Addition of Melanie Dr, Whitney Cir, and Dragstrip Dr, three private roadways
Summary of Information:
The owners of the Dragstrip RV Park are adding three additional interior roads to serve
multiple RV lots. Each road will serve at least three RV lots which invokes the “Ordinance
Regulating Addresses and Road Naming in Person County” and requires that the roads be
named.
Melanie Dr will be located off Pixley Pritchard Rd on parcel A95 26 and will provide access to
four RV lots. Whitney Cir will be located off Thomas Store Rd on parcel A107 142 and will
provide access to four new RV lots. Dragstrip Dr is also located off Thomas Store Rd on
parcel A107 142 and will provide access to three new RV lots. Refer to Figure 1 for specific
road locations and layout. Both parcels A95 26 and A107 142 are owned by Gary Garrett, the
developer of Dragstrip RV Park. Article IV, Section 402 H of the “Ordinance Regulating
Addresses and Road Naming in Person County,” requires any driveway serving 3 or more
addressable structures, including RV lots, must be named.
North Carolina General Statute 153A-239.1(A) requires a public hearing be held on the matter
and public notice be provided at least 10 days prior in the newspaper. The required public
notice was published in the December 26, 2024 edition of the Roxboro Courier-Times. Signs
advertising the public hearing were placed at the proposed roadway locations on December
20th, 2024.
The proposed road names were chosen by the property owner and are compliant with all
naming regulations in the Ordinance. A brief presentation will be provided explaining the road
naming process.

The Person County Board of County Commissioners will hold a public hearing at 6pm on
January 6, 2025 in room 215 of the Person County Office Building at 304 S Morgan St, Roxboro,
North Carolina to hear the following:
Request by the Person County Address Coordinator to add Melanie Dr, Whitney Cir, and
Dragstrip Dr to the database of roadway names used for E-911 dispatching. The proposed
private roadways will be located off Pixley Pritchard Rd and Thomas Store Rd in Allensville
Township, entirely within the Dragstrip RV Park. Article IV, Section 402 H of the Ordinance
Regulating Address and Road Naming in Person County requires any private roadway serving
three or more RV lots to be officially named.
Citizens will have an opportunity to speak regarding the above request.

Chapter 153A –Article 12 Roads and Bridges
153A-239.1. Naming roads and assigning street numbers in unincorporated areas for
counties
(a)A county may by ordinance name or rename any road within the county and not within a city,
and may pursuant to a procedure established by ordinance assign or reassign street numbers for
use on such a road. In naming or renaming a road, a county may not:
(1)Change the name, if any, given to the road by the Board of Transportation, unless the Board
of Transportation agrees;
(2)Change the number assigned to the road by the Board of Transportation, but may give the
road a name in addition to its number; or
(3)Give the road a name that is deceptively similar to the name of any other public road in the
vicinity.

A county shall not name or rename a road or adopt an ordinance to establish a procedure to assign or
reassign street numbers on a road until it has held a public hearing on the matter.At least 10 days before the
day of the hearing to name or rename a road, the board of commissioners shall cause notice of the time,
place and subject matter of the hearing to be prominently posted at the county courthouse,in at least two
public places in the township or townships where the road is located,and shall publish a notice of such
hearing in a newspaper of general circulation published in the county.At least 10 days before the day of the
hearing to adopt an ordinance to establish a procedure to assign or reassign street numbers on a road,
the board of commissioners shall publish a notice of such hearing in a newspaper of general circulation in the
county.After naming or renaming a road,or assigning or reassigning street numbers on a road,a county shall
cause notice of its action to be given to the local postmaster with jurisdiction over the road,to the Board of
Transportation, and to any city within five miles of the road.Names may be initially assigned to new roads by
recordation of an approved subdivision plat without following the procedure established by this section.

the Youngs Meadow Final Plat Major Subdivision Concept Plan approval on a ±107.16-acre
lot (Tax Map No. A40 57), located at 623 Youngs Chapel Church Rd., per Section 30 of the
Subdivision Regulations of Person County
Summary of Information:
The ±107.16-acre Subject Property is located at 623 Youngs Chapel Church Rd. (Tax Map No.
A40 57 & Parcel ID No. 9984-00-80-0017.000); along the east side of Youngs Chapel Church
Rd., between Burlington Rd. and Huff Rd. The current land use for the Subject Property is
residential, agriculture, and vacant land. The Applicant desires to construct a 21-lot residential
subdivision on ±24.81 acres, along the Youngs Chapel Church Rd. roadway frontage. This will
leave a ±70.69-acre remainder lot to the rear of the subdivision and the Applicant proposes
creating a separate ±11.66-acre lot for the existing greenhouse site.
From the Person County & City of Roxboro Joint Comprehensive Land Use Plan
(Comprehensive Plan), Section 4 of the Comprehensive Plan includes Guiding Principles. The
future land use designation for the Subject Property is Growth Areas and the zoning
classification is RC – Rural Conservation. The zoning is consistent and compatible with the
future land use designation on-site and supports the statement for Growth Areas listed in the
Comprehensive Plan, “For these reasons, the density and intensity of development should be
higher than other unincorporated areas of the County as a whole, though these areas should be
targeted primarily for residential land uses.” The following Guiding Principle also supports
Application SUB-01-24 for residential subdivision on the Subject Property:
•Guiding Principle No. 2 – Facilitating Sustainable Economic Growth; Guiding
Principle No. 2.6 – Provide an attractive and diverse housing stock to attract workers at
all levels.
The Person County Planning Board voted unanimously (7-0) to recommend denial of the
Youngs Meadow Final Plat Major Subdivision Concept Plan to the Board of Commissioners at
their July 11, 2024, public hearing. The Planning Board based their motion on the Applicant
not providing a second with the proposed lots shown on the parent tract, as well as not
including soil reports that the proposed lots will percolate for septic systems. The Applicant
has since provided the information, as included in this application package. The Planning

Board also heard comments from the public concerning school capacity, public safety, lot
location along roadway frontage only, traffic, access management, and preservation of
agricultural land. The applicant has conceptually agreed to a shared-driveway design with the
North Carolina Department of Transportation that is listed on the Concept Plan.
Addendum per December 12, 2024 Planning Board Meeting:
•Letter attached from Ken Krulik, Independent Planning Contractor Kerr-Tar COG -
Planning Board Review (and public hearing held). Planning Board recommends
approval, with conditions as noted.
•Applicant agreed to conditions and provided the necessary documentation in hard copy
prior to the agenda deadline.

Based on the above, the Planning & Zoning Department staff recommends that the Board of
Commissioners approve Major Subdivision Concept Plan, SUB-01-24, for the Youngs Meadow Final
Plat.

Property).
Request
A request by the Applicant and Property Owner, 3 Brothers Building, LLC, for Youngs Meadow Final Plat
Major Subdivision Concept Plan approval on a ±107.16-acre lot (Tax Map No. A40 57), located at 623
Youngs Chapel Church Rd. for a 21-lot residential subdivision, per Section 30 of the Subdivision
Regulations of Person County (Subdivision Regulations).
Location, Current Land Use, & Land Use Compatibility
The ±107.16-acre Subject Property is located at 623 Youngs Chapel Church Rd. (Tax Map No. A40 57 &
Parcel ID No. 9984-00-80-0017.000); along the east side of Youngs Chapel Church Rd. between Burlington
Rd. and Huff Rd. (see Exhibit A: Aerial Photo). The current land use for the Subject Property is residential,
agriculture, and vacant land. The Subject Property is also compatible with current land uses on adjacent
properties, as follows:
•North – residential, agriculture, & vacant land
•East – residential, agriculture, & vacant land
•South – residential, agriculture, & vacant land
•West – residential, agriculture, & vacant land

Planning Staff Analysis
The Applicant is applying for Major Subdivision Concept Plan (see Exhibit D: Concept Plan) approval to
create a 21-lot residential subdivision on the ±107.16-acre Subject Property, listed as the Youngs Meadow
Final Plat. The 21 lots on the Concept Plan total ±24.81-acres, which leaves a remainder of the Subject
Property with an ±11.66-acre tract for the greenhouses and a ±70.69-acre tract to the rear of the subdivision.
The new lots will be legally conforming, greater than one-acre each for minimum lot size, and over 100-ft.
wide meeting the minimum lot width. All of the lots will have roadway frontage along Youngs Chapel
Church Rd. and will utilize well and septic utilities.
Section 30 of the Subdivision Regulations requires Planning Board and Board of Commissioners approval
of the Concept Plan. Per Section 30-6 of the Subdivision Regulations, approval of the Concept Plan by the
Board of Commissioners is valid for twenty-four (24) months from the date of approval and shall be vested
for a 24-month period. Prior to Concept Plan expiration, an application for vested rights may be submitted
to guarantee development rights from the date of approval and an extension of development rights may be
granted by the Board of Commissioners for an additional period between 2-5 years.
Per Section 31 of the Subdivision Regulations, in addition to Concept Plan approval, the Applicant shall
submit a Major Construction Plat (Construction Plat) prior to earth works on the Subject Property. The
Construction Plat shall also be submitted by the Applicant to the North Carolina Department of
Transportation (NCDOT) and, where more than one-acre of land disturbance is proposed, to the North
Carolina Department of Environmental Quality (NCDEQ). Prior to site disturbance activities, the NCDOT
District Engineer’s signature is required on the Construction Plat and a copy of the NCDEQ approved soil
and erosion control plan shall be submitted to the County. The Applicant provided the Concept Plan to the
NCDOT and received the following comments to change the plan to accommodate these conditions:
•For residential subdivisions, internal circulation shall be directed to one or more collector streets
within the subdivision, and not access the State System road directly. Only the collector streets
should intersect the State System road.
•The NCDOT may deny access to the adjacent public roadway from “out lots” or “out parcels” of a
larger development where reasonable access can be provided via the larger development’s internal
circulation system.
•The NCDOT may require construction of an internal street system or service road to eliminate or
reduce multiple lot access connections directly to the adjacent public roadway system.
The proposed 21 lots are rectangular-shaped and have sufficient size to meet front, side, and rear yard
setbacks for single-family residential development. The lot sizes, at greater than one-acre, should
accommodate individual well and on-site septic systems on each lot. That Applicant will also need County
Department of Environment Health permit approval. City of Roxboro central utilities are not readily
available to the Subject Property. On the Concept Plan, there is a perineal stream bisecting Lots 1-6 and a
50-ft. wide stream bufferyard over portions of Lots 1-8 that should not limit land subdivision or future
residential construction on those lots. The Subject Property is within the Falls-Neuse Watershed Basin and
are subject to basin stormwater regulations. Finally, Youngs Chapel Church Rd. is North Carolina State
Road 1142 and NCDOT may require shared driveways along the highway to preserve roadway capacity
and to limit the number of driveways with a minimum separation distance.
The Person County Planning Board voted unanimously (7-0) to recommend denial of the Youngs Meadow
Final Plat Major Subdivision Concept Plan to the Board of Commissioners at their July 11, 2024, public
hearing. The Planning Board based their motion on the Applicant not providing a second with the proposed
lots shown on the parent tract, as well as not including soil reports that the proposed lots will percolate for
septic systems. The Applicant has since provided the information, as included in this application package.
The Planning Board also heard comments from the public concerning school capacity, public safety, lot

The Person County Planning Board voted (3-2) to recommend approval of the Youngs Meadow Final Plat
Major Subdivision Concept Plan to the Board of Commissioners at their December 12, 2024, public hearing
with the following conditions:
1.Add to the final plat/plan for submittal for review, the necessary contour lines on the entire property
and not just the lots to be subdivided off the main road.
2.Remove the ambiguous note from the surveyor in the upper left corner of the printed plan referring
to Lots 14 and 15.
3. Remove the duplicate"L6" note on the call sign chart.
The applicant agreed to conditions and provided the necessary documentation in hard copy prior to the
January 6, 2025 agenda deadline.
Staff Recommendation
Based on the above, the Planning & Zoning Department staff recommends that the Board of Commissioners
approve Major Subdivision Concept Plan, SUB-01-24, for the Youngs Meadow Final Plat.

RECOGNITION OF OUTGOING COMMISSIONERS
Commissioner Puryear read a plaque in appreciation of outgoing Commissioner
Charlie Palmer for his four years of service, December 7, 2020 to December 2, 2024.
Commissioner Puryear read a plaque in appreciation of outgoing Commissioner
and Vice-Chairman Derrick Sims for his four years of service, March 9, 2020 to
December 2, 2024, and recognized that Sims was Vice-Chairman from December 6, 2021
to December 2, 2024.
Commissioner Puryear read a plaque in appreciation of outgoing Commissioner
and Chairman Gordon Powell for his eight years of service, December 5, 2016 to
December 2, 2024, and recognized that Powell was Vice-Chairman from December 5,

RECOGNITION OF CHAIRMAN GORDON POWELL PRESENTED WITH THE

Glenn Powell, son of Chairman Powell, presented the Order of the Long Leaf Pine
to Chairman Powell. The Order of the Long Leaf Pine is the highest honor bestowed upon
North Carolinians by the Governor, for persons who have made significant contributions
to the State and their communities, through their exemplary service and exceptional
accomplishments.

County Attorney T.C. Morphis, Jr. introduced the Honorable Deborah L. Barker,
Clerk of Superior Court.
Ms. Barker administered the Oath of Office to the commissioners-elect, Sherry
Wilborn, Tracy Ellixson, and Antoinetta Royster.

County Attorney T.C. Morphis, Jr. stated, as noted in the Board’s Rules of
Procedure, the Board would convene its Organization of the Board. Morphis opened the
floor and called for nominations for Chair of the Board of Commissioners.
Commissioner Wilborn nominated Commissioner Puryear for Chair of the Board.
There were no other nominations for Chair. Morphis asked for a vote by the Board. The
Board voted unanimously to appoint Commissioner Puryear as Chairman of the Board.
Morphis announced Commissioner Puryear as the Chairman of the Board.
Chairman Kyle Puryear opened the floor for nominations for Vice-Chair of the
Board. Commissioner Ellixson nominated Commissioner Thomas for Vice-Chair of the
Board. There were no other nominations for Vice-Chair. Chairman Puryear asked for a vote
by the Board, and by acclamation announced Commissioner Thomas as Vice-Chairman of
the Board.
APPROVAL OF BONDS FOR THE FINANCE DIRECTOR, THE REGISTER OF
DEEDS, THE SHERIFF, AND THE TAX ADMINISTRATOR
County Attorney T.C. Morphis stated that every year the Board is required to
approve bonds for certain offices, including the Finance Director, the Register of Deeds,
the Sheriff, and the Tax Administrator. He stated that these bonds are set and required by
statute.
A motion was made by Commissioner Wilborn and carried 5-0 to approve the
bonds for the Finance Director, the Register of Deeds, the Sheriff, and the Tax
Administrator.

Chairman Puryear called for a brief recess at 6:05pm.
A motion was made by Commissioner Wilborn and carried 5-0 to recess the
meeting. The meeting reconvened at 6:20pm.

Chairman Puryear asked if enrollment in the program was down, and what avenues
are being taken to get the numbers up. McCormick advised that the enrollment numbers are
down. She stated that one of the reasons for wanting the grant funding is to be able to use it
to develop some new marketing materials to do a direct mailing, in hopes that people who
did not respond previously, will do so. She stated that she will also reach out to those people
who are eligible, those in the PUV (Present-Use Value).
A motion was made by Commissioner Wilborn and carried 5-0 to approve the grant
application for $8,500 and authorize the County Manager to accept the funds, if awarded
the grant.

AMERICA 250 NC COMMITTEE
Assistant County Manager Brian Hart stated that in 2026, the United States will be
commemorating the 250th anniversary of the signing of the Declaration of Independence.
He stated that America 250 NC, a program of the NC Department of Natural and Cultural
Resources, is partnering with local governments and nonprofits throughout North Carolina
to mark this anniversary. He stated that many NC counties have formed official
committees dedicated to planning and organizing events, projects, and initiatives at the
county level. He stated that having a committee unlocks the opportunity for resources from the
State through the America 250 NC office, most notably a county committee grant or a community
program grant. He stated that the county committee option has a maximum request/grant amount
of $10,000 and restricts eligibility for local government entities or counties with an official county
committee. He stated that the community program option, for which the maximum request amount
is $30,000, considers counties and non-profit organizations as eligible entities. He stated that the
State will provide the committee with an official logo signifying the County’s alignment with the
State in the 250th commemoration. He stated thus far, County management has identified, and
engaged with the following persons and/or organizations about their interest in
participating in the America 250 NC initiative:
•Erin Hill, Director of Kirby Cultural Arts Complex
•Kim Strickland, Person County Public Information Officer
•Von Yeager, Person County Public Library Director
•Person County Veterans Council
•Person County Museum of History
•Person County Tourism Development Authority
•Sappony Tribe
He stated that Erin Hill is willing to lead the committee, which will fall under the
umbrella of the Kirby Cultural Arts Complex. He stated that County staff will support the
committee’s efforts and help to identify and recruit a diverse group of people to serve on
the committee.
A motion was made by Vice-Chairman Thomas and carried 5-0 to approve a
Resolution Recognizing and Approving the Person County Official America 250 NC
Committee.

LEASE AND AGENCY AGREEMENT -CHATT
County Manager Katherine Cathey stated that on August 30, 2024, the County
purchased the Carolina Pride Carwash Headquarters, located on 10.51 acres of land in
Timberlake, for use as Piedmont Community College’s (PCC’s) future Center for Health,
Advanced Technology and Trades (CHATT). She stated that PCC contributed $1,835,000
towards the $7,000,000 purchase price. She stated that given that counties are statutorily
responsible for the provision of educational facilities, the County will rent the facility to
PCC for $1.00 per year. She stated that PCC will contract for the construction and upfit at
the Leased Property as required for the accomplishment of the CHATT Project. She stated
that PCC will also finance the cost of the CHATT Project through a variety of methods,
and while having no obligation to do so, the County may also consider serving as an
additional source of funding.
Commissioner Wilborn stated that she noticed that the agreement did not mention
the restrictive covenants with it being in the PCBIC Industrial Park, and who would be
responsible for the maintenance fees, and making sure that there was compliance. County
Attorney T.C. Morphis, Jr. stated that is certainly something that the County can discuss
with PCC and incorporate into the final edits of the agreement.
A motion was made by Commissioner Royster and carried 5-0 to approve the Lease
and Agency Agreement and authorize the Board Chairman to sign, with the addition of
Exhibit A and final edits to include who would be responsible for the maintenance fees.
RESOLUTION ADOPTING THE BOARD OF COMMISSIONERS SCHEDULE OF
MEETINGS FOR 2025
Clerk to the Board Michele Solomon stated that NC General Statute 153A-40
requires the Board of Commissioners to hold a regular meeting at least once a month. She
advised the Board that before them is a Resolution Establishing the 2025 Schedule of
Regular Meetings for adoption.
A motion was made by Commissioner Wilborn and carried 5-0 to approve a
Resolution Adopting the Board of Commissioners Schedule of Meetings for 2025.

FY 2025-2026 BUDGET CALENDAR
County Manager Katherine Cathey presented the FY2025-2026 Budget Calendar.
She stated that staff has developed a budget calendar for the Board’s consideration and
adoption. She stated that it outlines a proposed schedule for the FY2025-2026 budget
process. She highlighted a few dates that are key milestones:
•February 18, 2025- The Board of Commissioners Annual Retreat
•April 21, 2025- Adoption of the Capital Improvement Plan (CIP)
•May 19, 2025-Presentation of the Manager’s Recommended Budget
•June 2, 2025- Required Budget Public Hearing
•June 16, 2025- Adoption of the FY2025-2026 Budget Ordinance
A motion was made by Vice-Chairman Thomas and carried 5-0 to adopt the

Chairman Puryear expressed thanks to all Board members for his nomination as
Chair. He congratulated newly elected Board members.
MANAGER’S REPORT
County Manager Katherine Cathey congratulated the newly elected Board members
and also extended a congratulations to Chairman Puryear and Vice-Chairman Thomas on
their new roles. She stated that she looks forward to orienting the newly elected Board
members, and for them to meet County staff and department heads. She stated that the
County Employee Longevity Awards Program is being held at the Homestead on December
4, 2024 at 11:30 a.m.
COMMISSIONER REPORTS/COMMENTS
Vice-Chairman Thomas stated that he looks forward to the challenge as Vice-Chair
and congratulated Chairman Puryear on being named Chair of the Board.

Roxboro Rotary Centennial Park: Electric Service Right-Of-Way and Installation Agreement
Summary of Information:
The Person County Recreation, Arts, and Parks Department is in the process of constructing
the new Roxboro Rotary Centennial Park (formerly known as County Farm to Park Project).
This construction includes: Main Drive Access Road, two Parking Areas, Paved ADA
Accessible Trail, Stormwater Best Management Practices (BMP) Wet Pond, Site Erosion
Control, 30 miles of multi-purpose nature trails, picnic shelters, ADA Accessible Restroom
and Support Area, and riparian buffer enhancements.
The project is now in the phase for installation of electrical services/utilities. Electrical service
utility lines will be installed approximately 4,200 linear feet along the left side of the park’s
main drive access road. The installation will consist of an electrical feed connection from lines
located on Moores Mill Road and will continue into the park until it reaches the main ADA
Parking Areas and Restrooms. Electric service is needed to operated well, septic, ADA
restroom and supporting amenities. All electrical line will be installed underground.
It is normal protocol for the landowner to complete a utilities right-of way agreement and
installation agreement with the electric service provider before installation. The electric service
provider for these areas is Piedmont Electric Membership Corporation. See attached Right-Of-
Way Agreement and Installation Agreement between Person County and Piedmont Electric
Membership Corporation.
Financial Impact:
Costs for installation of electrical services/utilities total $56,938.09 and will be paid for through the
park project construction budget. The utilities and restroom amenities for this project are funded by the
North Carolina Parks and Recreation Trust Fund Grant previously awarded to Person County
Recommended Action:
Approve Right-of Way and Installation Agreement between Person County and Piedmont Electric
Corporation.

facilities in the path of the Cooperative's electric service lines; Cooperative is not responsible for damage to any

Person County Schools’ Request for Distributions from the North Carolina Education Lottery
Public School Building Repair & Renovation Fund
Summary of Information:
The school system requests approval of one project application that is based on their Facility
Needs Study and would be funded by the Public School Building Repair & Renovation Fund.
This fund was established by S.L. 2021-180, Section 4.4.(a1), which provides revenue to
counties for school repair and renovation projects.
As with the Public School Building Capital Fund, the application requires approval by both the
Board of Education and Board of Commissioners before submittal to the Department of Public
Instruction (DPI). Once approved, it must be executed by the chair of each board. The Board of
Education approved the attached applications at their meeting on December 12, 2024, and it is
now before the Board of Commissioners for consideration.
The project application is for:

entrance of high school ($80,000)

Courthouse Sign Update
Summary of Information:
Mr. Robert Daniel Wilkins, Sr., a Person County resident, submitted a request to the Board of
Commissioners to update a sign on the courthouse property. The sign is located to the right of
the sidewalk leading to the front door of the courthouse (pictured below).
In a letter dated November 21, 2024, Carrie Currie, Executive Director of the Person County
Museum of History, confirmed that the Heritage Trail sign is the property of the county.
Staff recommends replacing the sign with a new sign that includes the county seal, removes
the reference to the 2016 Heritage Trail and updates the wording (below). The proposed
wording incorporates edits based on Mr. Wilkins’s research and preserves the historical details
originally included on the sign purchased by Clerk of Court Deborah Barker on behalf of the
Person County Courthouse in 2015.

Person County Courthouse Site
Circa 1792
The current courthouse structure, circa 1932, is built on this site one of several constructed on
this site since the formation of Person County in 1791. The original land conveyance occurred
in 1792 and consisted of 6 acres donated to Person County by Dempsey Moore, "in
consideration of the good- will ofhe bears towards the pPeople of the Person County of
Person."
An 1842 survey reflects a natural spring located on the property. This natural spring, as well as
the fact that this location lies at the geographical center of Person County, symbolizes the
logical placement of the courthouse on this spot.
Court was temporarily held at Paine's Tavern until a permanent courthouse was built. The first
Commissioners, Stephen Moore, John Paine, and John Womack awarded a contract to Yancey
Bailey to construct the first Person County Courthouse (a log structure). He was paid
482 pounds, ten shillings (about $2,000) indicating that he had finished the work by December
10, 1793, "to the perfect satisfaction of the Commissioners."
In 1978, commissioners voted for an addition to be constructed to the current courthouse, and
it was completed in 1979. In 2010, renovations began to the interior of the courthouse which
included updating both courtrooms, creating offices in the former jail space on the fourth floor
and the installation of security measures.Currently, only the judicial offices occupy the
building.
Financial Impact:
Funding in the amount of $75 for a new sign is available in the General Services Department supplies
line item.
Recommended Action:
Approve the wording for the new sign to be placed on courthouse property.

Fire and Rescue Tax Funding Request
Summary of Information:
In a letter received on October 24, 2024, the Timberlake Volunteer Fire and Rescue
Department requested funding for 12 new portable radios ($81,062). In a letter received on
October 30, 2024, the Person County Rescue Squad requested funding to outfit a new Incident
Support unit with an air compressor ($90,000) for filling SCBA and SCUBA bottles. The
letters are attached.
At its December 5, 2024 meeting, the Person County Chief’s Association voted “to give
Timberlake and Rescue $66,000 each for their part of the money that would have been
allocated for them had they agreed to the need for the Stryker EMS equipment.” The motion
passed with no opposition. The minutes are attached.
Financial Impact:
The Chief’s Association requests an allocation from the Fire and Rescue Tax District Fund totaling
$132,000 in FY25 ($66,000 for Timberlake VFRD and $66,000 for the Rescue Squad). $106,290 is
available in the unallocated line item. The remaining $25,710 would need to be funded through a Fund
Balance allocation. The current fund balance in the Fire and Rescue Tax District Fund is approximately
$965,000.
Recommended Action:
Consider funding the request with unallocated Fire and Rescue Tax District funds in the amount of
$106,290 and a fund balance allocation of $25,710.

MEMORANDUM
TO: ALL VIPER PARTNERS AND END USERS
FROM: MICHAEL T. HODGSON, VIPER DIRECTOR
RE: VIPER TDMA UPDATE AND IMPORTANT INFORMATION
As the North Carolina Voice Interoperability Project for Emergency Responders (VIPER)
continues to grow, it is important that the system remains at the forefront of the technological
improvements afforded to our end users. To maintain our technological timelines and to be able
to make the most efficient use of the resources that we have available, VIPER must begin to
address our ability to implement new capabilities to ensure that we are ready for not only the
continued growth of the system but also for future system enhancements.
Under our current Project 25 (P25) system architecture, we support digital operation using the
Frequency Division Multiple Access or FDMA technology. With the implementation of the GTR
base stations, VIPER became able to support P25 Phase 2 operation utilizing Time Division
Multiple Access or TDMA operation. TDMA allows us to divide each channel on the system that
supports voice radio traffic into two separate talk “paths”, each supporting a unique voice radio
conversation. This capability will allow VIPER to potentially support more concurrent voice
conversations without adding additional base stations to address the need for growth. In the 10
years since we migrated to P25 in June 2014, the VIPER system has grown from 65,565 to over
185,000 user devices and continues to grow every day.
A transition to TDMA is still a year away and hopefully all our end users’ agencies are well
under way in the replacement of their non TDMA capable radios.
VIPER first provided a roadmap with certain steps on 1 July 2019. The original intent was to
allow state and local agencies to have six fiscal budget years to prepare for the upcoming
transition to P25 Phase 2 (TDMA) operation on the VIPER system. Below are the two most
important dates that are relevant today.

•Effective 1 July 2022 all radios being added to the VIPER system must be ready to
receive TDMA programming. It is extremely important that our end users understand
exactly what this means. Many manufacturers’ radios may be capable of TDMA
operation but were not ordered with the “feature” enabled from the factory. These radios
will need to be modified in the field to add the TDMA feature, to be “ready” for a
transition to TDMA in the future.
•Effective 1 July 2025 all radios currently active on the VIPER system, along with all
future additions to the system shall be ready to receive TDMA programming.
VIPER respects that these dates may represent challenges to our end users, especially around
funding since replacement radios or upgrades to existing radios will be necessary. However, it is
important to consider that the system continues to grow and to maintain VIPER's current level of
system busies, that a move to TDMA operation would be the most effective way to address
future growth and system health.
VIPER has created a new email address specifically for TDMA related questions regarding this

VIPER TDMA Testing
In anticipation of the upcoming July 1, 2025, activation of TDMA (P25 Phase 2), VIPER has
been diligently working to allow end-user and radio service shop programmers to start testing
and verification. To that end, we have enabled TDMA on a select number of sites distributed
across the state. Please see attached file showing the footprint of the sites providing TDMA
capabilities for testing. Please note that this coverage footprint is approximate.
In cooperation with North Carolina Emergency Management, the State Event talk groups Tango
1, Tango 2, Tango 3 and Tango 4 have been set at the system level to ONLY support TDMA
calls, and radios will only be able to affiliate with sites that support TDMA.
These talk groups have been removed from the assignment rotation for state incidents by the 24-
Hour Watch and are NOT monitored by the Watch nor any communications center.
Users may utilize these talk groups to test communications but do be aware that you may hear
others testing as well.
Also attached is the guide sheet previously distributed for most of the radio manufacturers for
configuration of the radios for proper TDMA operation.

Statewide Radio System for the period 1 January – 31 December 2023
The following Vendors and their respective listed Radio Model Numbers are hereby approved
for NEW radio purchases. NEW is defined as a currently manufactured radio, that includes
TDMA (Phase II operation), directly from a manufacturer or authorized vendor/manufacturer’s
representative.
Motorola – APX 900/4000/6000/8000/NXT portables, APX 1500/4500/6500/8500 mobiles and
APX8500 series consolettes.
EF Johnson – Kenwood – EFJ VP5000/VP6000/8000 portables and VM5000/6000/7000
mobiles.
TAIT - TP9400/TP9600 portables and TP9400 mobiles.

The above list of radios is for radios currently in production and being shipped during the
calendar year 2023. However, virtually all the above manufacturers, previously manufactured
radios that are P25 Phase 2 capable that are no longer in production. VIPER will continue to
allow end user agencies to add radios from the below list since they are P25 Phase 2 (TDMA)
capable.

BEING ADDED TO VIPER must be P25 Phase 2 (TDMA) ready. Ready is defined as the
radios MUST have the TDMA option already in the radios at time of purchase. This includes the
purchase of NEW and USED radios.
**NOTE** VIPER previously notified all users that effective 1 January 2020 that the following
radios listed below will no longer be permitted TO BE ADDED to the system. Existing
radios from the below list will continue to be allowed to operate on the system until 1 July
2025. We continue to see requests to add radios from the below list every single month. If
you have questions regarding the below radios and their use on the system, please ASK prior to
spending your agency dollars to purchase them second hand. Transferring radios from one
agency to another does NOT mean that the radios will be approved to remain on the system.

Radio end user agencies should note that this letter is for approved radios for use on the
Statewide VIPER radio system and does not constitute an approval of the above radios on locally
owned and operated Project 25 (P25) radio systems. Some radios on the VIPER approved list
may NOT be approved for use on local systems. Please confirm with your local radio system
administrators to determine local eligibility and approval.

Encryption – With the overwhelming number of agencies across North Carolina that are
implementing encryption along with the adoption of a statewide encryption plan that includes all
of the nationally recognized encryption formats (ADP/ARC4, DES and AES), the VIPER system
has created a series of Common State Keys for encryption that reflect all of the above encryption
formats. The state has also adopted a set of Law Enforcement Only State Event Talk Groups that
require the use of the Common State Keys and Agency Specific Keys. The Common State Keys
are available to any agency that utilizes encryption and can be transferred via a Motorola
KVLx000 series Key Variable Loading Device. The Motorola KVL is the de-facto standard for
Key Fill Devices. If you require the Common State Keys, please email viper@ncdps.gov and put
CSK in the subject line.
With the adoption of the Common State Keys, VIPER has elected to place an additional
requirement on all radios being sold for use on the VIPER system, therefore any manufacturer
that is unable to support the key loading all of the above algorithms (ADP/ARC4, DES and
AES) via KVLx000 device, shall have their radios removed from the approved radio list
effective 1 January 2023. This action will not preclude any manufacturer from being added
back to the approved list should they be able to meet the above requirement in the future.
Additions back to the approved list will occur at such times that the Approved Radio List is
normally updated. Currently this occurs every January first of the upcoming calendar year
however the state reserves the right to update the list at any time that it deems to be in the best
interest of the state or the end users that it supports.
Summary – None of the above actions taken by the state should be construed as forcing end
users to discontinue the use of radios currently activated on the system. All end users should
however have a clear understanding that the deadline for conversion of the VIPER system to
TDMA (Phase 2 P25) operation remains at 1 JULY 2025. This requirement means that over the
next thirty (30) months, all non P25 capable radios shall be removed from the system.

Division Chief of Community Risk Reduction Shawn Bradsher advised if anyone needs help
with putting calls in the new software please let him know. Also if you have not picked up
your departments smoke detectors please see him he has them tonight to pass out.
Emergency Communications Division Chief Roland Nenni has two things:
1. Passed around a sheet for each chief to put two points of contact on it for the new alert
software migration.
2. He also needs names and Radio ID of people or apparatus assigned a viper radio so they
can be programmed into the radio server so when a radio is locked open or in emergency
the telecommunicators will know what to look for. Example last week had a radio
transmitting an open signal and it took several hours to finally locate it, doing this will
make it easier to locate and get the channel cleared.

Emergency Medical Services Division Chief Heather Chandler stated that most of the Stryker
equipment is in. She also needs set up a date and time with the departments to bring it out
and do the training, please contact her.
Emergency Medical Services Brandon Fox talked about the new airways that being put into
place instead of th King Airways we use now. The King Pediatric Airway is being recalled and
will be replaced and training will start on this new airway. For the adult King Airways we
are going to use them until they expire out and then it will be replaced with the new type.
( If you have King Pediatric airways do not throw them away, please turn them into EMS
because a credit can be received for the old ones )

New Business
Jason Fletcher shared with association that he and Rescue had approached the county
manager about getting the same amount of funding as the other departments got when
they joined the County Strker Contract with EMS. He stated that she replied with had it
been approved by the association and were they aware of it, so he was bringing it up
to us tonight to discuss and figure out a resolution to the matter.
He stated that at the time of the contract they did not need the AED's or the Lucas Device
because they had just upgraded their Equipment last year. There major need at this time
is replacement Viper Radios that will going offline after a system upgrade in July. He will lose
12 radios when this happens and to follow NFPA and OSHA guidelines everyone in a fire
needs communications. Each radio costs 7,211.00 and he was proposing to be able to
purchase 9 get by with.
Rescue use of the money was to fund part of the new countywide support truck that they
are puchasing that will respond to all county calls for assistance. The portion of the money
was for the purchase of the air bottle refill machine that would be used to refill air bottles
on the scene of fires and also fill scuba bottles for the dive teams for water rescue.
The equipment will cost 90,000.00
After an extensive discussion on this it was decide that a procedure needs to be setup by
the association and the county on how this would be handled in the future. After this
discussion two motions were made as follows.
Motion 1: Motion made and seconded to give Timberlake and Rescue $ 66,000 each for
their part of the money that would have been allocated for them had they agreed to the
need for the Stryker EMS equipment. Motion passed with no oppostion.

Motion 2: Motion Made and Seconded to draft a set of procedures on how this will work
in the future for department needing additional funding. Motion passed and during the
discussion it was determined that other counties may already have some type of
procedure already in place and maybe we could copies of their procedures and may not
have to come up with a whole new procedure. It was decided that all chief's check with
other counties and see if they can get a copy of theirs and get them to President Windham
so he can email them out to the chief's to look over before discussion in our February
Meeting, Everyone agreed.

Planning and Zoning Department Staffing/Operational Update
Summary of Information:
The Planning Director position has been vacant since October 4, 2024, following the previous
director’s resignation. The Planning Technician and Planner positions have remained filled. In
addition, the contract Code Enforcement Officer has continued to work in Person County one
day per week.
A contract with Kerr-Tar Council of Governments has provided additional support for County
staff. Through this contract, a semi-retired Planning Director has provided planning technical
assistance on two major projects that have been or will be considered by the Planning Board
and Board of Commissioners in December and January. Going forward, he also will provide
assistance with the plans review and permitting processes.
Over the past month, holidays and sickness have interrupted the department’s workflow.
Returning from the holidays, staff has a plan in place to continue making progress on the
backlog of applications that are in the review queue. The additional support from Kerr-Tar will
be a great benefit.
There is also an option to enter into a separate contract with State Code Enforcement to
provide additional on-site and remote support for plans review and permitting. Staff is
currently evaluating the potential impacts of pursuing this option.
Two rounds of recruitment for a new Planning Director were conducted in October and
November. Two offers were rejected based on salary considerations. Recruitment was placed
on hold due to the holidays. The position will be reposted on January 2, 2025.
Financial Impact:
The cost of the Kerr-Tar COG contract is covered by lapsed salary within the Planning and Zoning
Department FY25 budget. Adding support through State Code Enforcement may require a budget
transfer or amendment.
