The Person County Board of County Commissioners will hold a public hearing on Monday,
July 10th, 2017 at 9am in Room 215 of the Person County Office Building at 304 S Morgan St,
Roxboro, North Carolina to hear the following:
Request by the Person County Address Coordinator to add Wynn Acres Trl to the database of
roadway names used for E‐911 dispatching. The proposed private roadway will be located off
Wrenn Crumpton Rd between Burlington Rd and Whitt Town Rd in Roxboro Township.
Article IV, Section 402 H of the Ordinance Regulating Address and Road Naming in Person
County requires any private roadway serving three or more homes to be officially named.
Citizens will have an opportunity to speak regarding the above request.
Specific information about the request can be obtained from the Person County GIS
Department, 325 S Morgan St, Suite D.

AGENDA ABSTRACT
Meeting Date: July 10, 2017
Agenda Title: Addition of Wrenn Acres Trail, a private roadway
Summary Information: A third residence is being added along a private driveway, which
necessitates the naming of the driveway (see map below).
Background Information: Two private residences are located on a private driveway off Wrenn
Crumpton Rd. A third private residence is being added to this driveway. In accordance with Article
IV, Section 402 H of the Ordinance Regulating Address and Road Naming in Person County, the
driveway must be named. The addition of this road will require occupants of the two existing
residences to change their addresses to reflect the new roadway name.

which is compliant with the Ordinance. A sign advertising the public hearing was placed at the
proposed roadway location approximately two weeks prior to this public hearing.
Recommended Action: Motion to approve the recommended roadway name.

The Board of Commissioners for the County of Person, North Carolina, met in
recessed session on Wednesday, June 15, 2017 at 11:00am in the Commissioners’ meeting
room in the Person County Office Building for the purpose of a budget work session.
Chairman Kendrick called the meeting to order.
ADJUSTMENTS FROM RECOMMENDED BUDGET:
County Manager, Heidi York followed up with the Board on the two following
items that were discussed at the Board’s last budget work session:
A fee for residential false fire alarms requires an ordinance by the Board
which will necessitate a public hearing. Ms. York said she would bring this
back before the Board in July or August.
Information related to Agricultural Economic Development position was
placed in the Board’s Drop Box folder titled Budget 2017-2018.
At the last budget meeting. Assistant Finance Director and Budget Manager, Laura
Jensen presented the following noted revenues and expenditures which offset for a surplus
of $21,540.

Kerr Tar Council of Governments Director, Diane Cox told the group that her
revised budget request that was needed in local funding, in addition to the approved Senior
Center HCCBG match of $32,545, was $55,926. Ms. Cox said her original request of
$100,000 was based on the agreement with the County in 2011 when the County asked
Kerr Tar to form the non-profit.
A motion was made by Commissioner Clayton to appropriate $55,926 to the Senior
Center budget, using the surplus budget $21,540 and $34,386 from Fund Balance.
Commissioner Puryear opposed appropriating Fund Balance noting his concerns
with unexpected expenditures with the potential closure of the landfill next year.
Vice Chairman Powell offered up the commissioners travel budget of $12,443.
Commissioner Jeffers noted there was $100,000 already budgeted in Contingency
that could be used.

Chairman Kendrick targeted the Governing Body budget for potential cuts and
came up with $59,611 which included a 10% cut in salary and wages for the commissioners
($5,300), doing away with the commissioners’ group insurance ($41,868) and
commissioners travel budget ($12,443). He stated his preference to cut the Governing
Body’s budget versus using Fund Balance.
A substitute motion was made by Chairman Kendrick to use the $59,611 identified
in the Governing Body’s budget; 10% cut in salary and wages for the commissioners
($5,300), doing away with the commissioners’ group insurance ($41,868) and
commissioners travel budget ($12,443) for the $34,386 needed to fund the Senior Center
budget.
Ms. Jensen stated the Board of Commissioners have the authority to set their own
salary. However, in terms of compensation and according to General Statute 153A-92,
Ms. Jensen recited that the Board of Commissioners may not reduce the salary, allowances,
or other compensation paid to an officer elected by the people for the duties of his elective
office if the reduction is to take effect during the term of office for which the incumbent
officer has been elected, unless the officer agrees to the reduction or unless the Local
Government Commission pursuant to Chapter 159, Article 10, orders a reduction.
Commissioner Jeffers stated the elected official filing fee was a percentage of the
compensation established for that office.
Ms. Jensen added that if the Board of Commissioners reduces the salaries,
allowances, or other compensation of employees assigned to an officer elected by the
people, and the reduction does not apply alike to all county offices and departments, the
elected officer involved must approve the reduction. Ms. Jensen noted while the Board
may discuss, each commissioner must make that decision individually. Ms. Jensen further
noted that the Board cannot choose where the salary savings will then be used to offset
other costs.
Finance Director, Amy Wehrenberg stated that due to the Board being in budget
deliberations, her interpretation was that the Board can take action to reduce their salary
individually but no budget decisions can be made based on those decisions. She confirmed
the budget would be in place however no expenditures would be encumbered and after the
fiscal year, those funds would end up in the Fund Balance.
Chairman Kendrick withdrew his substitute motion; Commissioner Clayton
withdrew his motion.

Commissioner Jeffers advocated for the Board’s commitment to Person County
Schools ($150,000) and Piedmont Community College ($29,000) for the requested salary
increases with Fund Balance, using recommended Contingency Funds for the $34,386
Senior Center budget and to cut the Governing Body’s travel by $10,000 to put toward a
part-time Agricultural Economic Development position.
Chairman Kendrick stated appreciation for the school system personnel, however,
he could not support to prop up an obligation of a state elected office as there was a clear,
defined line of what the county taxpayers are responsible for, which is capital
improvements and building operational costs with salary and benefits being functions of
the state government. Chairman Kendrick said Person County’s teacher supplements were
among the top 10 of the 100 counties within the state.
Related to the Agricultural Economic Development position, Chairman Kendrick
noted there may be an opportunity to contract with NC State University and/or NC A&T
for this service. Chairman Kendrick asked that more review be given to this position and
the associated options for contracting. Ms. York asked if the Board wanted to set aside
any funding for the Agricultural Economic Development position noting staff was
recommending a salary range of $20,000-$25,000. The Board preferred to have the actual
options with associated costs brought back to the Board noting there would be available
funds in the Contingency Fund.
Commissioner Jeffers proposed funding the Senior Center budget $34,386 using
recommended Contingency Funds, which will leave a balance of $65,614 in the
Contingency Fund.
A motion was made by Commissioner Jeffers and carried 5-0 to fund the Senior
Center budget using the surplus budget $21,540 and $34,386 from the recommended
Contingency Fund for a total of $55,926 with direction to staff to bring a Budget Ordinance
reflecting the adjustments for a balanced budget at its June 19, 2017 Board meeting.

Commissioner Puryear stated his pleasure that the Board did not balance the budget
using Fund Balance.
Chairman Kendrick thanked Ms. York, the Assistant County Manager, Sybil Tate
and staff for their work on preparing the budget. He also thanked the community for its
input as well.

FISCAL YEAR 2017-2018 ANNUAL BUDGET ORDINANCE:
County Manager, Heidi York requested the Board to adopt the Fiscal Year 2017-
2018 Budget Ordinance noting General Statute 159-13(a) directs that the annual budget
must be adopted by July 1. The Budget Ordinance before the Board for adoption resulted
from the budget work sessions and having fulfilled the legal requirements including the
conducting of a public hearing.
A motion was made by Commissioner Jeffers and carried 5-0 to adopt the Fiscal
Year 2017-2018 Budget Ordinance as presented.
Following is the Fiscal Year 2017-2018 Budget Ordinance, inclusive of Attachment

authorities, and committees through advertisement in the Courier-Times edition dated May

2017. The highlighted boards denote a competitive board and are eligible for the informal
interview process only should the Board desire this process to aid them in making
appointments. Should the Board be interested in holding the informal interview process

CONFERENCE:
Chairman Kendrick said the voting credentials for the 2017 Annual Conference to
be held July 21-24, 2017, in Franklin County, Ohio, must be submitted by July 7, 2017 in
order for Person County’s delegate to participate in the association’s annual election of
officers and policy adoption.
A motion was made by Commissioner Puryear and carried 5-0 to designate
Commissioner Jeffers as Person County’s delegate for the 2017 Annual NACo Conference.
CHAIRMAN’S REPORT:
Chairman Kendrick reported that on this date at 12:00 noon in the District
Courtroom, Person County will celebrate one of its personians, Ernest T. Dixon, who has
served as a deputy sheriff, a Sheriff in Person County, a volunteer fireman and a lifelong
citizen of the county and will be awarded the Order of the Long Leaf Pine, the highest
award by the Governor of the state of NC.
Chairman Kendrick thanked staff for all the hard work delivering a budget.
MANAGER’S REPORT:
County Manager, Heidi York thanked the Board for its work on the budget as well
as staff for the thoughtful analysis.
COMMISSIONER REPORT/COMMENTS:
Commissioner Jeffers had no report.
Commissioner Clayton reported there was interest among a business group in
Person County for the type of facility as Sierra; he said there was interest for operating the
transfer station and Commissioner Clayton offered his assistance as the Chairman and Vice
Chairman meet with Granville County to get this project moving forward.
Commissioner Puryear had no report.
Vice Chairman Powell had no report.

public body's staff or negotiating agents concerning the position to be taken by or on behalf
of the public body in negotiating the price and other material terms of a contract or
proposed contract for the acquisition of real property by purchase, option, exchange, or
lease with the following individuals permitted to attend: County Manager, Heidi York,
Clerk to the Board, Brenda Reaves, County Attorney, Ron Aycock, Assistant County

Wide Open Networks or UtiliPlex for the provision of services specified in the RFP in an
amount not to exceed $336,830.
A motion was made by Commissioner Jeffers and carried 5-0 to authorize the

Attached please find a request from Mr. James Dunnagan, representing D & L Associates, concerning a refund
of property taxes. Our office charged D & L Associates for a modular building that had been previously
removed by the owner. We confirmed that the modular was moved prior to January 1, 2013 by using GIS.
We have reviewed our records and determined that the error was an illegal tax, since the tax involved a structure
that was not present on the valuation date (January 1st). Under G.S. 105-381, an illegal tax is a valid defense
for a taxpayer to request and receive a refund. This error resulted in a taxable value that was overstated for
2013- 2015 by $82,414 each year. Upon written request from the taxpayer, the governing board may issue a
refund. The tax office recommends that Board approve this request.
If approved, the taxpayer will receive a refund of taxes paid for the tax years of 2013-2015. The refund will be

§ 105-381. Taxpayer's remedies.
(a) Statement of Defense. – Any taxpayer asserting a valid defense to the enforcement of the collection
of a tax assessed upon his property shall proceed as
hereinafter provided.
(1) For the purpose of this subsection, a valid defense shall include the
following:
a. A tax imposed through clerical error;
b. An illegal tax;
c. A tax levied for an illegal purpose.
(2) If a tax has not been paid, the taxpayer may make a demand for the release of the tax claim by
submitting to the governing body of the taxing unit a written statement of his defense to payment or
enforcement of the tax and a request for release of the tax at any time prior to payment of the tax.
(3) If a tax has been paid, the taxpayer, at any time within five years after said tax first became due or
within six months from the date of payment of such tax, whichever is the later date, may make a
demand for a refund of the tax paid by submitting to the governing body of the taxing unit a written
statement of his defense and a request for refund thereof.
(b) Action of Governing Body. – Upon receiving a taxpayer's written statement of
defense and request for release or refund, the governing body of the taxing unit shall within 90 days
after receipt of such request determine whether the taxpayer has a valid defense to the tax imposed or
any part thereof and shall either release or refund that portion of the amount that is determined to be in
excess of the correct tax liability or NC General Statutes - Chapter 105 592 notify the taxpayer in writing
that no release or refund will be made. The governing body may, by resolution, delegate its authority to
determine requests for a release or refund of
tax of less than one hundred dollars ($100.00) to the finance officer, manager, or attorney of the taxing
unit. A finance officer, manager, or attorney to whom this authority is delegated shall monthly report to
the governing body the actions taken by him on requests for release or refund. All actions taken by the
governing body or finance officer, manager, or attorney on requests for release or refund shall be
recorded in the minutes of the governing body. If a release is granted or refund made, the tax collector
shall be credited with the amount released or refunded in his annual settlement.
(c) Suit for Recovery of Property Taxes. –
(1) Request for Release before Payment. – If within 90 days after receiving a taxpayer's request for
release of an unpaid tax claim under (a) above, the governing body of the taxing unit has failed to grant
the release, has notified the taxpayer that no release will be granted, or has taken no action on the
request, the taxpayer shall pay the tax. He may then within three years from the date of ayment bring a
civil action against the taxing unit for the amount claimed.
(2) Request for Refund. – If within 90 days after receiving a taxpayer's request for refund under (a)
above, the governing body has failed to refund the full amount requested by the taxpayer, has notified
the taxpayer that no refund will be made, or has taken no action on the request, the taxpayer may bring
a civil action against the taxing unit for the amount claimed. Such action may be brought at any time
within three years from the expiration of the period in which the governing
body is required to act.
(d) Civil Actions. – Civil actions brought pursuant to subsection (c) above shall be
brought in the appropriate division of the general court of justice of the county in which the taxing unit
is located. If, upon the trial, it is determined that the tax or any part of it was illegal or levied for an
illegal purpose, or excessive as the result of a clerical error, judgment shall be rendered therefor with
interest thereon at six percent (6%) per annum, plus costs, and the judgment shall be collected as in

Summary of Information:
GS 160A allows for the sale of surplus property via the upset bid process. This process begins with
an initial offer. The initial offer is then advertised and new bids that are not less than ten percent
(10%) of the first one thousand dollars ($1,000) and five percent (5%) of the remainder are solicited.
This process is followed until no further bids are received.
Unfortunately, Environmental Health has deemed both of the Roxplex properties “unsuitable” for
septic systems, even when combined. If the Board decides to move forward with the sale of these
properties, staff recommends accepting bids for both Roxplex lots together and separately. The Old
Senior Center and the Old Hotel lots will be sold separately.
Attached are maps of the properties.

property. The resolution creates an intent of the Board to lease the property for use by the Charter
School. Technical details are being negotiated with Dr. Daniel, the organizer of the school. The
resolution of intent will be used in the application to the state for the Charter School.

to Piedmont Career Academy, Inc.
Whereas Person County owns the property upon which the Old Helena School is
situated, and
Whereas Person County presently utilizes a building on the property for the use of the
EMS Department, and on a part time basis the outside recreation and athletic facilities
and the Gym, and
Whereas the balance of the property is idle and non-productive, and
Whereas Piedmont Career Academy has through its organizer, Dr. Eddy Daniel,
requested that the County lease the idle property to it for use as a Charter School, and
Whereas the Charter school will emphasize work readiness, and
Whereas the school requests joint use with the county of the Gym, athletic fields and
recreational areas, and
Whereas Piedmont Career Academy proposes to make improvements to the property
which will cost approximately $2.5 million.
Now Therefore the Person County Board of County Commissioners Resolves as
follows:
1- The use of the property and facilities by the Charter School will be a reasonable and
appropriate use of the excess property.
2- The improvements to the property will have a reasonable value to the County
property of $2.5 million
3- The Board expresses its intent to negotiate a lease to Piedmont Career Academy the
property at the old Helena school site and ultimately to execute such a lease to the
Academy as outlined above.

Summary of Information:
As required by G.S. 105-294(a), the Person County Board of Commissioner's must appoint a Tax
Assessor. The Board of Commissioners appointed the current tax assessor, Russell Jones, on
July 20, 2015 for a 2 year term, which will expire this month. The current tax assessor is
certified by the North Carolina Department of Revenue as an Assessor, and therefore eligible for
a 4 year appointment. It is customary for counties to appoint an Assessor for the full 4 year term.
§ 105-294. County assessor.
(a) Appointment. – Persons occupying the position of county assessor on July 1, 1983, shall continue
in office until the first Monday in July, 1983. At its first regular meeting in July, 1983, and every two
years or four years thereafter, as appropriate, the board of county commissioners of each county shall
appoint a county assessor to serve a term of not less than two nor more than four years; provided,
however, that no person shall be eligible for initial appointment to a term of more than two years
unless such person is deemed to be qualified as provided in subsection (b) of this section or has been
certified by the Department of Revenue as provided in subsection (c) of this section. The board of
commissioners may remove the assessor from office during his term for good cause after giving him
notice in writing and an opportunity to appear and be heard at a public session of the board.
Whenever a vacancy occurs in this office, the board of county commissioners shall appoint a
qualified person to serve as county assessor for the period of the unexpired term.
Recommended Action: Appoint a County Tax Assessor for a designated term and
administer oath.

Agenda Title: Public Safety Communication System Update and Funding Request
Summary of Information:
Staff is moving forward with construction of two towers located at Bethel Hill and Bushy Fork. The
RFP for tower construction is scheduled to be advertised July 15th, with bids due July 31st. Towers
should be completed by spring 2018. When the towers are completed, the county will hang public
safety communication equipment and wireless broadband equipment on them. The entire project is
estimated to be completed by winter 2018.
In order to ensure that the towers are completed quickly after the bids are received, staff is
requesting funding from the General Fund for the tower construction in advance of the financing.
Once the proceeds from the financing are received, the General Fund will be reimbursed for the
costs associated with the tower construction. This allows construction to begin immediately, instead
of waiting 2-3 months after the bids are received for funding from the financing. Using the
reimbursement strategy also eliminates the need to ask vendors to update the VHF equipment bids.
Staff also requests moving forward with two additional school CIP projects in FY18. These projects
are:
Northern Middle School‐ Replace rooftop HVAC units‐ $535,000
Northern Middle School ‐ Fire alarm replacement ‐ $150,000
These projects would be included in the tower financing project, along with the already approved
bleachers ($85,000) for Northern Middle School. Adding these items to the financing allows
Northern Middle School to be used as collateral for the financing. This addition also accomplishes
much-needed school repairs more quickly and reduces strain on the CIP in future years. In order to
use Northern Middle School as collateral, the County will need to request conveyance of Northern
Middle School from the School Board.
Recommended Action: Direct staff whether or not to proceed with advancing funds for tower

Summary of Information: Voting Credentials for the 2017 NCACC Annual Conference
scheduled on August 10-13, 2017 in Durham County must be submitted by August 4, 2017
in order for Person County’s delegate to participate in the association’s annual election of
officers and policy adoption.
Recommended Action: Designate a commissioner attending the Conference as Person
County’s delegate. At this time, both Commissioners Clayton and Jeffers plan to attend the
full conference.
