.
Recommended Action: Uphold taxable value of 3 properties at $223,247, if appropriate.

Agenda Title: Request to Unfreeze Health Department Positions
Summary of Information: On June 17, 2019, the Board of Commissioners voted to
freeze the hiring of all vacant Health Department positions. On July 22, 2019, three
positions were released to hire. After assessing the service needs of the community with
Board of Health members and members of the Board of Commissioners, the Board of
Health and the Health Director request the unfreezing of the remaining four positions. As
is the current procedure, the positions will only be recruited and filled after receiving
approval from the County Manager. Unfreezing the positions would allow flexibility to hire
the positions and classifications needed and most beneficial to the department. The
remaining frozen positions are 3- Public Health Nurse II positions and 1- Community
Health Technician position. The cost of these positions is included in the adopted FY20
budget.
Since July 8, 2019, the Health Department has assured maternal health, family planning,
and STD services for residents through medical providers both in Person County and
outside of the county. While these services are being provided by other facilities, the
Health Department still incurs costs associated with the services and is not able to fully
access revenue sources due to not directly providing the medical care.
The U.S. Census Bureau estimates there are 4,938 uninsured residents in Person County
and approximately 2,200 of those are females. The number of uninsured individuals has
increased since 2015. Currently, there are no obstetricians or full-time gynecologists
providing care in Person County. Individuals who need maternity care, family planning
services, or STD diagnosis and treatment are having to seek care both in and outside of
Person County. Additionally, there are no other local providers who utilize a zero-sliding
fee scale.
To reduce access to care barriers and to better meet the needs of Person County
residents, the Health Department is making strides to rebuild the maternal health program
followed by the STD and family planning services. The unfreezing of the aforementioned
positions would provide flexibility of hiring staff, improve the efficiency of the hiring
process, and provide local coverage of these services for Person County residents.
Recommended Action: Approve the unfreezing of the 3- Public Health Nurse II positions
and 1- Community Health Technician position.

Summary of Information: A budget calendar has been developed for the Board’s adoption,
outlining a schedule for the timing of the budget process. A Board Retreat is proposed for February
3rd, along with the Capital Improvement Plan adoption in April, Presentation of the Recommended
Budget in May, a required Public Hearing on June 1st and Adoption of the FY20-21 Budget
Ordinance on June 15th. The dates outlined are subject to change if needed, but this will facilitate
an organized budget process for staff and elected officials.
Recommended Action: Adopt the budget calendar for FY2020-2021 and provide feedback and
changes to staff as needed.
