Request by Person County Planning staff to amend the Ordinance Regulating  Automobile Graveyards and Junkyards in Person County regarding commercial and  residential junkyards and their associated penalties.    The public is invited to attend the hearing.  Substantial changes may occur to the request based  on comments from the public hearing.  The Board of Commissioners reserve the right to recess  the public hearing to another place and time.  For further information on the case(s) listed above,  please contact the Person County Planning and Zoning Department at 336‐597‐1750.       4 AGENDA ABSTRACT Meeting Date: March 19, 2018 Agenda Title: Public Hearing for a Text Amendment (TA-01-18) request by the Person County Planning staff to amend the Ordinance Regulating Automobile Graveyards and Junkyards in Person County regarding commercial and residential junkyards and their associated penalties. The NC General Statutes requires that when reviewing a text amendment, the board also include with their motion a statement as to whether the proposed text amendment is reasonable and consistent. Summary of Information: Petition TA-01-18 is a request by the Person County Planning staff to amend the Ordinance Regulating Automobile Graveyards and Junkyards in Person County regarding commercial and residential junkyards and their associated penalties. This text amendment request serves to clarify in which instances the Ordinance Regulating Automobile Graveyards and Junkyards in Person County (“Junkyard Ordinance”) would apply to a parcel of land and which penalties would apply to the violation. While working on two current junkyard violations, staff determined that the language pertaining to residential junkyards was contradictory. While Section Six, Applicability, of the Junkyard Ordinance states that the ordinance applies to all properties (residential, commercial and industrial), Section Four, Prohibitions, only prohibits commercial junkyards. Staff also determined that the penalty section was unclear and that both criminal and civil penalties could be applied to a parcel regardless if it was zoned commercial or residential. Staff is recommending that criminal penalties only apply to non-residential properties. Civil penalties, in accordance with the NC General Statues, can apply to both. Planning Staff Recommendation - Planning Staff recommends approval of TA-01-18. Staff is requesting language in the Junkyard Ordinance that clearly distinguishes between a commercial and a residential junkyard along with the associated penalties for each. Statement of Reasonableness and Consistency - The text amendment request is consistent with the Comprehensive Plan and future planning goals and objectives of Person County. It is reasonable and in the public interest as it will provide clear and concise regulations in the Ordinance Regulating Automobile Graveyards and Junkyards in Person County. 5 Section 4.1.10 in the Goal and Objectives of the Land Use Plan states: “Continue to evaluate and regulate offensive land uses that create unsightly conditions and adversely affect adjacent property values. In particular, pursue vigorous enforcement of the Person County Junkyard Ordinance.” Recommended Action: Vote to approve, approve with modifications or deny the requested text amendment. The Board also needs to address the Statement of Reasonableness and Consistency required by the NC General Statutes. TITLE This ordinance may be known and may be cited as “Ordinance Regulating Automobile Graveyards and Junkyards in Person County.” SECTION TWO. PURPOSE AND OBJECTIVES The purposes and objectives for which this ordinance is passed are as follows: A. To protect the citizens and residents of Person County from possible injury at automobile graveyards and junkyards. B. To preserve the dignity and aesthetic quality of the environment in Person County. C. To preserve the physical integrity of land in close proximity to residential areas. D. To protect the economic interests of the citizens and residents of Person County. E. To achieve responsible economic growth in areas of Person County that is compatible with growth and development in nearby areas. SECTION THREE. DEFINITIONS For the purpose of this ordinance, certain terms and words are hereby defined; words used in the present tense shall include the future; words used in the singular number shall include the plural number; and the plural the singular; and the word “shall” is mandatory and not directory. Automobile Graveyard: The term and definition of “automobile graveyards” shall apply to commercial establishment only. Any commercial establishment tract of land which is maintained, used, or operated for storing, salvaging, keeping, buying and selling two or more wrecked, scrapped, ruined, dismantled or inoperable motor vehicles and which are not being restored to operation, regardless of the length of time which individual motor vehicles are stored or kept at said establishment. The phrase “automobile graveyard” as used herein shall be interpreted to include all service stations and repair shops which have on their premises four or more wrecked scrapped, ruined, dismantled or inoperable motor vehicles which are not being restored to operation. Chronic Offender: A person who owns property whereupon, in the previous calendar year, the county gave notice of violation at least three times under any provision of the public nuisance ordinance. Establishment: Any commercial operation. Housing Unit: A house, an apartment, a group of rooms, or a single room occupied or intended for occupancy as separate living quarters. 7 Red text – Removed (if crossed out) or proposed new text Blue text – Existing text relocated to another section in the Ordinance 2 Junk: The term “junk” shall mean scrap metal, rope, rags, batteries, paper, trash, rubber, debris, tires, waste, or junked, dismantled or wrecked motor vehicles or parts. Junkyard, Commercial: Any establishment or place of business which is maintained, operated, or used for storing, salvaging, keeping, buying or selling junk regardless of the length of time that junk is stored or kept, or for maintenance or operation of an automobile graveyard, but shall not include garbage dumps or county-operated sanitary landfills. An establishment or place of business which stores or keeps, for a period of 90 days or more, materials within the meaning of "junk" as defined in this section shall be deemed to be a junk yard within the meaning of this chapter. Junk Yard, Residential: A residential parcel of land in which an area of 600 square feet or more of "junk materials” are kept or stored at any given place whether for profit or not. Materials enclosed in closed buildings, solid waste containers or rolling stock (i.e., rail cars, trailer or other containerized body not intended or designed to be self-propelled) are excluded. Public Road: Any road or highway which is now or hereafter designated and maintained by the North Carolina Department of Transportation as part of the State Highway System, whether primary or secondary, and any road which is a neighborhood public road as defined in North Carolina General Statute Section 136-67. Repair Shop: An establishment which is maintained and operated for the primary purpose of making mechanical and/or body repairs to motor vehicles and which receives fifty percent or more of its gross income from charges made for such repairs. School: Any public or private institution for teaching which is recognized and approved by the State of North Carolina. Service Station: An establishment which is maintained and operated for the primary purpose of making retail sales of fuels, lubricants, air, water, and other items for the operation and routine maintenance of motor vehicles and/or for making mechanical repairs, servicing and/or washing of motor vehicles, and which receives more than fifty percent of its gross income from the retail sale of this aforesaid items and/or from the making of mechanical repairs, servicing and/or washing of motor vehicles. Solid Fence: A continuous, opaque, unperforated barrier extending from the surface of the grounds to a uniform height of not less than six (6) feet from the ground at any given point, constructed of dirt, wood, stone, steel, or other metal, or any substance of a similar nature and strength. Vegetation: Evergreen trees, including, but not limited to, white pine and/or hemlock, evergreen shrubs or plants with a minimum height of six (6) inches when planted, which reach a height of at least six (6) feet of maturity. Visible: Capable of being seen without visual aid by a person of normal visual acuity. Wire Fence: A continuous, translucent, perforated barrier extending from the surface of the ground to a uniform height of not less than six (6) feet from the group at any given point, constructed of 8 Red text – Removed (if crossed out) or proposed new text Blue text – Existing text relocated to another section in the Ordinance 3 wire, steel or nylon mesh, or any substance of a similar nature and strength, but which perforations or openings are no larger than sixteen (16) square inches. SECTION FOUR. PROHIBITIONS All commercial junkyards or automobile graveyards except as hereinafter provided shall be unlawful after the effective date of this Ordinance for any person, firm or corporation, or other legal entity to operate or maintain in any unincorporated area of Person County a junkyard or automobile graveyard without first obtaining a license to operate same and without maintaining screening from view as hereafter described. SECTION FIVE. SCREENING All commercial junkyards or automobile graveyards operated and/or maintained in Person County shall be fenced at all points where said fencing shall be necessary to screen the view of persons from public roads, schools, or housing units, and where such screening is not already substantially provided by natural vegetation, or other natural barriers. The fence shall be wire fence used in conjunction with vegetation or a solid fence. If a wire fence with vegetation is used, the plants shall be planted on at least one side of the wire fence and as close as practical to said fence. Vegetation shall be planted at intervals evenly spaced and in close proximity to each other so that a continuous, unbroken hedgerow will exist to a height of at least six (6) feet along the links of the wire fence surrounding the junkyard or automobile graveyard when the vegetation reaches maturity. Each owner, operator or maintainer of a junkyard or automobile graveyard to which this Ordinance applies and who chooses to use vegetation with wire fence, shall utilize good husbandry techniques with respect to said vegetation, including but not limited to, proper pruning, proper fertilizer and proper mulching, so that the vegetation will reach maturity as soon as practical and will have maximum density in foliage. Dead or diseased vegetation shall be replaced at the next appropriate planting time, and the fence, or wire fence and vegetation, shall be maintained in good condition. All wrecked, scrapped, ruined, dismantled or inoperable motor vehicles and junk shall be stored inside said fence. SECTION SIX. APPLICABILITY This Ordinance applies to all residential zoned properties and uses and applies to junk as defined in this Ordinance from an adjacent property, and/or road. This Ordinance applies to all commercial and industrial uses on properties that abut residential and public uses and applies to junk and abandoned vehicles as defined in this Ordinance that is are visible from an adjacent property, and/or public road. SECTION SEVEN. EXCEPTIONS A. Ordinance shall not apply to residential properties that are not visible from residential or public uses (schools, playgrounds) on adjacent properties or from public roads. B. Ordinance shall not apply to service stations or repair shops unless said service station or repair shop has inoperable motor vehicles which are not being restored to operation. C. This ordinance shall not apply to bona fide farm properties as defined by NCGS §153A-340. 9 Red text – Removed (if crossed out) or proposed new text Blue text – Existing text relocated to another section in the Ordinance 4 D. Automobile graveyards or junkyards existing at the effective date of this Ordinance which would be in violation of this Ordinance shall be granted a grace period of four (4) months to conform to the provisions of this Ordinance, thereafter same shall be subject to the provisions of this Ordinance. E. The provisions of this section shall not apply to material which is being used in connection with a construction activity taking place on the premises provided the construction activity associated with an active permit is being diligently pursued, and complies with applicable ordinances and codes. SECTION EIGHT. PENALTIES A. Criminal Penalty. Any person, firm, corporation, or other entity who maintains or operates or who controls the maintenance of a junkyard or automobile graveyard in violation of this Ordinance shall be guilty of a misdemeanor and subject to prosecution, and if convicted, shall be punished by a fine not to exceed $50 or by imprisonment not to exceed thirty ( 30) days, or both, in the discretion of the Court. Each day that said automobile graveyard or junkyard shall be maintained or operated in violation of this Ordinance shall constitute a separate and distinct offense. B. Civil Penalties. In addition to the criminal sanctions as herein set out, as provided by North Carolina General Statute 153A-123 (d), and (e), this Ordinance may be enforced by an appropriate equitable remedy issuing from a court of competent jurisdiction or by injunction and order of abatement. C. The Person County Planner shall be responsible for enforcing the provisions of this Ordinance and may take informal measures to procure compliance from any person deemed by the planner or his representative to be in violation. If such informal measures fail to cause compliance, the planner shall be responsible for obtaining warrants or instigating civil remedies for violations of this Ordinance. D. This Ordinance may be enforced by an appropriate equitable remedy, including temporary restraining order, preliminary injunction and permanent injunction was issued by a court of competent jurisdiction. E. Pursuant to NCGS §153A-140.2, the County Planning Director may issue annual notice to chronic violators. The County may notify a chronic violator of the County's public nuisance ordinance that, if the violator's property is found to be in violation of the ordinance, the county shall, without further notice in the calendar year in which notice is given, take action to remedy the violation, and the expense of the action shall become a lien upon the property and shall be collected as unpaid taxes. F. Appeals 1.) Unless the owner is a chronic violator, an owner who has received a violation notice under this section may appeal from the order to the Board of Commissioners by giving written notice of appeal to the Planning Department and to the clerk within 10 days following the 10 Red text – Removed (if crossed out) or proposed new text Blue text – Existing text relocated to another section in the Ordinance 5 day the order is issued. In the absence of an appeal, the order of the Planning Director is final. 2.) Without exception, the County may notify a chronic violator of the county's public nuisance ordinance that, if the violator's property is found to be in violation of the ordinance, the county shall, without further notice in the calendar year in which notice is given, take action to remedy the violation, and the expense of the action shall become a lien upon the property and shall be collected as unpaid taxes. The notice shall be sent by certified mail. SECTION NINE EIGHT. LICENSING Any person, firm, corporation, or other organization desiring to operate, or continue to operate a junkyard or automobile graveyard after the adoption of this Ordinance shall be required to obtain a license to operate same from the Person County Planner Planning Director. The application for license shall be in writing and contain such information that, in the discretion of the County Planner Director, is needed to guarantee that the operation is, or shall be, in compliance with the provisions of this Ordinance. The County Planner Director shall issue a license to operate to each applicant, upon payment of a license fee of $50.00, unless it appears that said operation is or shall be in violation of this Ordinance. The County Planner Director shall have the authority to revoke the license or any person, firm, corporation, or other organization who fails to comply with the provisions of this Ordinance. SECTION TEN NINE. SIGNAGE All commercial junkyards and automobile graveyards operated and maintained in Person County shall be identified at the entrance to said facility by a sign not less than fifteen (15) square feet in area. SECTION ELEVEN TEN. PROCESS ENFORCEMENT PROVISIONS Complaints shall be submitted by residents and investigated by the Planning Department; upon determining that a violation of this ordinance exists, the Planning Department shall issue written notice to the registered owner, lessee, or person(s) entitled to the land. The notice shall be provided by registered or certified mail. The notice shall: 1. Identify the property and describe the violation located thereon to be removed, abated, or remedied; 2. State that the costs incurred by the county for chronic offenders to remove, abate, or remedy the violation, if not paid by the violator(s), shall be subject to NCGS §153A-140.2 for chronic offenses. 3. If the violation is not removed, abated or remedied within thirty (30) days of the initial notice, and an appeal has not been filed, a second notice shall be issued. The notice shall: 4. Advise that the property must comply by a specific date thirty (30) days from the certified mailing date of the second notice; 6. Advise that civil penalties, are being accessed daily as of the date of the second notice; and, 7. Advise that in addition to any and remedies above, the Person County Board of Commissioners may request criminal penalties (for commercial properties) in accordance with this Ordinance. 8. Chronic Violators. Pursuant to NCGS §153A-140.2, the county may notify a chronic violator of the county's public nuisance ordinance that, if the violator's property is found to be in violation of the ordinance, the county shall, without further notice in the calendar year in which notice is given, take action to remedy the violation, and the expense of the action shall become a lien upon the property and shall be collected as unpaid taxes. The notice shall be sent by certified mail. A chronic violator is a person who owns property whereupon, in the previous calendar year, the county gave notice of violation at least three times under any provision of the public nuisance ordinance. Reaves, Clerk to the Person County Board of Commissioners 13 14 15 TA‐01‐18  Staff Analysis  BOC March 19, 2018    1 Text Amendment TA‐01‐18  Commercial and Residential Junkyards    EXPLANATION OF THE REQUEST  Petition TA‐01‐18 is a request by the Person County Planning staff to amend the Ordinance  Regulating Automobile Graveyards and Junkyards in Person County regarding commercial and  residential junkyards and their associated penalties.   REQUESTED ORDINANCE CHANGES   Section Three (see attached language)  Language was amended in this section to revise the definition of a junkyard and include a  definition for a residential junkyard.    Sections Four and Five (see attached language)  Language was amended in this section to remove the word “commercial.”    Section Six (see attached language)  A typo was corrected.    Section Eight (see attached language)  Section Eight was moved to Section Ten to provide a better transition within the Ordinance.     Sections Nine, Ten, Eleven and Twelve (see attached language)  These sections were renumbered since Section Eight was moved. The term “planner” was also  amended to read “Planning Director.”    Section Ten (see attached language)  Language was added to this section to apply the criminal penalties exclusively to commercial  properties and to also outline the Chronic Violator clause contained in the NC General Statutes.   The term “planner” was also amended to read “Planning Director.”    PLANNING STAFF ANALYSIS   This text amendment request serves to clarify in which instances the Ordinance Regulating  Automobile Graveyards and Junkyards in Person County (“Junkyard Ordinance”) would apply to  a parcel of land and which penalties would apply to the violation.  While working on two current junkyard violations, staff determined that the language  pertaining to residential junkyards was contradictory. While Section Six, Applicability, of the  Junkyard Ordinance states that the ordinance applies to all properties (residential, commercial  and industrial), Section Four, Prohibitions, only prohibits commercial junkyards.      16 TA‐01‐18  Staff Analysis  BOC March 19, 2018    2 Staff also determined that the penalty section was unclear and that both criminal and civil  penalties could be applied to a parcel regardless if it was zoned commercial or residential.   Staff is recommending that criminal penalties only apply to non‐residential properties.  Civil  penalties, in accordance with the NC General Statues, can apply to both.     PLANNING STAFF RECOMMENDATION  Planning Staff recommends approval of TA‐01‐18.  Staff is requesting language in the Junkyard  Ordinance that clearly distinguishes between a commercial and a residential junkyard along  with the associated penalties for each.     REASONABLENESS AND CONSISTENCY STATEMENT    The text amendment request is consistent with the Comprehensive Plan and future planning  goals and objectives of Person County.  It is reasonable and in the public interest as it will  provide clear and concise regulations in the Ordinance Regulating Automobile Graveyards and  Junkyards in Person County.      Section 4.1.10 in the Goal and Objectives of the Land Use Plan states: “Continue to evaluate  and regulate offensive land uses that create unsightly conditions and adversely affect adjacent  property values. In particular, pursue vigorous enforcement of the Person County Junkyard  Ordinance.”        Submitted by: Lori Oakley, Planning Director  17 PERSON COUNTY BOARD OF COMMISSIONERS MEETINGMarch 19, 201818 Petition TA-01-18 - A request by the Person County Planning staff to amend the Ordinance Regulating Automobile Graveyards and Junkyards in Person County regarding commercial and residential junkyards and their associated penalties. 19 Planning Staff Analysis■This text amendment request serves to clarify in which instances the Ordinance Regulating Automobile Graveyards and Junkyards in Person County (“Junkyard Ordinance”) would apply to a parcel of land and which penalties would apply to the violation.■While working on two current junkyard violations, staff determined that the language pertaining to residential junkyards was contradictory. While Section Six, Applicability, of the Junkyard Ordinance states that the ordinance applies to all properties (residential, commercial and industrial), Section Four, Prohibitions,only prohibits commercial junkyards. 20 Section Three - Definitions■Junkyard, Commercial:Any establishment or place of business which is maintained, operated, or used for storing, salvaging, keeping, buying or selling junk regardless of the length of time that junk is stored or kept, or for maintenance or operation of an automobile graveyard, but shall not include garbage dumps or county-operated sanitary landfills. An establishment or place of business which stores or keeps, for a period of 90 days or more, materials within the meaning of "junk" as defined in this section shall be deemed to be a junk yard within the meaning of this chapter.■Junk Yard, Residential: A residential parcel of land in which an area of 600 square feet or more of "junk materials” are kept or stored at any given place whether for profit or not. Materials enclosed in closed buildings, solid waste containers or rolling stock (i.e., rail cars, trailer or other containerized body not intended or designed to be self-propelled) are excluded.21 Section Four - Prohibitions■All commercialjunkyards or automobile graveyards except as hereinafter provided shall be unlawful after the effective date of this Ordinance for any person, firm or corporation, or other legal entity to operate or maintain in any unincorporated area of Person County a junkyard or automobile graveyard without first obtaining a license to operate same and without maintaining screening from view as hereafter described.22 Planning Staff Analysis■Staff also determined that the penalty section was unclear and that both criminaland civil penalties could be applied to a parcel regardless if it was zonedcommercial or residential. Civil penalties, in accordance with the NC GeneralStatues, can apply to both.23 Section Ten –Enforcement ProvisionsPenalties and remedies for violations shall be as follows:A. Criminal Penalty(shall only apply to parcels used for commercial purposes).Anyperson,firm,corporation, or other entity who maintains or operates or who controls the maintenance of ajunkyard or automobile graveyard in violation of this Ordinance shall be guilty of amisdemeanor and subject to prosecution, and if convicted, shall be punished by a fine not toexceed $50 or by imprisonment not to exceed thirty (30) days, or both, in the discretion of theCourt. Each day that said automobile graveyard or junkyard shall be maintained or operated inviolation of this Ordinance shall constitute a separate and distinct offense.B. Civil Penalties. In addition to the criminal sanctions as herein set out, as provided by NorthCarolina General Statute 153A‐123 (d), and (e), this Ordinance may be enforced by anappropriate equitable remedy issuing from a court of competent jurisdiction or by injunctionand order of abatement.24 Planning Staff Recommendation■Planning Staff recommends approval of TA-01-18. The public hearing set to hear a request by ESA Boston Solar, LLC on behalf of property owners, Edgar & Terri Talbert, for a Special Use Permit (SUP-06-17) to allow a solar energy system on 57.85 acres located at 8117 Boston Road (Tax Map & Parcel A68- 10) in the Rural Conservation Zoning District required a quasi-judicial zoning decision whereby witnesses are to be sworn in and subject to cross examination, no ex parte communication and requires findings of fact. A copy of the approved plan and approval letter must be given to the Planning and Zoning Department prior to issuance of a Zoning Permit. ■ A final “as-built” survey must be submitted to the Planning and Zoning Department prior to issuance of a Certificate of Occupancy. 36 February 26, 2018 11 PUBLIC HEARING: REQUEST BY THE COUNTY’S ADDRESS COORDINATOR TO ADD FAITH HAVEN LN, A PRIVATE ROADWAY, TO THE DATABASE OF ROADWAY NAMES USED FOR E-911 DISPATCHING: A motion was made by Commissioner Clayton and carried 5-0 to open the duly advertised public hearing for a request by the County’s Address Coordinator to add Faith Haven Ln, a private roadway, to the database of roadway names used for E-911 dispatching. GIS Manager, Sallie Vaughn stated the request to add a private roadway to the database of roadway names used for E-911 dispatching was necessitated by the four private residences located on the same private driveway off Cunningham Rd. She noted that emergency responders have reported issues in the past with locating homes accessed along this driveway. In order to bring the addresses into compliance with Article IV, Section 402 H of the Ordinance Regulating Address and Road Naming in Person County, the driveway must be named. The addition of this road will require occupants of the four existing residences to change their addresses to reflect the new roadway name. N.C. General Statue 153A-239.1(A) requires a public hearing be held on the matter and public notice to be provided at least 10 days before the hearing in the newspaper. The required public notice was published in the February 17, 2018 edition of the Roxboro Courier-Times. Ms. Vaughn further noted that the adjacent property owners were contacted via certified mail and all four property owners have reached a unanimous decision on the name Faith Haven Ln, which is compliant with the Ordinance. A sign advertising the public hearing was placed at the proposed roadway location approximately ten days prior to this public hearing. There were no individuals appearing before the Board to speak in favor of or in opposition to the request by the County’s Address Coordinator to add Faith Haven Ln, a private roadway, to the database of roadway names used for E-911 dispatching. Substance Abuse and Mental Health Services Administration Grant 38 February 26, 2018 13 NEW BUSINESS: RESOLUTION AMENDING THE PERSON COUNTY ECONOMIC DEVELOPMENT COMMISSION FOR A CHANGE IN MEMBERSHIP: Commissioner Jeffers recalled the request from the Economic Development Commission (EDC) Chairman, David Newell, Sr., for consideration to change the EDC membership to move the City of Roxboro’s representative from an ex-officio seat without voting rights to an ex-officio with voting rights. Commissioner Jeffers presented the Board of Commissioners a Resolution Amending Person County’s Economic Development Commission for a change in Membership to increase to nine voting members and to grant voting privileges to the City of Roxboro’s representative. A motion was made by Commissioner Jeffers to adopt a Resolution Amending the Person County Economic Development Commission for a Change in Membership to add a seat for the elected mayor or an alternate elected official of the Roxboro City Council with full voting rights. Vice Chairman Powell stated his support to tweak the EDC and to add the Mayor as a voting member. Vice Chairman Powell offered a substitute motion to add Mr. Mike Wilkins to the EDC Board along with the Mayor. County Manager, Heidi York noted the statute requires a maximum of nine members; in order to add Mr. Wilkins to the EDC Board, a current member would need to come off to create the open seat for Mr. Wilkins. Vice Chairman Powell withdrew his substitute motion. The original motion made by Commissioner Jeffers carried 5-0 for the Mayor or a designated elected official of Roxboro City Council to be appointed to the EDC Board with voting rights. 39 February 26, 2018 14 40 February 26, 2018 15 41 February 26, 2018 16 PRELIMINARY RESOLUTION TITLED “RESOLUTION MAKING CERTAIN DETERMINATIONS CONCERNING A PROPOSED INSTALLMENT FINANCING AGREEMENT TO FINANCE A PORTION OF THE COST OF VARIOUS PROJECTS AND PROVIDING FOR CERTAIN RELATED MATTERS” RELATED TO THE FINANCING OF PUBLIC SAFETY COMMUNICATION TOWERS, RELATED FACILITIES AND EQUIPMENT; AND OTHER VARIOUS COUNTY AND SCHOOL BUILDING IMPROVEMENTS: Finance Director, Amy Wehrenberg requested the Board to approve a Resolution making certain Determinations concerning a Proposed Installment Financing Agreement to Finance a portion of the Cost of Various Projects and providing for Certain Related Matters” related to the financing of Public Safety Communication Towers, Related Facilities and Equipment; and Other Various County and School Building Improvements. She explained that the presented Resolution represented the Board’s formal intent to finance the construction of two (2) public safety communication towers, the purchase and installation of related facilities and equipment, as well as building improvements to Huck Sansbury Gym, and various School buildings (collectively, the “Project”). This Resolution includes five (5) additional building improvements* that were deemed critical and necessary during staff’s evaluation of requested Capital Improvement Plan (CIP) projects received on February 16, 2018. Ms. Wehrenberg noted the recommendation to add these projects to the debt financing was the result of the funding constraint created in the CIP with the addition of the large $1.3M fiber project that was also scheduled for next year. Ms. Wehrenberg said this funding strategy allows the General Fund to commence with the much-awaited fiber project without having to defer other major capital needs submitted by the County, Community College, and the Schools. The average annual debt payment for the financing of the projects listed below is $380K. The maximum amount of funds necessary to finance the Project is $4,750,000, but less is anticipated. Ms. Wehrenberg stated that firm estimates and final loan documents will be available for the Board’s consideration at their meeting on April 9, 2018. Establishes certain findings and determinations regarding the proposed financing that it is necessary and expedient to provide funding by debt; that this particular type of financing is preferable; the amount of the proceeds of the proposed debt is sufficient; the County’s debt policies are in good order; an increase in taxes to fund repayment of the debt is not anticipated; and that the County is not in default on any of its debt 2. Designates and authorizes certain County officials to represent the County in filing an application with and requesting approval from the Local Government Commission (LGC) for the proposed financing agreement 3. Requests that the LGC approve the proposed financing agreement 4. Designates the special counsel to represent the County’s interests 5. The resolution is effective upon its passage by the Board (Note: At this time, it is anticipated that the conveyance of Northern Middle School will be pledged as collateral for this financing.) A motion was made by Commissioner Jeffers and carried 5-0 to adopt a Resolution making certain Determinations concerning a Proposed Installment Financing Agreement to Finance a Portion of the Cost of Various Projects and providing for Certain Related Matters. 43 February 26, 2018 18 RESOLUTION MAKING CERTAIN DETERMINATIONS CONCERNING A PROPOSED INSTALLMENT FINANCING AGREEMENT TO FINANCE A PORTION OF THE COST OF VARIOUS PROJECTS AND PROVIDING FOR CERTAIN RELATED MATTERS. WHEREAS, the County of Person, North Carolina (the “County”) is considering entering into an installment financing agreement and certain related documents pursuant to G.S. §160A-20, as amended, for the purpose of providing funds in an amount not to exceed $4,750,000, with other available funds, for paying the cost of (a) acquiring, constructing and installing two communication towers and related facilities and equipment that are a part of a project to improve the public safety communication system serving the residents of the County, (b) installing a heating, ventilating and air conditioning system at the Huck Sansbury Gym, (c) replacing the fire alarm system and three rooftop heating, ventilating and air conditioning units at Northern Middle School, (d) replacing the roof at Early Intervention & Family Services, (e) replacing the cooling towers at Helena Elementary School and Stories Creek Elementary School and (f) replacing heating and cooling unit valves at South Elementary School (collectively, the “Project”); and WHEREAS, it is necessary to take certain related actions at this time; NOW, THEREFORE, BE IT DETERMINED AND RESOLVED by the Board of Commissioners for the County, as follows: Section 1. The Board of Commissioners for the County (the “Board of Commissioners”) hereby finds and determines in connection with such proposed agreement that (a) the proceeds of such proposed agreement will be used to finance a portion of the cost of the Project to meet an urgent need for improved school and other public facilities constituting the Project to serve the residents of the County and, accordingly, such proposed agreement is necessary or expedient for the County, (b) such proposed agreement, under current circumstances, is preferable to a bond issue of the County for financing the same purpose because there is not adequate time to authorize and issue bonds of the County prior to the time when funds will be needed for such purpose, (c) the sums estimated to fall due under such proposed agreement are adequate and not excessive for its proposed purpose because they are based upon the County’s best estimate of the cost of the Project, (d) the County’s debt management procedures and policies are good and its debt will continue to be managed in strict compliance with the law, (e) any increase in taxes necessary to meet the sums estimated to fall due under such proposed agreement will not be excessive because the County expects that it will not be necessary to increase taxes for such purpose and (f) the County is not in default regarding any of its debt service obligations. 44 February 26, 2018 19 Section 2. The County Manager, the Finance Director and the County Attorney of the County are each hereby designated as a representative of the County to file an application for approval of such proposed agreement with the Local Government Commission of North Carolina and are authorized to take such other actions as may be advisable in connection with the negotiation of such proposed agreement and the development of the related financing; and all other actions heretofore taken by any of such officers or any other officer of the County relating to such matter on behalf of the County are hereby approved, ratified and confirmed. Section 3. The Board of Commissioners hereby requests the Local Government Commission of North Carolina to approve such proposed agreement under Article 8 of Chapter 159 of the General Statutes of North Carolina, as amended. Section 4. The law firm of Robinson, Bradshaw and Hinson, P.A., Charlotte, North Carolina, is hereby confirmed as special counsel to the County in connection with such proposed agreement. Section 5. This resolution shall take effect immediately upon its passage. Upon motion duly made and seconded, the foregoing resolution was passed by the following vote: Ayes: Chairman Tracey L. Noes: None. 45 February 26, 2018 20 REQUEST TO ACCEPT PIEDMONT ELECTRIC MEMBERSHIP CORPORATION LOAN FOR AMBULANCES AND TURNOUT GEAR: Finance Director, Amy Wehrenberg stated the Piedmont Electric Membership Corporation (PEMC) Board of Directors approved an interest-free loan on January 30, 2018 for Person County to purchase three ambulances and turn-out safety gear with the following terms: 1. Amount of Loan: $776,086.00 2. Payment Term: Five-year zero interest loan consisting of five annual payments to PEMC of $155,217.20 3. First payment due on or before September 1, 2018 4. Annual Loan Servicing Fee of 1% on outstanding balance as of December 31st of each year 5. Loan documents to consist of loan agreement, promissory note and security agreement 6. Person County will pay expenses associated with loan closing cost (estimate of $3,000) 7. The budgeted funds and actual expense for the vehicles and equipment will be recorded in the EMS Department. 46 February 26, 2018 21 Ms. Wehrenberg recommended the Board to accept the interest-free loan offer from PEMC as presented and grant the necessary authority to the County Manager and Finance Director to execute the associated loan documents on the County’s behalf. A motion was made by Commissioner Clayton and carried 5-0 to accept Piedmont Electric Membership Corporation interest-free loan for Person County to purchase three ambulances and turn-out safety gear as well as grant authority to the County Manager and Finance Director to execute the association loan documents on the County’s behalf with the terms as presented. APPROPRIATION OF FUNDS FOR EMS: EMS Operations Manager Greg White reminded the Board that in January EMS approached the Board to seek permission to look at a possible lease purchase loan. Director of Emergency Management Services, Douglas Young approached Piedmont Electric to pursue a non-interest bearing loan in the amount of $776,086 which has been approved. The closing date on this loan is not set until August 2018. Mr. White stated with the projected closing date of August, the three ambulances will not arrive until the end of this calendar year and the prices of the safety gear will increase in March 2018. In order to help reduce vehicle maintenance cost and keep current ambulance and safety gear pricing, Mr. White requested the Board to approve the advance purchase of one of the three ambulances and safety gear during this budget year (FY 17/18) for $272,335. The cost of the ambulance is $226,055 and the safety gear is $46,280. Mr. White said that once the loan was closed and proceeds are received, the County would reimburse the County for this ambulance and turnout gear in FY 18-19, and be in place for the purchase of the remaining two ambulances. County Manager, Heidi York clarified that the request was for an advance of Fund Balance to allow him to order one ambulance and purchase the turn out gear and once the loan proceeds are received in August, the County would reimburse the Fund Balance appropriation that was advanced. A motion was made by Commissioner Clayton and carried 5-0 to approve the advance purchase of one of the three ambulances and safety gear through a Fund Balance appropriation during this budget year (FY 17/18) for $272,335 with this amount to be reimbursed upon receipt of the loan proceeds as presented. 47 February 26, 2018 22 APPOINTMENT TO BOARDS AND COMMITTEES: Clerk to the Board, Brenda Reaves presented interested citizens applications to fill vacancies on the following: A. MANAGER’S REPORT: County Manager, Heidi York reported the Economic Development Commission would be meeting at 4:00pm on February 27, 2018. Ms. York stated the Board of Commissioners were invited to a Public Sector Star Award Celebration on February 28, 2018 at 10:00am hosted by the Person County General Services Department in the Auditorium. 48 February 26, 2018 23 COMMISSIONER REPORT/COMMENTS: Commissioner Puryear thanked the Board for accommodating his request to attend the meeting via telephone conference. Commissioner Jeffers made the group aware of the state of NC overpayment to providers providing child care noting the state has asked the Department of Social Services to assist in recouping the over payment from the providers. Commissioner Clayton reported on a recent field trip to Polk County to tour its Ag Economic Development Program noting an opportunity to view its Ag Economic position along with its state-of-the-art Tryon Horse Complex. He said the Assistant County Manager could provide more details. Commissioner Clayton advocated the County reconsider its vehicle rotation program; he gave an example of the vehicle used on the recent field trip having dry-rotted tires that caused blow-outs. BA‐1351 AGENDA ABSTRACT Meeting Date: March 19, 2018 Agenda Title: Updated Lease Agreement with Bushy Fork Grange Summary of Information: The County entered into a lease agreement with Bushy Fork Grange in April 2008 for use of the former Bushy Fork School property to include the “cafeteria building, barbecue pit, and the parking lot in front of the cafeteria building.” The property is used for meetings of the Grange and other community and social functions. The term of this lease was for one year with nine consecutive one year automatic renewals. The rental rate is $1.00 per year. None of the terms nor conditions of the 2008 agreement have changed, just an updating on the effective date and a renewal for an additional ten year agreement, as requested by the Grange. Submitted By: Heidi York, County Manager 52 NORTH CAROLINA  PERSON COUNTY    LEASE AGREEMENT     This lease agreement, made and entered into this 21st day of April, 2018, by and between  Person County, a body politic and corporate (the “County”), and the Bushy Fork Grange, an  unincorporated organization (the “Grange”):   WITNESSETH:   WHEREAS, the Grange has for a considerable length of time occupied and maintained the  hereinafter described real property for various local community functions; and,   WHEREAS, the parties desire to enter into a lease of said property in accordance with the  following terms and conditions;   NOW, THEREFORE, in consideration of the mutual covenants contained herein the parties agree  as follows:  1. PROPERTY DESCRIPTION  The County does hereby lease to the Grange the cafeteria building, the barbeque pit, and the  parking lot immediately in front of the cafeteria building, adjoining N.C. Highway 49, said property  being part of what is commonly known as the Bushy Fork School property, located approximately  ten miles South of the City of Roxboro on N.C. Highway 49.  2. USE OF PREMISES AND RESTRICTION OF USE  The property shall be used for meetings of the Bushy Fork Homemakers Club, meetings of the  Grange, and other community and social functions.  3. Term  The term of this lease shall be for a period of one year from the date of the execution of this  agreement.  4. AUTOMATIC RENEWAL  This lease shall automatically renew for nine successive one year terms unless written notice is given  by either party of notice not to renew on or before 180 days prior to the expiration date of each annual  lease term.  5. SUPERVISION AND MANAGEMENT  All supervision and management of the leased property shall be the responsibility of the Grange and  the Grange shall be responsible for custodial services, repairs and maintenance of the leased property in  such manner and such condition as to be considered satisfactory by the County.  The Grange shall keep  53 the buildings located on leased premises secure at all times including the locking of same, when not in  use.  The Grange shall not allow any attractive nuisance to be on the leased premises.  6. UTILITIES  The Grange shall be responsible for the cost of all utilities necessary for the use of the leased  property.  7. INDEMNIFICATION  The Grange shall indemnify, protect and save harmless the County from and against loss or damage  to any equipment or improvements placed by the Grange on the property.  The Grange shall indemnify  the County from and against any claims for injury or loss to person or property arising out of the  Grange’s use, supervision or maintenance of the leased property.  8. INSURANCE  The Grange shall maintain at all times during the term of this agreement, at its sole expense, liability  insurance in the combined single policy amount of at least $1,000,000.00 to insure against injury to  person or property by the negligence or tort of any invitee, agent or employee of the Grange when  acting within the scope of his authority or the course of his employment in performing the activities on  or about the land or facilities encompassed within this agreement.  The Grange shall furnish the County with evidence of all insurance policies required by this  agreement within 30 days of the execution of this document.  The policy shall provide that the insurance  shall not be cancelled or coverage reduced without the insurance carrier giving 30 days written notice to  the County.  The County shall be named as an additional insured on all insurance policies required by  this agreement.  9. IMPROVEMENTS  The Grange agrees to plan and coordinate with the County the construction of any improvements or  structures on the premises.  The County reserves the right to disapprove any such plans.  Any such plans  disapproved by the County shall not be implemented by the Grange.  All improvements of the property  shall be the property of the County.   10. ENTRY BY LESSOR  The County may enter on the leased premises at all reasonable times for the purpose of inspection,  repair or modification of the property.  It is the intent of the County to inspect the property for safety  purposes at least annually.  11. ASSIGNMENT  The Grange may not assign this agreement or allow any other person, organization or corporation to  use said premises except for periods not to exceed five days unless approved in advance by the County.  12. CONSIDERATION  The Grange agrees to pay to the Board the sum of $1.00 per year for the rental of said property.  The  first year’s rent is payable upon the execution of this instrument and if the lease is renewed for  54 successive one year periods each subsequent year’s rent shall be payable  in advance on the beginning  day of each subsequent renewal term.  13. WATER AND SEWER RIGHTS  The Grange shall have the right to use water from the well located upon the premises leased to the  Bushy Fork Athletic Club and shall be entitled to maintain septic tanks and septic lines needed to serve  the cafeteria building.  14. Retreat held on February 5th, Commissioners focused on two funding scenarios for the FY19 Volunteer Fire Department Funding and staff was directed to bring this discussion back to the Board in March. The first funding scenario proposes an increase to the VFDs of $1M annual operating funds through the new quarter-cent sales tax revenue. The viability of this scenario is dependent on the May 8th primary election where this question must be approved by voters. The second funding proposal has been revised by Commissioner Jeffers and now shifts all VFD funding to a newly created Fire Tax setting an annual funding amount at $1M. a. 1 penny on the fire tax generates $368,444 b. Set the fire tax rate at 2.71cents c. Provide for a 2% increase every other year d. Fire Chiefs to provide a distribution formula for each VFD e. Submitted By: Heidi York, County Manager 68 AGENDA ABSTRACT Meeting Date: March 19, 2018 Agenda Title: Person County Juvenile Crime Prevention Council Funding Recommendations For FY2018-2019 Summary of Information: Each year, funding is made available through the North Carolina Department of Public Safety / Division of Juvenile Justice to Person County and its Juvenile Crime Prevention Council (JCPC) to be utilized to address the needs of youth at-risk for delinquency as well as adjudicated undisciplined and delinquent youth in Person County. The funding comes in the form of a county allocation. All 100 counties in the State of North Carolina are allocated funds based on the population of youth in the county between the ages of 10 and 17. Annually, the JCPC Board conducts a planning process, which includes an array of legislated tasks: a review of the community risk factors and the risk levels of youth in the community; an assessment of the needs of the target populations; a review of the service resources available to address those needs; the identification of service gaps; and the strategic development of a plan to structure a seamless continuum of service programming to address the target population needs. As part of the development of the needed services identified in the continuum, there is a Request for Proposal (RFP) process that is completed by the JCPC Board. Non-profits and government entities may apply for the opportunity to provide services per the guidelines of the RFP. The JCPC Board reviews all requests and awards are made to service providers to address service needs identified by the JCPC Board. The JCPC Board makes its recommendation of expenditures of the allocation and presents its written annual planning documents to the Person County Board of County Commissioners for its approval. The JCPC Board performs this function as an extension of the Board of County Commissioners in its fulfillment of the legislated duties imposed upon them through general statute. Additionally, on an on-going basis, the JCPC evaluates the performance of its funded programs by annually monitoring each program through on-site visits and also monthly through program reporting at the local, monthly JCPC meetings. The JCPC is also charged with the tasks of increasing public awareness of the causes of delinquency, addressing strategies to intervene and appropriately responding to and treating the needs of juveniles while at the same time reducing juvenile recidivism. The total amount of the refund was $38,196. At the Oct. 16th board meeting, the BOC voted to fund the following projects with these additional funds:  Mental Health pilot in jails- $20,000  40 Naloxone kits and training for first responders- $3,500  Safe room at the hospital - $5,000  Drug Court - $9,696 At the Person County budget retreat, Commissioner Jeffers requested an update on how these funds were being spent. Summary of Information: Sheriff’s jail pilot 1. Contracted a psychiatrist to visit the jail for 3 hours a week until the end of June. 2. Below are the outcomes that the Peer Support Specialist will track for the pilot program: o Peer support specialist will help screen and identify if there is a mental health or substance abuse issue  % of individuals in jail who are screened for mental health issues by peer support specialist  % of individuals screened who have mental health issues o Peer support specialist will coordinate with family members to have inmates’ medication brought to the jail.  Cost of medication, if supplied by Person County o Peer support specialist will continue to be in contact with individuals post-release to ensure that they are utilizing services.  Number of individuals served by peer support specialist in jail and post- release  Recidivism rate for individuals served by peer support specialist o Peer support specialist will divert eligible individuals to detox  Number of individuals diverted to detox  Number of nights in jail for individuals diverted to detox vs. regular inmates  Amount of detox medication costs saved 71 o Peer support specialist will coordinate with DSS  Number of individuals served who are also engaged with DSS services o Peer support specialist will help with coordination and collaboration between agencies providing services to defendants  Number of community outreach presentations  Number of organizations in referral network Naloxone kits and training All EMS, VFD’s, Sheriff and Police Department first responders have access to Naloxone and have been trained to administer it. EMS reports that first responders used Narcan 30 times thus far in FY18. The first and only use of the new kits occurred within less than one month of the training and distribution. EMS has additional Naloxone supplies available to replace those that have been used. Hospital Safe Room An MOU with the hospital has been completed and the location for a “safer” room has been identified. Hospital staff has researched equipment and is gathering purchasing and installation quotes. Installation should be complete by the end of April. Drug Court Drug Court is on target to spend the additional funds. Below are Drug Court’s outcome measures thus far in FY18:  Individuals served: 37  Individuals terminated as unsuccessful: 12  Individuals neutrally terminated: 2  Individual who transferred to another drug court by moving out of county: 1  Number of drug tests given: 808  Number of positive tests: 62 (8% of drug tests come back positive)  Individuals graduated: 7 In addition, the county has received a$30,343 refund from Cardinal for FY17. Submitted By: Assistant County Manager, Sybil Tate 72 AGENDA ABSTRACT Meeting date: March 19, 2018 Agenda Title: Request for Approval of New Audit Firm’s Proposal for Auditing Services of Person County’s Annual Financial Statements Summary of Information: Finance Director is presenting the attached bid tabulation and recommendation on the audit firm to perform audit services for Person County’s annual reporting requirements for fiscal year periods ending 2018, 2019 and 2020. A Request for Proposal was released on February 15, 2018, and four audit firms responded, including the County’s current auditor. After thorough analysis of each proposal, it has been determined that Elliott Davis, PLLC, from Raleigh, NC, presented the best responsive bid. Their estimate to perform the audit for Person County for fiscal year ending 2018 is $9,000 less than our current auditor’s bid ($3,000 over lowest bid). Over the three year period, the total cost reduction from our current auditor’s bid is $38,345. Other variables that were in their favor over the other bid responses include (1) their close proximity to Person County, (2) the fact that they are a larger firm which potentially offers additional audit staffing resources, (3) high recommendations from one of the counties they are currently serving, and (4) their overall ability to submit financial reports to the Local Government Commission prior to November 30th compared to the other bidders. Recommended Action: To approve the audit firm’s three year proposal as recommended, and approve execution of first year’s contract for reporting year 2017-18.
