AGENDA ABSTRACT
Meeting Date: January 7, 2013
Agenda Title: Public Hearing for a text amendment to the Zoning Ordinance
pertaining to nonconforming uses and accessory uses.
Legislative Zoning Decision: This is a legislative hearing, evidence is not required,
members are free to discuss outside of hearing, no findings of fact are required.
Summary of Information:
The Planning Board has addressed the nonconforming use and accessory use sections of
the Zoning Ordinance. The Board has recommended the following amendment changes:
1. Definition for nonconforming building, nonconforming lot and nonconforming
use.
2. Allow existing nonconforming buildings to continue in use but not all
enlargement or extension unless the ordinance is met.
3. If a nonconforming use of land or building is discontinued for longer than one
year, must now conform.
4. Board recommends deleting Section 101-8 which allows the enlargement of a
nonconforming use with a Special Use Permit.
5. Nonconforming lot of record may be built upon provided setbacks are met. States
a variance is required if setbacks can not be met.
6. Section 101-10 addresses lots reduced in size due to government action such as
realignment of a street.
7. Accessory building more clearly defined stating that is to include sheds, garages,
lean to’s, storage building, carports, pool. (well houses, gazebo not included). A
pool or pool house is not included if attached by either a deck or solid material to
the principal structure.
8. Section 60-5 allows accessory structures five feet from side and rear property
lines and the principal structure.
9. 60-6A – accessory structures only allowed in side and rear yards except for lots 5
acres and larger.
10. 60-6B Accessory buildings are allowed only on lots with primary dwellings,
business or industrial uses.
Recommended Action
The Planning Board held a Public Hearing on November 8, 2012 and voted 4 to 0 to
recommend approval of all of the proposed ordinance changes as stated in the staff
report.

Planning Board Recommended Changes to the Non-conforming Use and Accessory
Structure sections of the zoning ordinance
Text in italics are proposed changes.
Text in bold are additions to the ordinance.
Nonconformities are existing, completed land uses, structures, or lots that were legal
when established but are inconsistent with subsequently adopted or amended land use
regulations. A use that is initiated in violation of a zoning ordinance does not enjoy
nonconforming status.
NONCONFORMING USES
New Definitions to Consider: The Ordinance needs to define the following:
Nonconforming Building – A building or structure that is not in conformance with
the provisions(Section 75-Table of Dimensional Requirements) of the district in
which it is located.
Nonconforming Lot – Surveyed and recorded lots that met existing zoning
regulations when created but no longer conform with the adopted regulations.
Nonconforming Use – A lawful use of land that does not comply with the use
regulations for its zoning district but which complied with applicable regulations
before adoption of this Ordinance or the predecessor Person County Zoning
Ordinance.
101-1 Nonconforming uses may not be changed to another nonconforming use unless
the Board of Adjustment determines that such change shall be no more
detrimental to the neighborhood than the existing use; however, no change of title
or possession, or right to possession of property shall be construed to prevent the
continuance of a nonconforming use.
101-2 No building may be extended or enlarged or the amount of land devoted to a use
increased unless such extensions or enlargements comply with all the provisions
of this ordinance.
Proposed 101-2
Any structure existing at the time of adoption of this Ordinance which does not
comply with setback or yard requirements, or which exceeds height requirements, may be
continued in use but shall not be enlarged or extended unless such extensions or

enlargements comply with all the provisions of this ordinance. No unenclosed portion of
a building may be enclosed if the setback or height requirements are not met.
101-3 Nothing in this ordinance shall be construed to prevent the reconstruction of any
building, conforming or nonconforming, damaged by any means. However, any
nonconforming building which is damaged may only be replaced by a structure of
equal or smaller size and square footage as that of the previous structure. No
reconstruction or new construction shall be allowed which creates any new or
additional nonconformity than that which existed at the time of damage.
101-4 If a nonconforming use is discontinued for a period of 180 days or for more than
eighteen months in any three year period, the future use of the building or land
must be a conforming use.
Proposed 101-4
If any such nonconforming use of land and/or structure ceases for a period of more than
one year (except when government action impedes access to the premises), any
subsequent use of such land and/or structure shall conform to the regulations specified
by this ordinance for the district in which such land is located. Vacancy and/or nonuse of
the land or structure, regardless of the intent of the owner or tenant, constitutes
discontinuance under this Section.
101-5 A nonconforming use may be changed to a use of higher classification and
whenever the use is changed to a higher or conforming classification then it shall
not be allowed to change to the original use or to a lower use. For the purposes of
this section, the order of classification of use, form the highest to the lowest shall
be as follows: R, B-1, B-2, GI and RC.
101-6 If a nonconforming structure or a conforming structure devoted to a
nonconforming activity is destroyed or damaged in any manner, to the extent that
the cost of restoration to its condition before the occurrence shall not exceed 60
percent of the cost of reconstructing the entire structure based on the assessed
structure value, as recorded by the County Tax Assessor, it may be repaired or
restored, provided such repair or restoration is started within six months of the
damage and completed within twelve months. However, any nonconforming
building which is damaged may only be replaced by a structure of equal or
smaller size and square footage as that of the previous structure. Relief to the time
limits may be granted by the Board of Adjustment.
101-7 A nonconforming structure or a conforming structure devoted to a
nonconforming activity that is damaged by any casualty to an extent more than 60
percent of its assessed value, based on County Tax Assessor records, shall not be
restored except as follows:
a. As a conforming use.

b. If the use is a one-family dwelling, restoration shall be permitted, provided
such restoration is begun within six months of the casualty and completed
within 24 months of the casualty.
c. For structures except a one family dwelling, restoration of a nonconforming
structure shall require approval by the Board of Adjustment. A site plan
according to Section 80 will be required. In approving such permit, the Board
will consider the stated purpose for establishing the zoning district in which
the structure is located, the uses in the area immediately surrounding the
structure in question, particularly the other nonconforming uses, and the
hardship which would result from a denial of the Conditional Use Permit. The
permit shall include conditions as to time for repair to be completed and any
other conditions deemed necessary to carry out the intent of this section of the
ordinance.
101-8 A nonconforming use may be extended or enlarged with a Special Use Permit
provided that the addition is no more than fifty percent of the original structure
and a landscape buffer is provided to buffer the new portion from adjacent land
owners and all setbacks, height, and area requirements of the Planning Ordinance
are met. Single family dwellings are exempt from Section 101-6.
(The Planning Board proposes to delete this section from the ordinance)
New Sections to be considered:
101-9 Nonconforming lots of record: Permitted Structures may be erected upon
any single lot of record at the time of adoption of this Ordinance, provided
the minimum yard requirements are met. A variance to the zoning
ordinance is required if the yard width or setback requirements can not be
met.
101-10 The creation of a lot with a width or area smaller than allowed by existing
zoning requirements is prohibited, except by governmental action, such as a road
widening. Any lot, which, by reason of realignment of a public street or highway or
by reason of condemnation proceedings, has been reduced in size to an area less
than that required by law, shall be considered a nonconforming lot of record subject
to the provisions set forth in this section; and any lawful use or structure existing at
the time of such highway realignment or condemnation proceedings which would
thereafter no longer be permitted under the terms of this ordinance shall be
considered a nonconforming use or structure as that term is used in this ordinance.
101-11 When any nonconforming use is superseded by a permitted use, the use shall
thereafter conform to the regulations for this district, and no nonconforming
use shall thereafter be resumed.

The Planning Board decided to keep these sections, making no changes:
102-1 Nothing in this ordinance shall prevent the restoring or strengthening of a
nonconforming structure to a safe condition, provided that the square feet of the
structure shall not be increased.
102-2 Should any nonconforming structure be moved for any reason within the Zoning
Jurisdiction of Person County, it shall conform to the regulations for the district
in which it is to be located.
The following section will be deleted. The proposed Section 101-9 is the same as this.
103-1 In any district, notwithstanding the dimensional requirements for the district in
regards to lot width and minimum area, buildings, may be erected on any legally
created lot of record existing at the effective date of adoption to this ordinance.
Accessory Structures
An accessory building - An accessory building, structure or use is a building or structure
or use on the same lot or site with, of a nature customarily incidental or subordinate to,
and of a character related to the principal use or structure. Accessory buildings are, but
not limited to : sheds, garages, lean to, storage buildings, carports, pool, but not to
include well houses(not to exceed 6’ x 6’) , gazebo or pool house if attached to
footprint of pool.
Pools - Pools are considered accessory uses if they are above ground or in ground if
not attached by either a deck or solid material such as brick, stone, concrete, etc. to
the principal structure.
60-5 Unless otherwise specified in this ordinance, accessory buildings may be allowed
within five feet of rear and side yard lot lines provided they are five feet or more from the
main structure.
Proposed 60-5
Accessory structures shall be located at least five feet from any principal structure and
side and rear property lines.
60-6 Unless otherwise specified in this ordinance, every principal building hereafter
erected or moved shall be located on a separate lot and in no case shall there be more than
one principal building and three permitted accessory buildings on all lots under three
acres. There shall be allowed one additional accessory building for every acre over three
acres. Industrial operations located in the GI district shall be exempted from this
provision.

60-6A - Accessory structures shall be placed in the rear or side yard and not the
front yard of all lots under five acres. Parcels of property containing five acres or
larger may place an accessory building in the front yard provided such building is
located at least 50 feet from any street right of way line and a minimum of twenty
five feet from any side property line.
60-6B -Accessory buildings shall only be allowed on a lot upon which a primary
dwelling, multifamily dwelling, business use or industrial use exists.

The Person County Board of County Commissioners will hold a
public hearing on Monday, January 7th, 2013, at 7:00 p.m. in the
auditorium room at 304 South Morgan Street, Roxboro, North
Carolina to hear the following:
1. Request by Person County to amend the Person County
Planning Ordinance:
a. Definition Section to add nonconforming building,
nonconforming lot and nonconforming use and
accessory building.
b. Article X: nonconforming use section to address
nonconforming lots of record, extension of
nonconforming uses, discontinuance of a
nonconforming use, and
c. Article VI, Section 60: Accessory structures related to
the number allowed, setback distances and where
located on property.
Citizens will have an opportunity to speak regarding the above
requests.

Meeting Date: January 7, 2013
Agenda Title: Person County Non-Smoking Ordinance
Summary of Information: The Person County Non-Smoking Ordinance was presented in
September 2012. Since that time, several discussions and changes have been presented.
During the November 19th meeting, the Person County Board of County Commissioners
decided to move forward with a public hearing for the Person County Non-Smoking Ordinance
in January 2013. At the Board’s meeting on December 3, 2012, the public hearing was
scheduled to be held on January 7, 2013.
Recommended Action: 1) Conduct the public hearing for public comment.
2) Approve the Person County Non-Smoking Ordinance.

PERSON COUNTY NON-SMOKING ORDINANCE
ORDINANCE BANNING SMOKING IN COUNTY FACILITIES AND
ON COUNTY PROPERTY
WHEREAS, on February 25, 2008, the Person County Board of Health adopted a rule pursuant to then
existing state law banning smoking in certain locations on County and City of Roxboro Property in
Person County;
WHEREAS, on May 19, 2009, the State of North Carolina passed "An Act To Prohibit Smoking In Certain
Public Places And Certain Places Of Employment" amending Chapter 130A of the General
Statutes and thereby authorizing local governments to adopt and enforce ordinances "that are
more restrictive than State law and that apply in local government buildings, on local
government grounds, in local vehicles, or in public places;"
WHEREAS, within said legislation the General Assembly finds "that secondhand smoke has been proven to
cause cancer, heart disease, and asthma attacks in both smokers and nonsmokers. In 2006, a
report issued by the United States Surgeon General stated that the scientific evidence indicates
that there is no risk-free level of exposure to secondhand smoke;"
WHEREAS, the Person County Board of Health has reviewed this legislation and at its meeting on February
27, 2012 took action requesting that the Person County Board of Commissioners enact an
ordinance further regulating tobacco use in the County;
WHEREAS, the Person County Recreation Advisory Board has considered the effect of second hand smoke on
participants and spectators at recreation programs and facilities and took action at its board
meeting on March 7, 2012 requesting that the Person County Board of County Commissioners
ban smoking at Recreation events and on certain Recreation and Park Lands.
WHEREAS, smoking is prohibited in certain county buildings and on certain other county property pursuant
to Health Department Rules and other County Regulations.
WHEREAS, Person County recognizes the health risks of tobacco use and secondhand smoke for non-
smokers and wishes to minimize the harmful effects of tobacco use among staff and eliminate
secondhand smoke exposure for staff and the public in those facilities and grounds controlled by
Person County. Further Person County is committed to providing a safe and healthy workplace in
County facilities for its employees and the visiting public;
WHEREAS, this Board is of the opinion that it is in the best interests of the citizens and
residents of the County to further prohibiting smoking in certain County
buildings and on certain County grounds.
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners for the County of Person as
follows:

(a) Authority. This section is enacted pursuant to authority granted in legislation titled "An
Act To Prohibit Smoking In Certain Public Places And Certain Places Of
Employment" and pursuant to authority contained in GS 130A-498 and the
provisions of G.S. 153A-121 as an exercise of the police power to protect,
promote and preserve the public health, welfare and safety of individuals in
Person County buildings, on Person County grounds, or in County vehicles.
(b) Definitions. The following definitions apply:
(1) "Grounds" - An unenclosed area owned, leased, or occupied by Person County.
(2) "Person County government building" - A building owned, leased as lessor, or the
area leased as lessee and occupied by Person County.
(3) "Person County vehicle" - A passenger-carrying vehicle owned, leased, or
otherwise controlled by Person County and assigned permanently or temporarily
by Person County to Person County employees, agencies, institutions, or facilities
for official Person County business.
(4) "Smoking or smoke" - The use or possession of a lighted cigarette, lighted cigar,
lighted pipe, or any other lighted tobacco product.
Section 2 - Prohibitions, Notices, Exceptions and Enforcement
(a) Smoking prohibited. No person shall smoke, carry or possess a lighted cigar, cigarette, pipe
or other lighted smoking equipment or paraphernalia in any Person County
buildings, in Person County vehicles or within 50 feet of any recreation, health,
and wellness amenity. All other county buildings will be regulated on an
individual basis as determined by the Board of Commissioners. These buildings
will be included as an appendix to this Ordinance.
(b) No smoking signs and instructions. The individual or the individual's designee who is in
charge of Person County buildings, Person County grounds, or Person County
vehicles shall post signs in conspicuous areas of the building, vehicles and/or
grounds. The signs shall state that "smoking is prohibited" and may include the
international "No Smoking" symbol, which consists of a pictorial representation
of a burning cigarette enclosed in a red circle with a red bar across it. In
addition, the individual or the individual’s designee in charge of the building,
vehicle and/or grounds shall direct a person who is smoking inside the building,
or on the grounds, or in a vehicle, to extinguish the lighted smoking product.
(c) Exceptions. This ordinance does not restrict or prohibit smoking in the following places:
(a) Recreation Camp Sites
(b) Piedmont Community College buildings and grounds as governed by
NCGS 115D-20.1.

(c) Designated areas which are 50 feet from any recreation, health, and
wellness amenity and are approved by the Person County Recreation
Advisory Board.
(d) Penalty for violation of section. Any person violating the provisions of this section shall be
guilty of an infraction, and the person committing the infraction may be
punished by a fine of not more than fifty dollars ($50.00). Conviction of an
infraction under this section has no consequence other than payment of a
penalty. A person smoking in violation of this local ordinance may not be
assessed court costs.
Section 3 –Effective Date
This ordinance shall be effective upon adoption by the Board of Commissioners.

The Board of Commissioners for the County of Person, North Carolina, met in
regular session on Monday, December 3, 2012 at 6:30 pm in the Commissioners’ meeting
room in the Person County Office Building.
Chairman Clayton called the meeting to order and asked the Board for a motion to
relocate the meeting to the County Auditorium.
A motion was made by Commissioner Jeffers, seconded by Vice Chairman
Puryear, and carried 5-0 to relocate the meeting to the County Auditorium.
Chairman Clayton recessed the meeting at 6:31 pm for the group to relocate to the
Auditorium.
Chairman Clayton reconvened the meeting at 6:35 pm and led invocation.
Commissioner Kennington led the Board in the Pledge of Allegiance.
APPROVAL OF MINUTES:

Chairman Clayton, Vice Chairman Puryear, Commissioners Blalock and Jeffers,
County Manager, Heidi York and Clerk to the Board, Brenda Reaves congratulated
Commissioner Kennington and spoke of the honor and privilege to serve with him the
last four years.
Chairman Clayton presented Samuel R. Kennington a plaque in appreciation of
the four (4) years of service (December 1, 2008 – December 3, 2012) and dedication to
the citizens of Person County. Commissioner Kennington received a standing ovation as
he left the Board and took a seat in the audience.
Chairman Clayton passed the gavel to County Attorney, Ron Aycock to preside
over the Swearing-In Ceremony and the Organization of the Board.
SWEARING-IN CEREMONY:
The Honorable Deborah L. Barker, Clerk of Superior Court administered the Oath
of Office to the newly elected Commissioners Jimmy B. Clayton, B. Ray Jeffers and
David Newell, Sr. She also administered the Oath of Office to Soil and Water
Conservation District Supervisors John Gray and Harold Carver, Sr.
ORGANIZATION OF BOARD:
County Attorney, Ron Aycock presided over the meeting and explained the rules
of procedure for nomination and election of the Board’s Chairman and Vice Chairman.
County Attorney, Ron Aycock presided and called for nominations for Chairman
of the Board of Commissioners.
Commissioner Newell nominated Commissioner Clayton as Chairman.
Nominations completed, a motion was made by Commissioner Newell, seconded by
Commissioner Jeffers, and carried 5-0, to close the nominations for Chairman and to
elect Commissioner Clayton as Chairman of the Board by acclamation.
County Attorney Aycock opened the floor for nominations for Vice-Chairman of
the Board.
Commissioner Newell nominated Commissioner Puryear as Vice-Chairman.
Commissioner Blalock nominated Commissioner Jeffers as Vice-Chairman.
A motion was made by Commissioner Newell, seconded by Chairman Clayton,
and carried 5-0, to close the nominations for Vice-Chairman.
Mr. Aycock stated the vote for Vice-Chairman would take place by show of
hands in the reverse order.
By show of hands, Chairman Clayton and Commissioners Jeffers and Blalock
voted to elect Commissioner Jeffers as Vice-Chairman.

Commissioner Jeffers was elected Vice Chairman by a majority vote 3-2.
APPROVAL OF BONDS:
County Attorney, Ron Aycock stated Chapter 161(Register of Deeds) and 162
(Sheriff) of the North Carolina General Statutes requires the Board of County
Commissioners to approve the official bonds at the first meeting in December. The Bonds
are a continuation of existing bonds and were secured for those elected officials by the
County Human Resources Director, who also serves as Insurance Liaison. The Human
Resources Director provided information that the Sheriff’s bond is for the length of his
term, currently to December, 2014.
Mr. Aycock requested the Board to approve the annual Bonds of the Register of
Deeds in the amount of $50,000 and $100,000 each for the Tax Administrator and
Finance Director (amount of each Bond is dictated by statute).
A motion was made by Chairman Clayton, seconded by Vice Chairman Jeffers,
and carried 5-0 to approve the Bonds of the Register of Deeds in the amount of $50,000
and $100,000 each for the Tax Administrator and Finance Director.
County Attorney, Ron Aycock passed the gavel to Chairman Clayton to preside
over the meeting. Chairman Clayton thanked his fellow commissioners for having
confidence in him as their Chairman.
Chairman Clayton announced a brief recess at 7:03 pm to allow the public an
opportunity to sign up for informal comments.
Chairman Clayton reconvened the meeting at 7:13 pm.
DISCUSSION/ADJUSTMENT/APPROVAL OF AGENDA:
A motion was made by Commissioner Newell, seconded by Commissioner
Puryear and carried 5-0 to add an item to the agenda to discuss timber on the county
farm.
A motion was made by Vice Chairman Jeffers, seconded by Commissioner
Blalock and carried 5-0 to approve the agenda as adjusted.
RESOLUTION OF APPRECIATION:
Chairman Clayton read and presented a Resolution of Appreciation to Person

proposed Recreation and Senior Center and recent Board action to move forward to the
design phase noting the conditions of the current facility’s conditions and its usage by
many residents:

Board’s action to enter into a contract for the design phase of the Recreation and Senior
Center and urged the Board to not commit funding at this time:

Ms. Dorothy Stewart Crowe of 156 Cherokee Lane, Roxboro addressed the Board of the
lack of access to broadband in the northern part of the county.
OLD BUSINESS:
REVIEW OF THE CONTRACT FOR DESIGN SERVICES OF RECREATION
AND SENIOR CENTER:
Commissioner Puryear stated the Board voted 3-2 last month to move forward to
spend over $400,000 for design fees noting it was fair to include the new Board member
on the discussion. Commissioner Puryear stated it would be a disservice to
Commissioner Newell if the Board did not revisit the future of the project.
Commissioner Newell stated his opposition of the current plan and not so much
against the Senior Center noting the current plan is too extravagant. Commissioner
Newell agreed with the public comments and concerns expressed that the current Senior
Center is a death trap. Commissioner Newell stated the fact that a facility is needed for
the Senior Center is not the question; however the amount that the County spends on the
facility is what he opposes. Commissioner Newell noted the County needs answers to the
many questions related to costs, not only to build but primarily day to day operations
further noting the estimates are disguised. Commissioner Newell stated his reservation to

spend County funds in the midst of a depression. Commissioner Newell stated the
County could reach its goals with less money. Commissioner Newell stated the Country
Club is not necessarily the answer but would lend the Senior Center to a safer facility
with transportation available with the PATS buses as well as remedy the pool situation as
early as springtime.
Vice Chairman Jeffers addressed the comment related to a disservice made by
Commissioner Puryear noting the Board is not reviewing and discussing other agenda
items from past meetings. Vice Chairman Jeffers told the group the recent Courthouse
project totaled $4.5 million with $429,000 spent in design fees. Vice Chairman Jeffers
stated the Feasibility Study prepared for the Recreation and Senior Center is a plan which
provides alternatives for youth and improves the quality of life in Person County. Vice
Chairman Jeffers noted community centers enhance educational, social and recreational
activities tailored to the needs of the community. Vice Chairman Jeffers stated the
support of the two community groups: 1) the Executive Roundtable committee chaired by
Representative Winkie Wilkins of the Recreation and Senior Center supporting the
project as a priority as well as 2) the Person Future’s Strategic Plan Foster a Sense of
Community Committee outlining Goal #2 to create and support centers for the
community with an objective to create a community center to house recreational
facilities, the Senior Center, meeting rooms and a Wellness Center to be completed by
2015. Vice Chairman Jeffers stated the Recreation and Senior Center will help increase
the number of economic development projects, decrease youth and adult obesity rates,
decrease crime rates, increase the number of older adults utilizing wellness services and
increase the amount of people of all ages that consider their lifestyle active, reduce an
average time on waitlist for senior services. Vice Chairman Jeffers reminded the group
that this project was on the ballot in 2008 and approved by the majority of the
community.
Vice Chairman Jeffers spoke to the County’s Fund Balance in 2007-2008 was
24.2% of the total budget and 36.9% in 2010-2011. Vice Chairman Jeffers stated 36.9%
equates to $17,532,848 noting a previous Board took action to retain 18% of the total
budget in the County Fund Balance. Vice Chairman Jeffers added the County has cut $7
million from the total budget since 2008 and grew the Fund Balance.
Commissioner Puryear commended Mr. Hill for a job well done however; he did
not support putting the County at risk with the main source of revenues being donations
at the same time hiring additional part-time staff. Commissioner Puryear stated he was
not against a facility noting the Board needed to plan ahead and further noted one-fourth
of the County tax base is Progress Energy and the Board should not put the County in a
situation which is not planned. Commissioner Puryear advocated for the
conservativeness of the previous Boards and recommended not to spend the Fund
Balance commenting that economic development is about jobs encouraging people to
come to Person County.

Commissioner Blalock stated the people on the opposing side of the ballot (45%)
were not present except Bayard Crumpton. Commissioner Blalock noted her concerns
related to funding the Recreation and Senior Center, the fiscal cliff affecting the entire
country suggesting the Board delay action by a month or two. Commissioner Blalock
stated the outlying residents would have difficulty getting to a centrally located center
with the need of satellite centers throughout the County. Commissioner Blalock spoke to
the attained 5% recycling goal noting the State’s goal of 40% necessitating a partnership
with the City of Roxboro to help the City reduce collection fees to raise revenue for on-
going expenses to help to pay for the community center. Commissioner Blalock
advocated for the Board to partner with the City first to help the recycling make a profit
then pay for expenses for such a center.
Chairman Clayton told the group that within two to three years there will be
school debt relieved from the County. Chairman Clayton advocated for the project to
move forward noting that the Board has the ability to freeze or cut the plan at any time
should the need arise noting the present commitment is for the plans to be created.
Chairman Clayton stated the project could be completed without a tax increase noting he
would not be in favor or a tax increase to the citizens to pay for the project. Chairman
Clayton stated support to have the design work completed should federal funds/grants
become available for projects ready to begin construction noting projects built in phases
will cost more in the long run than a stand-alone project further noting it was placed on
the ballot in 2008 and the bond passed.
Commissioner Blalock asked about moving forward with the project but not
committing the full $400,000 for the design should the County need to stop the process at
any time. County Manager, Heidi York stated the signed contract was negotiated for the
County to pay on the basis for services completed noting MHA Works would invoice the
County upon a phase being completed for payment in monthly increments. Ms. York
confirmed the contract committed to the total scope of the project totaling $425,850. Ms.
York noted the contract included clauses for either termination or suspension. Chairman
Clayton confirmed the 3-2 vote was for the design phase only to allow the County to have
contractors bid. Ms. York informed the group that following the design phase would be
the construction phase estimated to begin in August 2013 with a completion date in
September 2014.
Commissioner Jeffers reiterated the project could be done in phases noting the
basic part is the Senior Center, recreation and aquatics with a future assessment for the
future gym, skate park and racquetball courts. Commissioner Jeffers stated the
importance of doing the design phase so that the project would be ready upon the Board’s
action to proceed to the construction without having to wait to do the design phase.

A motion was made by Commissioner Newell, seconded by Commissioner
Puryear to suspend the current contract as written and to authorize the County Manager to
negotiate with the design people the continuance of the design work (blue prints for bid)
for the area designated for the Senior Center (existing buildings where the Parks and
Recreation offices are located and the old Social Services currently occupied by PCC) not
to exceed $75,000.
Commissioner Newell stated according to the estimates that area could be
renovated for $50 per foot. Commissioner Newell noted his preference to go through the
budget process before considering new construction. Commissioner Newell further noted
the many uncertainties in Washington and Raleigh.
Vice Chairman Jeffers asked Commissioner Newell about the staff that will be
displaced with his motion. Commissioner Newell stated the details could be worked out
and his motion stands.
A substitute motion was made by Vice Chairman Jeffers, seconded by Chairman
Clayton and failed 2-3 to defer consideration. Vice Chairman Jeffers and Chairman
Clayton voted in favor of the substitute motion. Commissioners Newell, Blalock and
Puryear cast the dissenting votes.
A second substitute motion was offered by Commissioner Blalock to defer
consideration to the next Board meeting. The second substitute motion died for a lack
of a second motion.
Commissioner Jeffers asked the Parks and Recreation Director, John Hill how
many employees were housed in the building in the motion. Mr. Hill responded six
employees.
The original motion carried 3-2. Commissioners Newell, Puryear and Blalock
voted affirmatively. Chairman Clayton and Vice Chairman Jeffers cast the dissenting
votes.

TEN-YEAR SOLID WASTE PLAN AND RESOLUTION ACCEPTING AND
ENDORSING PERSON COUNTY’S SOLID WASTE MANAGEMENT PLAN OF
2012:
Assistant County Manager, Sybil Tate stated the Board had reviewed and
suggested changes to the Ten Year Solid Waste Plan at its November 5, 2012 meeting
and the City of Roxboro adopted a resolution supporting the Ten Year Solid Waste Plan
at their November 19, 2012 meeting. Ms. Tate requested the Board to adopt a Resolution
Accepting and Endorsing Person County’s Solid Waste Management Plan of 2012.
Commissioner Blalock stated a plan should show progress and solutions.
Commissioner Blalock requested the following text be added to the plan under Section 6
- Assessments and Actions - Collection: If the city initiates a curbside collection service
and achieves the 40% required by the state then they could realize a savings of
approximately $113,000 while realizing a fuel savings for fewer trips to the landfill and
the following text to the section Transfer outside the geographic area covered by the plan:
These revenue losses may be offset by increasing recycling. A 50% waste diversion
curbside plan by the city would add as much as 3700 tons of recycling for our recycle
center creating a revenue increase of approximately $425,000.
Ms. Tate stated Person County will not achieve the 2012 waste reduction goals set
forth in the 2009 Solid Waste Management Plan which included a 5% reduction goal for
June 2012 and an 8% goal by 2022. Ms. Tate reminded the Board the Plan is a planning
tool and the 8% challenging goal was recommended by the Solid Waste Advisory
Committee.
Commissioner Blalock stated Person County has never met the waste reduction
goals set and in order to do so, a partnership with the City of Roxboro is needed.
Vice Chairman Jeffers stated his opposition to setting an 8% goal for waste
reduction when the 5% goal has not been attained nor to use County tax dollars to pay for
City of Roxboro curbside only.
Commissioner Newell noted his desire for the City to be receptive to the idea of
re-establishing the pick up of recyclables and deposition at the County facility thereby
saving tipping fees at the landfill. Vice Chairman Jeffers noted his preference to see a
Business Plan.
A motion was made by Commissioner Blalock, seconded by Chairman Clayton
and carried 3-2 to adopt a Resolution Accepting and Endorsing Person County’s Solid
Waste Manager Plan of 2012 with the text additions as presented. Chairman Clayton and
Commissioner Blalock and Newell voted in support of the motion. Vice Chairman
Jeffers and Commissioner Puryear cast the dissenting votes.

BROADBAND GRANT PROGRAM:
Assistant County Manager, Sybil Tate stated that on August 20, 2012, staff
provided the Board with information about the county’s new broadband granting
authority. The Board asked staff to create a Request for Proposal (RFP) to solicit
proposals from private providers to provide broadband service to un-served areas of the
county. Ms. Tate reminded the Board that on October 15, 2012 staff presented a
timeline for the RFP and a draft of a county-wide broadband survey. Ms. Tate stated the
survey opened on October 18, 2012 and was closed on November 15, 2012. The survey
was distributed through the schools, at county departments and to county employees. Ms.
Tate announced the County received 434 responses to the survey, with 68 individuals
reporting no access, 81 reporting inadequate access, 25 reporting that they “don’t know”
if they have access or not and 260 reporting adequate access. Thirteen businesses or
home-based businesses responded that they had inadequate or no access. Ms. Tate noted
the on-line survey will remain open until January 17, 2013.
Ms. Tate stated based on the county-wide survey and data from the State, the GIS
department created a map depicting the un-served areas of the County. The green areas
represent un-served areas as recorded by the State and the red dots represent the un-
served individuals resulting from the survey. Ms. Tate told the group staff have labeled
the areas and prioritized according to population, income and student population. Ms.
Tate noted there are 1,875 un-served individuals or 738 households.
Ms. Tate stated the next step is to release the RFP, review the response and
choose a vendor with the County’s goals to include the grand cost in the Capital
Improvement Plan (CIP). The projected date for grant award notification is April 2013.
Upon approval of the CIP, funds would be allocated in fiscal year 2014 on a fiscal year
basis. Ms. Tate noted the vendor applications will come to the Board at its meeting in
February.
Ms. Tate asked the Board to provide feedback on the RFP and direct staff whether
or not to release the RFP.
A motion was made by Vice Chairman Jeffers, seconded by Commissioner
Puryear and carried 5-0 to release the RFP.

NEW BUSINESS:
BOARD OF COMMISSIONERS 2013 SCHEDULE OF MEETINGS:
Clerk to the Board, Brenda Reaves told the Board that North Carolina General
Statute 153A-40 requires the Board of Commissioners to hold a regular meeting at least
once a month. Ms. Reaves presented to the Board for consideration a proposed schedule
of 2013 meetings dates which did not include dates that conflict with the NACo
Legislative Conference (March 2 – 6 Washington DC). The NACo Annual Conference
(July 19-22 Ft. Worth, Texas) will not present a conflict with the schedule. Ms. Reaves
stated to accommodate the Local Government Day participation, the March 11, 2013
meeting is scheduled for the Board’s regular meeting noting Person County Schools’ staff
has not advised the date of the Fall 2013 Local Government Day however November 18
is anticipated if the same schedule is followed as done this year. Ms. Reaves noted the
Board will hold its regular scheduled meetings in its usual Boardroom, Room 215 in the
County Office Building and to accommodate attendance, Local Government Day dates
will be relocated to the FEMA room and the Budget Public Hearing will be held in the
County Auditorium. Ms. Reaves further noted two Community Conversations are
proposed with the location to be determined closer to the meeting dates. Ms. Reaves
noted a correction on the proposed Schedule of Meeting stating the December 2, 2013
meeting should begin at 7:00 pm without a need for the Organizational Meeting at 6:30
pm.
Ms. Reaves requested Board consideration of the proposed dates and take action
to set the 2013 Schedule of Meeting dates to cause copy of such to be posted on the
bulletin board and county website.
Commissioner Puryear requested the April 15, 2013 meeting be deleted from the
Schedule of Meetings in its entirety as well as suggested the September 3rd and 16th
meetings be rescheduled for September 9th and 23rd.
A motion was made by Commissioner Puryear, seconded by Commissioner
Blalock and carried to adopt the 2013 Board of Commissioners Schedule of Meetings as
presented with the changes requested by Commissioner Puryear incorporated.

ADOPTION OF THE FISCAL YEAR 2013-2014 BUDGET CALENDAR:
County Manager, Heidi York presented the Fiscal Year 2013-2014 Budget
Calendar, a schedule for the timing of the budget process, the Board Retreat as well as
two Community Conversations. Ms. York stated the dates outlined are subject to change
if needed, but this will facilitate an organized budget process for staff and elected
officials. One change necessitated by the adoption of the 2013 Schedule of Meetings is
that the April 15 date will change to April 29 for the FY13-14 CIP adoption at the
Community Conversations Meeting. Ms. York requested Board adoption of the budget
calendar for FY 13-14 and to provide feedback and changes to staff as needed.
Commissioner Newell requested the dates of Board meetings to be starred on the
Budget Calendar.
A motion was made by Vice Chairman Jeffers, seconded by Commissioner
Blalock and carried 5-0 to adopt the Fiscal Year 2013-2014 Budget Calendar as
presented.

SCHEDULE PUBLIC HEARING RELATED TO PERSON COUNTY NON-
SMOKING ORDINANCE:
County Manager, Heidi York told the group that at the November 19, 2012 Board
of County Commissioners’ Meeting, a revised version of the proposed Non-Smoking
Ordinance was reviewed. The Board voted 5-0 to set a public hearing to receive public
comment on the proposed ordinance upon adoption of the Board’s 2013 Schedule of
Meetings.
A motion was made by Vice Chairman Jeffers, seconded by Commissioner
Blalock and carried 5-0 to schedule a Public Hearing related to proposed Person County
Non-Smoking Ordinance for 7:00 pm on January 7, 2013.

TIMBER ON THE COUNTY FARM:
Commissioner Newell stated he has been told there was mature timber present on
the county farm noting his desire to cut and sell if so. Chairman Clayton noted the
forestry service may be able to provide this service.
County Manager, Heidi stated the timber in question has previously been assessed
noting it was not ready for harvesting noting she would obtain an official
recommendation from the Forestry Service.
A motion was made by Commissioner Newell, seconded by Commissioner
Blalock, and carried 5-0 to authorize the County Manager to have a timber cruise
assessment at the county owned property in the southern part of the county.
CHAIRMAN’S REPORT:
Chairman Clayton thanked the Board members for re-electing him as Chairman of
the Board.
Chairman Clayton noted an email received from former Commissioner
Kennington related to an upcoming Chamber Board meeting noting he had discussed
with Commissioner Newell to which Commissioner Newell agreed to attend.
Chairman Clayton told the Board members that the Clerk to the Board would send
them a Board of Commissioners Committee Assignments listing for input.
Chairman Clayton stated the Board of Equalization & Review (E&R) is set to
convene in April 2013 noting the notices reflecting the revaluation will be mailed on
December 29, 2012. Chairman Clayton asked Board members to instruct citizens to
contact Russell Jones with any questions/comments related to their property valuation. If
no resolution results with Mr. Jones, the appeal process will then come before the Board
of E&R. Chairman Clayton asked the County Manager to place the Board of E&R on the
January agenda for further discussion.
MANAGER’S REPORT:
County Manager, Heidi York reminded the Board of a special called meeting
scheduled for the Board of Commissioners to meet jointly with the Board of Health and
the Social Services Board and facilitated by the School of Government on December 10,
2012 beginning at 5:00 pm in the FEMA room to explore options related to consolidating
human services.
Ms. York asked Board members to attend the annual county employee luncheon
on Friday, December 7, 2012 at 11:30 am in the County Auditorium at which time
service awards will be given at 12:00 pm to employees as well as the Outstanding
Employee of the Year will be named. Ms. York commended the Morale Committee for
their work organizing the luncheon.

COMMISSIONER REPORT/COMMENTS:
Vice Chairman Jeffers wished everyone Happy Holidays. Vice Chairman Jeffers
commented it was a sad day in Person County when the voice of the citizens falls on deaf
ears. Vice Chairman Jeffers asked staff to let Dr. Bartlett know they will be evicted
sooner than first thought. Vice Chairman Jeffers asked the County Attorney to review
options related to the landfill contract with the Board at the Board’s second meeting in
January 2013. Chairman Clayton requested Board members to email any questions to the
County Manager and/or the County Attorney.
Commissioner Puryear had no report.
Commissioner Blalock welcomed Commissioner Newell to the Board and
commented it is not a sad day in Person County noting the process was just slowed down
until time to move forward. Commissioner Blalock wished Merry Christmas to the
group.
Commissioner Newell wished everyone Happy Holidays.

Agenda Title: Review of the Proposed Recreation and Senior Center Project
Summary of Information: At the Board’s December 3, 2012 meeting, the Board voted 3-2 to
suspend the current contract for design services and authorize the County Manager to negotiate a
contract for the design of the existing buildings at the Huck Sansbury complex not to exceed
$75,000. Staff, along with MHA Works, the contracted architectural firm, has been directed to make
a presentation on the projected financial impact of a new recreation complex focusing on a new
“base” version of the project. This base version includes renovation of the existing buildings as a
combined recreation and senior center, a six-lane swimming pool and splash pool area, air
conditioning for the existing gym, and an enclosed track. Staff has also been asked to share revenue
projections, proposed membership and usage fees, as well as projected annual operating costs.
Recommended Action: Receive the presentation and provide direction to staff.

Agenda Title: Law Enforcement Center Water Heater
Summary of Information: The water heater at the Law Enforcement Center (LEC) that
provides hot water to the entire building, including pods, (except kitchen) is leaking and has
gotten progressively worse. A contractor has assessed the situation and noted that the water
heater is significantly rusted. This means that the weakened section could give way at any time
and blow out. This could be devastating in a couple of ways: the water heater is located adjacent
to numerous electrical controls and downtime on this water heater would eliminate any hot water
in the building (except kitchen).
Quotes were solicited from vendors and were received in the range from $93,400 to replace the
entire system, including gas burner/boiler to just replacing the water heater/tank for $38,780.
Quotes were obtained from Schneider (current contractor that does most work at LEC), Comfort
Systems of South Boston, and Brown Brothers of Durham. We have decided to issue the contract
to Schneider for the replacement of the tank at $38,780.
Obviously, this is an emergency expense and was not budgeted. Therefore, we are requesting an
appropriation from Fund Balance in the amount of $40,000 for the replacement of the water
heater tank.
Recommended Action: Approve a budget amendment to appropriate fund balance in the amount of
$40,000 from the General Fund to the Building Maintenance and Repair line item in General
Services Budget for the replacement of this water heater tank.

These rules apply to all meetings of the Board of Commissioners of Person County at
which the board is empowered to exercise any of the executive, quasi-judicial,
administrative, or legislative powers conferred on it by law.
Comment: On the whole, rules of procedure of a governing board are intended
to govern formal meetings of the board where it will exercise any of its executive
and legislative powers. These rules fulfill that purpose and also are designed to
ensure board compliance with the Open Meetings Law, G.S. 143-318.9 through -
318.18, which applies to any gathering of a majority of the board to discuss
public business. The rules also apply to informal work sessions or committee
meetings where public business is discussed but no official action is taken.

(a) It is the public policy of North Carolina and of Person County that the hearings,
deliberations, and actions of this board and its committees be conducted openly.
(b) Except as otherwise provided in these rules and in accordance with applicable
law, each official meeting of the Person County Board of Commissioners shall be
open to the public and any person is entitled to attend such a meeting.

(c) For the purposes of the provisions of these rules concerning open meetings, an
official meeting of the board is defined as any gathering together at any time or
place or the simultaneous communication by conference telephone or other
electronic means of a majority of board members for the purpose of conducting
hearings, participating in deliberations, or voting upon or otherwise transacting
public business within the jurisdiction, real or apparent, of the board.
Comment: See G.S. 143-318.10(d). The Open Meetings Law provides
that a social meeting or other informal assembly or gathering together of
the members of the board does not constitute an official meeting unless it
is “called or held to evade the spirit and purposes” of the laws requiring
meetings to be open.

(a) Notwithstanding the provisions of Rule 2, the board may hold a closed session
and exclude the public under the following circumstances and no others:
1. To prevent the disclosure of information that is privileged or confidential
pursuant to the law of this state or of the United States, or is not considered a
public record within the meaning of Chapter 132 of the General Statutes.
Comment: See G.S. 143-318.11(a)(1).
2. To consult with the county attorney or another attorney employed or
retained by the county in order to preserve the attorney-client privilege.
Comment: See G.S. 143-318.11(a)(2). The statute provides that general
policy matters may not be discussed in a session closed in order to
consult with the county attorney, and the mere fact that the county
attorney is participating in a board meeting is not grounds to close the
meeting. The statute further provides that the board may consider and
give instructions to the attorney concerning handling or settlement of any
pending litigation or other matter in controversy, but the terms of any
settlement (other than a malpractice claim against a public hospital) must
be reported to the board of commissioners and entered in the minutes “as
soon as possible within a reasonable time” after the settlement is
concluded.
3. To discuss matters relating to the location or expansion of industries or other
businesses in the county.

4. To consider and take action with respect to the position to be taken by the
county in negotiating the price or other material terms of an agreement for
the acquisition or lease of real property.
Comment: See G.S. 143-318.11 (a)(5). The statute does not permit a
closed session to discuss negotiations for purchase or lease of personal
property.
5. To consider and take action with respect to the position to be taken by the
county in negotiating the amount of compensation or other material terms of
an employment contract.
Comment: See G.S. 143-318.11(a)(5).
6. To consider the initial employment or appointment of an individual to any
office or position, other than a vacancy in the board of county commissioners
or any other public body, and to consider the qualifications, competence,
performance, character, and fitness of any public officer or employee, other
than a member of the board of commissioners or of some other public body.
Comment: See G.S. 143-318.11(a)(6). Final action on appointments and
discharges must be taken in open session. The statute specifically
prohibits discussing general personnel policy issues in closed session. It
also prohibits discussion in closed session of removing from office a
member of the board of commissioners or any other public body. This
prohibition does not preclude discussion of removing from office an
individual officer or employee who is not a member of a “public body.”
7. To hear or investigate a charge or complaint by or against an individual
public officer or employee.
Comment: See G.S. 143-318.11(a)(6). Final action discharging an
employee or removing an official from office must be taken in open
session.
8. To plan, conduct, or hear reports concerning investigations of alleged
criminal misconduct.

(b) The board may go into closed session only upon motion made and adopted at an
open meeting. A motion to go into closed session must cite one or more of the
permissible purposes listed in subsection (a) of this rule. In addition, a motion to go
into closed session pursuant to Rule 3(a)(1) must state the name or citation of the law
that renders the information to be discussed privileged or confidential, and a motion
to go into closed session pursuant to Rule 3(a)(2) must identify the parties in each
existing lawsuit, if any, concerning which the board expects to receive advice
during the closed session.

(c) Unless the motion to go into closed session provides otherwise, the county
manager, county attorney, and clerk to the board may attend the closed session. No
other person may attend the closed session unless specifically invited by majority
vote of the board.
Comment: The Open Meetings Law does not address this point.
Although they have no legal right to attend a closed session, the manager,
attorney, and clerk to the board are officers of the board itself and most
boards will want them present at all meetings. All other persons should be
excluded unless their presence is reasonably necessary to facilitate the
board’s deliberations on the matter before it.

(a) Even-numbered Years. The board shall hold an organizational meeting at its
regular meeting place at 6:30 P.M. on the first Monday in December of each even-
numbered year. The agenda for this organizational meeting shall be limited to
induction of newly elected members of the board of county commissioners and other
elected county officials and organization of the board for the ensuing year. The
organizational meeting shall be convened and concluded before the regular
December meeting is convened. The county attorney shall call the meeting to order
and shall preside until a chair and vice chair are elected. If they have not already
been sworn and inducted into office, the newly elected members of the board shall
take and subscribe the oath of office as the first order of business. As the second
order, the board shall elect a chair and vice-chair from among its members. As the

third order, the board shall approve the bonds of the sheriff, and the register of
deeds, and induct them and any other newly elected county officials into office.
(b) Odd-numbered Years. At the first regular meeting in December of each off-
numbered year, the first order of business shall be approval of minutes of the
previous meeting. The second order of business shall be election of the chair and
vice-chair for the ensuing year. The third and fourth orders of business may be
appointment of the clerk and county attorney.
Comment: This rule requires an organizational meeting in even
numbered years to be followed by a regular meeting.
This rule incorporates the requirements of G.S. 153A-26 concerning the
times for organizational meetings and the qualifications of new members
and the requirements of G.S. 153A-39 concerning the election of the chair
and the vice-chair. G.S. 161-4 (for the register of deeds), and G.S. 162-9
(for the sheriff) require the board to approve the bonds of these officials.
G.S. 153A-26 provides that the oath of office is that prescribed by Article
VI, Section 7, of the North Carolina Constitution (see also G.S. 11-6 and
G.S. 11-7) and may be administered by any person authorized by law to
administer oaths. The written statement of the oath shall be signed by
each new member and filed with the clerk to the board. The statute also
provides that a new member who cannot be present at the organizational
meeting may take and subscribe the oath later.

(a) Regular Meetings. The board shall hold a regular meeting on the first and third
Monday of each month or such other dates as set out in a schedule of meetings
adopted by the board. If a regular meeting day is a holiday on which county offices
are closed, the meeting shall be held on the next business day or such succeeding
days as may be specified in the motion adjourning the immediately preceding
regular meeting. Regular meetings shall be held at Person County Office Building
in the Commissioner Room and shall begin at 7:00 P.M. on the first Monday of each
month and at 9:00 A.M. on the third Monday of each month or such other date and
time as set out in the schedule of meetings adopted by the board. The board may
change the place or time of a particular regular meeting or all regular meetings
within a specified time period by resolution adopted, posted, and noticed no less
than seven days before the change takes effect. Such a resolution shall be filed with
the clerk to the board and posted at or near the regular meeting place, and copies
shall be sent to all persons who have requested notice of special meetings of the
board.
Comment: See G.S. 143-318.12(b)(1) and G.S. 153A-40(a). Any
permanent change in the schedule of regular meetings must be adopted
not later than ten days before the first meeting to which the new schedule
applies. Also, G.S. 153A-40 requires the board of county commissioners
to meet at least once a month. The notice requirements of the proposed
rule are somewhat broader than those required by law.
(b) Special Meetings. The chair or a majority of the members of the board may at
any time call a special meeting of the board by signing a notice stating the time and
place of the meeting and the subjects to be considered. The person or persons who
call the meeting shall cause the notice to be posted on the principal bulletin board
of the county or the door of the regular meeting place if there is no principal
bulletin board and delivered to the chair and all other board members or left a the
usual dwelling place of each member at least 48 hours before the meeting. In
addition, the notice shall be mailed or delivered to individual person and news
media organizations who have requested such notice as provided in subsection (d),
below. Only those items of business specified in the notice may be transacted at a
special meeting, unless all members are present or those who are not present have
signed a written waiver.

(c) Emergency Meetings. If a special meeting is called to deal with an unexpected
circumstance that requires immediate consideration by the board, the notice
requirements of this rule do not apply. However, the person or persons who call an
emergency meeting shall take reasonable action to inform the other members and
the public of the meeting. Local news organizations who have requested notice of
special meetings as provided in subsection (d), below, shall be notified of such
emergency meetings by the same method used to notify board members. Only
business connected with the emergency may be discussed at the meeting.
Comment: See G.S. 153A-40(b) and G.S. 143-318.12(b)(3).
(d) Sunshine List. Any individual person and any newspaper, wire service, radio
station, and television station may file with the clerk to the board of commissioners a
written request for notice of all special meetings of the board.
Comment: See G.S. 143-318.12(b)(2).
(e) Work Session and Committee Meetings. The board may schedule work sessions,
committee meetings, or other informal meetings of the board or a majority of the
members of the board at such times and with respect to such subject matter as may
be established by resolution or order of the board. A schedule of any such meetings
that are held on a regular basis shall be filed in the same place and manner as the
schedule of regular meetings. Work sessions and other informal official meetings
not held on a regular schedule are subject to the same notice requirements as
special board meetings.
Comment: The Open Meetings Law requires that any “official meeting” at
which a majority of the board deliberates on public business must be open
to the public and notice must be given. The last sentence of this rule
embodies that principle. The rule goes beyond the Open Meetings Law in
requiring a published schedule of work sessions or committee meetings
held on a regular basis.
G.S. 143-318.13(a) provides that if the board holds any regular, special,
emergency, or other official meeting by use of conference telephone or
other electronic means, the clerk shall provide a location and means
whereby members of the public may listen to the meeting and notice of the
meeting shall specify that location.

All meetings shall be held within the boundaries of Person County, except as
otherwise provided for herein.
1. A joint meeting with the governing board of any other political
subdivision of this state or any other state may be held within the
boundaries of either subdivision as may be stated in the call of the
meeting. At any such joint meeting, this board reserves the right to
vote separately on all matters coming before the joint meeting.
2. A special meeting called for the purpose of considering and acting
upon any order or resolution requesting members of the General
Assembly representing all or any portion of this county to support or
oppose any bill pending in the General Assembly or proposed for
introduction therein may be held in Raleigh or such other place as
may be stated in the call of the meeting.
Comment: See G.S. 153A-40(c). That statute also speaks of two other
categories of gatherings that may be held outside the boundaries of the
county: retreats, and meetings with the legislative delegation representing
the county in the General Assembly. The statute expressly forbids the
board to take any official action at any such meetings, so they are not
mentioned in the proposed rule. Remember, however, that such meetings
are covered by the Open Meetings Law if a majority of the board is
present and “deliberates” on the public business.

(a) Except as provided in this rule, any radio or television station is entitled to
broadcast all or any part of an official meeting of the board that is required to be
open to the public. Any person may photograph, film, tape-record, or otherwise
reproduce any part of the meeting required to be open.
(b) Any radio or television station wishing to broadcast any portion of an official
meeting of the board shall so notify the county manager no later than twenty-four
hours before the meeting. If the number of requests or the quantity and size of the
necessary equipment is such that the meeting cannot be accommodated in the

designated meeting room and no suitable alternative site in the county office
building is available, the county manager may require the news media either to
pool equipment and personnel or to secure and pay the costs of an alternative
meeting site that is mutually agreeable to the board and the media representatives.
Comment: See G.S. 143-318.14. Notwithstanding the proposed rule, the
board probably could not exclude broadcast media reporters simply
because they failed to give the suggested twenty-four-hour notice.

(a) The clerk to the board and county manager shall prepare the agenda for each
regular, special, and emergency meeting. A request to have an item of business
placed on the agenda for a regular meeting must be received at least three working
days before the meeting. Any board member may, by a timely request, have an
item placed on the agenda.
(b) The agenda packet shall include the agenda document, any proposed
ordinances or amendments to ordinances, and supporting documentation and
background information relevant to items on the agenda. A copy of the agenda
packet shall be available at the Clerk’s office or delivered to each member of the
board at least twenty-four hours before the meeting. Documents in the agenda
packet, if not previously available for public inspection, shall become so when
packets have been delivered to each board member or left at his or her usual
dwelling.
(c) The board may, by majority vote, add an item that is not on the agenda.
Comment: Because of the increased volume and complexity of the
matters they must consider, nearly all boards use an agenda. Some
boards use an agenda only to organize the material they must consider
and to give themselves an opportunity to study the issues before they
meet. These boards generally allow last-minute additions to the agenda
by general consent. This rule takes that approach. Other boards use their
agenda to control the length of their meetings. Often a board that uses its
agenda for this purpose will hold a work session before the regular
meeting to ask questions and thoroughly explore the proposals that must
be voted on at the regular meeting. Generally these boards take a stricter

approach and do not allow late additions to the agenda unless an
emergency exists.
The manager or the clerk may find it convenient to maintain a mailing list
of interested parties who wish to receive a copy of the agenda regularly.

The clerk to the board shall include on the agenda of each regular meeting a period
of ten minutes for comments or questions from members of the public in attendance.
The chair will first recognize individuals or groups who have made a prior
appointment to be heard, and then may recognize others, subject to available time.
The chair may specify the time allotted to each speaker. After the time set aside for
informal public comments has expired, the chair will recognize further speakers
only upon motion duly made and adopted.
Comment: The board must set aside part of one meeting per month for
individuals or groups to address the board. The rule allows any individual
or group to get on the agenda but lets the board decide whether there is
time to hear its comments. See G.S. 153A-52.1.

require the participation of nonmembers, such as members of the public
and administrative officials, may be considered first.

The chair shall preside at all meetings of the board. A member must be recognized
by the chair in order to address the board. The chair shall have the following
powers:
1. To rule on points of parliamentary procedure, including the right to rule out
of order any motion patently offered for obstructive or dilatory purposes;
2. To determine whether a speaker has gone beyond reasonable standards of
courtesy in his or her remarks and to entertain and rule on objections from
other members on this ground;
3. To call a brief recess at any time;
4. To adjourn in an emergency.
Comment: This rule replaces the question of order and appeal in
Robert’s Rules of Order (hereinafter referred to as RRO). Here, the
chair’s authority increases: his or her decisions regarding decorum in
debate and rules of parliamentary procedure are final and cannot be
appealed to the membership. In RRO, a recess can be taken only on a
motion and vote by the members. This rule gives the chair authority to
declare a recess when necessary to “clear the air” and thus hold friction
among the members to a minimum.

Comment: Good leadership depends, to a certain extent, on not taking
sides during a debate. On a small board this may not always be feasible
or desirable; yet an unfair advantage accrues to the side whose advocate
controls access to the floor. This rule is designed to ensure evenhanded
treatment to both sides during a heated debate. Ordinarily the chair
should call on the vice-chair to preside if he or she finds it necessary to
step aside. If all board members want to continue to actively participate in
the debate, the clerk to the board or some other staff member may be
asked to preside temporarily.

RRO does not refer to substantive motions as such; instead it uses such
adjectives as “main” or “principal.” Here, a substantive motion is any
motion other than the procedural motions listed in Rule 20. The possible
subject matter of a substantive motion coextends with the board’s legal
powers, duties, and responsibilities. Indeed, since Rule 14 provides that
the board shall proceed by motion, the substantive motion is the board’s
exclusive mode of action. The procedural motions detailed in the following
rules set forth the board’s various options in disposing of substantive
motions.

A motion shall be adopted if approved by a majority of the votes cast, a quorum
being present, unless an extraordinary majority is required by these rules or the laws

The chair shall state the motion and then open the floor to debate, presiding over
the debate according to these general principles:
1. The member making the motion or introducing the ordinance, resolution, or
order is entitled to speak first.
2. A member who has not spoken on the issue shall be recognized before
someone who has already spoken.
3. To the extent possible, the debate shall alternate between opponents and
proponents of the measure.
4. No member shall speak more than twice on a point in the main motion, nor
longer than ten minutes for the first speech and five minutes for the second
speech; nor shall the member speak more than twice upon an amendment or
procedural motion and then not longer than five minutes for the first speech
and two minutes for the second speech.
Comment: The fourth principle, above, is similar to Rule 10 of the North
Carolina House of Representatives. Not all boards will find it necessary or

desirable to include this provision and those that do should give careful
consideration to the time limits.

(a) In addition to substantive proposals, the procedural motions listed in subsection
(b) of this rule, and on others, shall be in order. Unless otherwise noted, each motion
requires a second, is debatable, may be amended, and requires a majority vote for
adoption.
Comment: This rule substantially departs from RRO. Each procedural
motion in RRO was reviewed to determine whether it was appropriate for
use by a small board; substantial modifications and deletions were the
result. The following enumeration of procedural motions is exhaustive; if a
procedural option is not on the list, it is not available.
(b) In order of priority (if applicable), the procedural motions are:
Comment: While a substantive motion is out of order if another
substantive motion is pending, several procedural motions can be
entertained in succession without necessarily disposing of the immediately
pending one. The order of the list below establishes which procedural
motion yields to which – for example, a move to defer consideration (6)
may be made while a move to refer to committee (9) is pending because
(6) ranks higher on the list.
1. To Adjourn. The motion may be made only at the conclusion of action
on a pending matter; it may not interrupt deliberation of a pending
matter.
Comment: This motion differs from the RRO motion in several respects.
In RRO, it is not debatable or amendable and can be made at any time,
even interrupting substantive deliberations. In view of the small number of
members and the available procedures to limit debate, this rule allows
debate and amendment of the motion to adjourn but allows the motion to
adjourn only when action on a pending matter is over. The motion to defer
consideration or to postpone to a certain time or day may be used if the
board wants to adjourn before completing action on a matter.
2. To Take a Recess.
Comment: RRO does not allow debate on this motion, but since the
number of members is small and procedures to limit debate are available,
this rule allows debate on the motion. As in RRO, the motion is in order at

any time. Note that under Rule 12, the chair also has the power to call a
brief recess.
3. To Call to Follow the Agenda. The motion must be made at the first
reasonable opportunity or it is waived.
Comment: This motion differs from the call for the orders of the day in
RRO: it may be debated and must be made when an item of business that
deviates from the agenda is proposed or the right to insist on following the
agenda is waived for that item.
4. To Suspend the Rules. The motion requires a vote equal to a quorum.
Comment: This motion differs from RRO in that it is debatable and
amendable and the number of necessary votes is a quorum rather than
two thirds. Thus if a board has five members, three members (a quorum)
must vote for the motion; if only three members are present at a particular
meeting, all three must vote for the motion in order to adopt it. This
motion is in order when the board wishes to do something that it may
legally do but cannot without violating its own rules. The procedure will
pose some problems for a three-member board, as it can be used to
prevent one member from participating in the board’s deliberations.
Frequent use of the motion to prevent one member from presenting
proposals to the board or from speaking on an issue before the board is of
doubtful legality. A three-member board may decide to require a
unanimous vote to suspend the rules.
5. To Divide a Complex Motion and Consider It by Paragraph.
Comment: this motion is the same as the division of a question and
consideration by paragraph in RRO except that it is debatable.
6. To Defer Consideration. A substantive motion whose consideration
has been deferred expires one hundred days thereafter, unless a
motion to revive consideration is adopted.
Comment: This motion, which replaces the motion to lay on the table in
RRO, was renamed to avoid confusion. It allows the board temporarily to
defer consideration of a proposal. It differs from RRO in that it may be
debated and amended, and in that a motion that has been deferred dies if
it is not taken up by the board (via a motion to revive consideration) within
one hundred days of the vote to defer consideration. (In RRO a motion
laid on the table dies at the end of that particular session of the assembly.)
One hundred days is the suggested period of time for deferring

consideration because it is also the time within which a proposal
ordinance must be enacted (see Rule 27).
7. To Call the Previous Question. The motion is not in order until every
member has had one opportunity to speak.
Comment: This motion differs from the motion in RRO. The RRO motion
is always in order, is not debatable or amendable, and requires a two-
thirds vote for adoption. Thus, it may be used to end discussion of a
proposal before every member has had an opportunity to speak. Such a
device may be necessary to preserve efficiency in a large assembly, but
with a small board, allowing every member at least one opportunity to
speak before closing debate strikes a better balance between efficiency
and fairness. After every member who wishes to speak has done so,
debate may be ended by majority vote. The second revised edition of
these Rules of Procedure for the Board of County Commissioners also
suggested that the call for the previous question may not be made before
there had at least twenty minutes of debate. That provision is deleted
from this edition in favor of the suggested principle included in Rule 19
concerning limitations on individual speeches at various steps in debate.
8. To Postpone to a Certain Time or Day.
Comment: This motion allows the board to defer consideration to a
specified time or day and is appropriate when more information is needed
or the deliberations are likely to be lengthy.
9. To Refer to Committee. Sixty days after a motion has been referred to
a committee, the introducer may compel consideration of the measure
by the entire board, regardless of whether the committee has reported
the matter back to the board.
Comment: This motion is identical with the motion of the same name in
RRO except that the introducer’s right to compel consideration by the full
board after a specified period of time prevents using the motion to defeat a
proposal by referring it to a committee that intends to take no action on it.
If the board does not use committees, this rule is unnecessary.
10. To Amend. An amendment to a motion must be germane to the
subject of the motion, but it may not achieve the opposite effect of the
motion. There may be an amendment to the motion and an
amendment to an amendment, but no further amendments. Any
amendment to a proposed ordinance shall be reduced to writing.

Comment: This motion is identical to the motion of the same name in
RRO except for the requirement for written amendments to proposed
ordinances.
11. To Revive Consideration. The motion is in order at any time within
one hundred days of a vote deferring consideration of it. A
substantive motion on which consideration has been deferred expires
one hundred days after the deferral, unless a motion to revive
consideration is adopted.
Comment: This motion replaces the motion to take up from the table in
RRO and was renamed in order to avoid confusion. This motion may be
debated and amended; the motion in RRO may not. If the motion to
revive consideration is not successful within one hundred days of the
original deferral date, the substantive motion expires. The subject matter
of the motion may be brought forward again by a new motion.
12. To Reconsider. The motion must be made at the same meeting at
which the original vote was taken, and by a member who voted with
the prevailing side. The motion cannot interrupt deliberation on a
pending matter but is in order at any time before adjournment.
Comment: According to RRO, the motion may be made at the same
meeting or on the next legal day and may interrupt deliberation on another
matter. The rule does not allow reconsideration of a vote once the
meeting adjourns. A member wishing to reverse an action taken at a
previous meeting may make a motion or introduce a new ordinance
having the opposite effect.
13. To Prevent Reconsideration for Six Months. The motion shall be in
order immediately following the defeat of a substantive motion and
at no other time. The motion requires a vote equal to a quorum and is
valid for six months or until the next regular election of county
commissioners, whichever occurs first.
Comment: This clincher motion prevents the same motion from being
continually introduced when the subject has been thoroughly considered.
Because this motion curtails a member’s right to bring a matter before the
board, a vote equal to a quorum is required. As with every other motion, a
clincher may be dissolved by a motion to suspend the rules. Six months is
merely a suggested time; the board may shorten or lengthen the time as it
sees fit. In order to give a new board a clean slate, the motion is not
effective beyond the next regular election.

the affirmative.
Comment: G.S. 153A-44 provides that board members have a duty to
vote, but does not state the remedy for failure to do so.

A proposed ordinance shall be deemed introduced at the first meeting at which it is
on the agenda, regardless of whether it is actually considered by the board, and its
introduction shall be recorded in the minutes.
Comment: G.S. 153A-45 provides that an ordinance may not be finally
adopted at the meeting at which it is introduced except by unanimous
vote. The definition of introduction therefore is important because it
makes a difference in the number of votes required to adopt an ordinance.
No North Carolina judicial decisions have addressed the question of when
an ordinance is considered to have been introduced. The rule assumes
that a measure is introduced when it has been formally presented to the
board through an approved agenda.

To be adopted at the meeting where first introduced, an ordinance or any action
with the effect of an ordinance, or any ordinance amending or repealing an existing
ordinance (except the budget ordinance, a bond order, or another ordinance
requiring a public hearing before adoption) must be approved by all members of
the board of commissioners. If the proposed measure is approved by a majority of
those voting but not by all the members of the board, or if the measure is not voted
on at the meeting where introduced, it shall be considered at the next regular
meeting of the board. If the proposal receives a majority of the votes cast at the next
meeting or within one hundred days of being introduced, it is adopted.

A majority of the board membership shall constitute a quorum. The number
required for a quorum is not affected by vacancies. If a member has withdrawn from
a meeting without being excused by majority vote of the remaining members
present, he or she shall be counted as present for the purposes of determining
whether a quorum is present. The board may compel the attendance of an absent
member by ordering the sheriff to take the member into custody.
Comment: See G.S. 153A-43. Compelling the attendance of a member
by ordering the sheriff to take him or her into custody is an extraordinary
remedy intended for use when a member obstinately refuses to attend
meetings for the purpose of preventing action on a proposal. If the board
contemplates using this power, it might be wise to give the absent
members notice that their attendance is required by the majority and may
be compelled in this manner.

Public hearings required by law or deemed advisable by the board shall be
organized by a special order, adopted by a majority vote, setting forth the subject,
date, place, and time of the hearing as well as any rules regarding the length of time
allotted to each speaker and designating representatives to speak for large groups.
At the appointed time, the chair shall call the hearing to order and preside over it.
When the allotted time expires, the chair shall declare the hearing ended and the
board shall resume the regular order of business.
Comment: G.S. 153A-52 provides that public hearings may be held
anywhere within the county and gives the board authority to adopt rules
governing the hearings.

A quorum of the board shall be required at all public hearings required by law.
Comment: G.S. 153A-52 implies that a quorum of governing board
members is necessary for a public hearing by providing that a hearing
shall be deferred to the next regular meeting if a quorum is not present at
the originally scheduled time. However, if the board decided to hold a
public hearing not required by law to gather a consensus of public opinion
on an issue, the hearing could be held at several sites, with a few
members at each site.

Minutes shall be kept of all board meetings.
Comment: G.S. 143-318.10(e) requires all public bodies to keep “ full
and accurate” minutes of all official meetings, including closed sessions.
Minutes of closed sessions must be a “general account… so that a person
not in attendance would have a reasonable understanding of what
transpired.” Closed session minutes may be withheld from public
inspection “so long as public inspection would frustrate the purpose” of the
session.

To the extent not provided for in, and not conflicting with the spirit of, these rules,
the chair shall refer to Robert’s Rules of Order to resolve procedural questions.
Comment: RRO was designed to govern a large legislative assembly,
and many of its provisions may be inappropriate for small boards.
Nevertheless, it is the best source of parliamentary procedure; care should
simply be taken to adjust RRO to meet the needs of small governing
boards.
