Note: All Items on the Agenda are for Discussion and Action as deemed appropriate by the Board. 2 AGENDA ABSTRACT Meeting Date: October 15, 2012 Agenda Title: Person County Government Safety Award Summary of Information: The Person County Safety Committee implemented a new safety recognition program in July 2012. Each quarter, the Person County Safety Committee will select a county department safety winner. This is a competitive award based on established criteria including: attendance at county trainings, reporting accidents in a timely manner, submitting accident investigation forms, reporting hazards, performance on facility inspections, and emergency procedures testing and other outstanding safety acts. The department will be presented a certificate and plaque with their department’s name listed. The plaque will be located in the hallway outside the Commissioners’ Meeting Room. A newsletter article will be in the county newsletter and submitted to the local paper to highlight the outstanding measures of the county department. This award will be presented quarterly and this is the first recipient to achieve this honor. Recommended Action: Allow the County Manager to recognize the county department that has earned the first Person County Government Safety Award. Blalock The Board of Commissioners for the County of Person, North Carolina, met in special session on Tuesday, September 25, 2012 at 6:00 p.m. in the Roxboro Police Department Training Room for the purpose of joint session with the Roxboro City Council. Person County Attendees: Chairman Clayton, Commissioners Jeffers, Blalock and Kennington County Manager, Heidi York Clerk to the Board, Brenda Reaves Assistant County Manager, Sybil Tate City of Roxboro Attendees: Mayor Merilyn Newell, Mayor Pro-Tem William Davis, Council Members: Henry Daniel, Sandy Stigall, Mark Phillips, and Byrd Blackwell City Manager, Stephen Steese City Clerk, Trevie Adams Assistant City Manager, Tommy Warren Chairman Clayton called the meeting to order. Vice Chairman Puryear was absent. DISCUSSION/ADJUSTMENT/APPROVAL OF AGENDA: A motion was made by Commissioner Jeffers, seconded by Commissioner Blalock and carried 4-0 to approve the agenda. Mayor Newell recognized Representative Winkie Wilkins in the audience. Representative Wilkins introduced Michael Woodard, current City of Durham Councilman and a Senate candidate that would represent Person County. 4 September 25, 2012 2 ECONOMIC DEVELOPMENT: Economic Development Partnership Agreement between the City and the County: City Manager, Stephen Steese presented to the Board of Commissioners and City Council an Economic Development Partnership between the City and the County for a joint economic venture for 1) the county to hire an Economic Development Director to which the City of Roxboro will appropriate $20,000 funding, and 2) the city to hire an Uptown Development Director to which Person County will appropriate $20,000 funding. The overlapping purpose is the partnership and coordination for economic development by and between the two positions. Mr. Steese noted the Uptown Development Director would be housed at City Hall and serving as the Roxboro Development Group (RDG) Director and the Main Street Director. The RDG Board would set the guidelines and objectives for the Uptown Development Director as well as participate in the evaluation process with the City and County Managers. Mr. Wayne Ross, RDG Board Chair told the group the RDG Board is in full support of the agreement which will enable RDG to have a full time Director. A motion was made by Commissioner Jeffers, seconded by Commissioner Kennington, and carried 4-0 to approve the Economic Partnership Agreement between Person County and the City of Roxboro as presented. City Council took action to approve the Economic Partnership Agreement between Person County and the City of Roxboro as presented by unanimous vote. 5 September 25, 2012 3 6 September 25, 2012 4 7 September 25, 2012 5 8 September 25, 2012 6 Update on the Potential Joint Business Park between Person and Durham Counties: County Manager, Heidi York shared with City Council a report given to the Board of Commissioners at its last meeting noting a Feasibility Study for a Person-Durham Multi- Jurisdictional Business Park Development was completed by Sanford Holshouser. Ms. York stated the study analyzed if a joint business park would be viable looking at current business parks and infrastructure with the outcome being very positive for a shared park as well as improved tier status. Ms. York noted the next step in the process would be the site assessment study noting the Board of Commissioners of both Durham and Person counties both agreed to move forward. Ms. York told the group the Board of Commissioners will meet jointly with Durham County following the site assessment study for further evaluation of the specific site. Chairman Clayton noted his support of a potential joint business park with Durham County noting coordination with the City Roxboro will play a major role for the supply of water. COORDINATION OF SERVICES: Planning/Zoning/Permitting/Inspections One Stop Shop: County Manager, Heidi York updated the group on the ongoing commitment to creating a more customer friendly one stop shop by combining the functions of Planning, Permitting and Inspections. Ms. York noted the new City Planner, Aaron Holland, currently works with the county staff in the same location. Ms. York further noted the three phases of the process: 1) the co-location of staff, 2) consideration for a joint city/county department, and 3) move forward with a Unified Development Ordinance (UDO). Ms. York presented a proposed City/County Development Services Department Org Chart creating a Development Services Department for the city and county. The City and County Managers propose a Development Services Director position that would coordinate all branches of the permitting offices and become a public liaison providing an utmost customer service experience. The Development Services Director position would be jointly funded by the city and county. City Manager, Stephen Steese stated $10,000 has been appropriated in the City budget for contracted services with the county for this future planning purpose. Assistant County Manager, Sybil Tate explained the existing system directed citizens from one point to another while the proposed system would allow for technicians/admin positions to become experts for the process and resources thereby assisting in all requests for all permitting processes. Ms. Tate stated a pre-application meeting can be offered scheduling all permitting applicable staff in an effort to make the process for major projects an opportunity for a seamless permitting process as well as to provide feedback. Ms. Tate pointed out the Development Services Director job description placed emphasis on customer service and coordination of service. Mr. Steese added the task of creating a joint UDO is a huge task and the Development Services Director would coordinate and oversee the implementation of the UDO process. 9 September 25, 2012 7 Ms. York confirmed the county has taken on the Minimum Housing responsibilities for the city with shared costs. Commissioner Jeffers stated concerns related to the addition of the Development Services Director position. Ms. York stated the role of the position would be coordination of the processes to proceed to a UDO for both the city and county noting the current workload for current staff would not allow the process to begin the implementation of the UDO. Mayor Newell noted the job description did not include enforcement. Councilman Phillips suggested discussing the concept as presented to both governing bodies to the Home Builders Association for feedback. Sam Hobgood, Inspections Director commented he recently met with the Home Builders Association to address the permitting process and the feedback was very positive related to the co-location of staff to one building. Commissioner Kennington suggested the meeting times as presented not be firm with more flexibility to accommodate schedules. UPDATE ON THE PROPOSED RECREATION & SENIOR CENTER: County Manager, Heidi York stated the Board of Commissioners at its last meeting was presented the finalized feasibility study on the proposed Recreation and Senior Center along with operating costs. Ms. York highlighted the overall floor plan that was placed at each seat noting the Board of Commissioners approved with a 3/2 vote to proceed to the next phase which includes the design and engineering for the project. The finalized project added space to the senior center area, added a splash/therapy pool in addition to the six-lane swimming pool and an enclosed walking track. Ms. York noted future phases may include an additional gym as well as an athletic field complex located on county owned property at the Critcher-Wilkerson site. Ms. York stated the estimated construction costs for the project is $4.2 million. Arts, Parks & Recreation Director, John Hill noted the configuration could change in the engineering process with further public meetings. Mr. Hill addressed questions and concerns from the Mayor and City Council related to the planning, logistics and security of the proposed facility on the Huck Sansbury site reassuring that program needs, safety and public input have guided the feasibility study. Mr. Hill stated the senior center dedicated space/square footage is comparable to their existing space with additional usable space available through the recreational areas noting all space would be totally accessible. Assistant County Manager, Sybil Tate projected $232,000 net of additional funding would be required for operating costs for the proposed facility noting the estimation was based on conservative planning using $30 per month for 200 memberships. Mr. Hill concluded by noting the benefits to Person County and the City of Roxboro for healthier opportunities for its citizens related to the proposed Recreation & Senior Center as well as the economic development draw. 10 September 25, 2012 8 CLOSED SESSION: A motion was made by Commissioner Jeffers, seconded by Commissioner Blalock, and carried 4-0 to enter Closed Session jointly with City Council pursuant to NC General Statute 143.318.11(a)(4) to discuss matters relating to the location or expansion of industries or other businesses in the county at 7:16 pm with the following individuals permitted to attend: County Manager, Heidi York, Assistant County Manager, Sybil Tate, Economic Development Director, Stuart Gilbert and Clerk to the Board, Brenda Reaves Roxboro City Council Closed Session attendees: Mayor Merilyn Newell, Mayor Pro-Tem William Davis, Council Members: Henry Daniel, Sandy Stigall, Mark Phillips, and Byrd Blackwell City Manager, Stephen Steese City Clerk, Trevie Adams Assistant City Manager, Tommy Warren Both governing bodies agreed to allow Wayne Ross, a member of the Economic Development Board to be included in the Closed Session. Blalock The Board of Commissioners for the County of Person, North Carolina, met in regular session on Monday, October 1, 2012 at 7:00 p.m. in the Commissioners’ meeting room in the Person County Office Building. Chairman Clayton called the meeting to order, led invocation and asked Commissioner Kennington to lead the Pledge of Allegiance. DISCUSSION/ADJUSTMENT/APPROVAL OF AGENDA: A motion was made by Commissioner Blalock, seconded by Commissioner Kennington and carried 3-2 to add an item to the agenda for action related to Patrick Riley’s request for a motion for his tax cases to be reheard by the Property Tax Commission and to approve the agenda as adjusted. Vice Chairman Puryear and Commissioner Jeffers cast the dissenting votes. PUBLIC HEARING: SCHEDULE OF VALUES: A motion was made by Commissioner Jeffers, seconded by Vice Chairman Puryear, and carried 5-0 to open the duly advertised Public Hearing for the Schedule of Values. Tax Administrator, Russell Jones stated the scheduled public hearing for the Schedules of Values for the 2013 Revaluation is to receive taxpayer feedback on the proposed Schedule of Values that was made available at the Board’s last meeting on October 1, 2012. The Schedule of Values was also made available at the Tax Office as well as posted on the web site. Mr. Jones stated the Schedule of Values will be placed on the Board’s October 15, 2012 meeting agenda for consideration for approval. Mr. Jones introduced Property Revaluation Manager, Phillip Christy to explain the Schedule of Values to the group. Mr. Christy told the group the revaluation process is over 90% complete with a review of 3,700 sales over the last four years with 1,000 of those noted as good, qualified sale. Mr. Christy stated Marshall & Swift, a revaluation company, assisted Person County for the manual information. 12 October 1, 2012 2 Mr. Christy noted land values have risen more than other values with house values being flat the last four years. Mr. Christy indicated to the Board a fairly flat revaluation. Mr. Christy stated taxpayers will receive a new notice of value along with an appeal form. The goal is for all property to be at 100% fair market value. Commissioner Kennington asked Mr. Christy to explain a good, qualified sale. Mr. Christy explained a good, qualified sale is a sale between two parties that are not related, no undue influence, arms-length transaction, not a foreclosure, and not a family sale. There were no individuals appearing before the Board to speak in favor or in opposition to the Schedule of Values. A motion was made by Commissioner Blalock, seconded by Commissioner Jeffers, and carried 5-0 to close the Public Hearing for the Schedule of Values. INFORMAL COMMENTS: The following individuals appeared before the Board to make informal comments: Mr. Barry Walker of 1575 Charlie Tapp Road, Roxboro, and Chairman of the Planning Board, requested Board consideration to allow Derrick Smith, a newly hired county employee, to continue as a member on the Planning Board. Ms. Faye Boyd of 69 Foxwood Drive, Timberlake stated support of the Recycling Ordinance on the agenda for consideration for compliance with the state’s goals to achieve 40% reduction in solid waste. Mr. Ken Hill of 916 Mann Oakley Road, Rougemont and Chairman of the Solid Waste Advisory Committee voiced support for the Board to enact the Person County Recycling Ordinance regulating recycling materials. Mr. Hill noted the state of NC issued General Statutes 130A-309.4 and 138-309.9 which call for local governments to find alternatives other than disposal of solid waste in the landfills with the hierarchy of the methods starting with waste reduction, recycling and reuse, composting with the last option being disposal into landfills. Mr. Hill stated the Board’s adoption of the proposed Recycling Ordinance would support the mandate dictated by the state. Mr. Hill informed the group that the City of Roxboro has a Recycling Ordinance, under General Statutes 50.25 Articles I and J to which Mr. Hill read an excerpt noting the passage date of June 11, 1974. APPROVAL OF MINUTES: A motion was made by Commissioner Jeffers, seconded by Vice Chairman Puryear, and carried 5-0 to approve the minutes of September 17, 2012. 13 October 1, 2012 3 TAX ADMINISTRATIVE REPORT: A motion was made by Commissioner Jeffers, seconded by Commissioner Blalock, and carried 5-0 to approve the Tax Administrative Report noting the Releases for the month of August, 2012. OLD BUSINESS: REVIEW OF SECTION 101, NONCONFORMING USES AND SECTION 60, GENERAL REGULATIONS, ACCESSORY STRUCTURES IN THE ZONING ORDINANCE: Chairman of the Planning Board, Barry Walker stated the Board of County Commissioners asked the Planning Board to review the nonconforming and accessory use sections of the Zoning Ordinance. Mr. Walker stated the Planning Board discussed these issues in three separate meetings and presented the Board with proposed amendments and changes as outlined below: Planning Board Recommended Changes to the Non-conforming Use and Accessory Structure sections of the zoning ordinance Text in italics are proposed changes. Text in bold are additions to the ordinance. Nonconformities exist; completed land uses, structures, or lots that were legal when established but are inconsistent with subsequently adopted or amended land use regulations. A use that is initiated in violation of a zoning ordinance does not enjoy nonconforming status. NONCONFORMING USES New Definitions to Consider: The Ordinance needs to define the following: Nonconforming Building – A building or structure that is not in conformance with the provisions(Section 75-Table of Dimensional Requirements) of the district in which it is located. Nonconforming Lot – Surveyed and recorded lots that met existing zoning regulations when created but no longer conform with the adopted regulations. Nonconforming Use – A lawful use of land that does not comply with the use regulations for its zoning district but which complied with applicable regulations before adoption of this Ordinance or the predecessor Person County Zoning Ordinance. 14 October 1, 2012 4 101-1 Nonconforming uses may not be changed to another nonconforming use unless the Board of Adjustment determines that such change shall be no more detrimental to the neighborhood than the existing use; however, no change of title or possession, or right to possession of property shall be construed to prevent the continuance of a nonconforming use. 101-2 No building may be extended or enlarged or the amount of land devoted to a use increased unless such extensions or enlargements comply with all the provisions of this ordinance. Proposed 101-2 Any structure existing at the time of adoption of this Ordinance which does not comply with setback or yard requirements, or which exceeds height requirements, may be continued in use but shall not be enlarged or extended unless such extensions or enlargements comply with all the provisions of this ordinance. No unenclosed portion of a building may be enclosed if the setback or height requirements are not met. 101-3 Nothing in this ordinance shall be construed to prevent the reconstruction of any building, conforming or nonconforming, damaged by any means. However, any nonconforming building which is damaged may only be replaced by a structure of equal or smaller size and square footage as that of the previous structure. No reconstruction or new construction shall be allowed which creates any new or additional nonconformity than that which existed at the time of damage. 101-4 If a nonconforming use is discontinued for a period of 180 days or for more than eighteen months in any three year period, the future use of the building or land must be a conforming use. Proposed 101-4 If any such nonconforming use of land and/or structure ceases for a period of more than one year (except when government action impedes access to the premises), any subsequent use of such land and/or structure shall conform to the regulations specified by this ordinance for the district in which such land is located. Vacancy and/or nonuse of the land or structure, regardless of the intent of the owner or tenant, constitutes discontinuance under this Section. 101-5 A nonconforming use may be changed to a use of higher classification and whenever the use is changed to a higher or conforming classification then it shall not be allowed to change to the original use or to a lower use. For the purposes of this section, the order of classification of use, form the highest to the lowest shall be as follows: R, B-1, B-2, GI and RC. 15 October 1, 2012 5 101-6 If a nonconforming structure or a conforming structure devoted to a nonconforming activity is destroyed or damaged in any manner, to the extent that the cost of restoration to its condition before the occurrence shall not exceed 60 percent of the cost of reconstructing the entire structure based on the assessed structure value, as recorded by the County Tax Assessor, it may be repaired or restored, provided such repair or restoration is started within six months of the damage and completed within twelve months. However, any nonconforming building which is damaged may only be replaced by a structure of equal or smaller size and square footage as that of the previous structure. Relief to the time limits may be granted by the Board of Adjustment. 101-7 A nonconforming structure or a conforming structure devoted to a nonconforming activity that is damaged by any casualty to an extent more than 60 percent of its assessed value, based on County Tax Assessor records, shall not be restored except as follows: a. As a conforming use. b. If the use is a one-family dwelling, restoration shall be permitted, provided such restoration is begun within six months of the casualty and completed within 24 months of the casualty. c. For structures except a one family dwelling, restoration of a nonconforming structure shall require approval by the Board of Adjustment. A site plan according to Section 80 will be required. In approving such permit, the Board will consider the stated purpose for establishing the zoning district in which the structure is located, the uses in the area immediately surrounding the structure in question, particularly the other nonconforming uses, and the hardship which would result from a denial of the Conditional Use Permit. The permit shall include conditions as to time for repair to be completed and any other conditions deemed necessary to carry out the intent of this section of the ordinance. 101-8 A nonconforming use may be extended or enlarged with a Special Use Permit provided that the addition is no more than fifty percent of the original structure and a landscape buffer is provided to buffer the new portion from adjacent land owners and all setbacks, height, and area requirements of the Planning Ordinance are met. Single family dwellings are exempt from Section 101-6. (The Planning Board proposes to delete this section from the ordinance) New Sections to be considered: 101-9 Nonconforming lots of record: Permitted Structures may be erected upon any single lot of record at the time of adoption of this Ordinance, provided the minimum yard requirements are met. A variance to the zoning ordinance is required if the yard width or setback requirements can not be met. 16 October 1, 2012 6 101-10 The creation of a lot with a width or area smaller than allowed by existing zoning requirements is prohibited, except by governmental action, such as a road widening. Any lot, which, by reason of realignment of a public street or highway or by reason of condemnation proceedings, has been reduced in size to an area less than that required by law, shall be considered a nonconforming lot of record subject to the provisions set forth in this section; and any lawful use or structure existing at the time of such highway realignment or condemnation proceedings which would thereafter no longer be permitted under the terms of this ordinance shall be considered a nonconforming use or structure as that term is used in this ordinance. 101-11 When any nonconforming use is superseded by a permitted use, the use shall thereafter conform to the regulations for this district, and no nonconforming use shall thereafter be resumed. The Planning Board decided to keep these sections, making no changes: 102-1 Nothing in this ordinance shall prevent the restoring or strengthening of a nonconforming structure to a safe condition, provided that the square feet of the structure shall not be increased. 102-2 Should any nonconforming structure be moved for any reason within the Zoning Jurisdiction of Person County, it shall conform to the regulations for the district in which it is to be located. The following section will be deleted. The proposed Section 101-9 is the same as this. 103-1 In any district, notwithstanding the dimensional requirements for the district in regards to lot width and minimum area, buildings, may be erected on any legally created lot of record existing at the effective date of adoption to this ordinance. Accessory Structures An accessory building - An accessory building, structure or use is a building or structure or use on the same lot or site with, of a nature customarily incidental or subordinate to, and of a character related to the principal use or structure. Accessory buildings are but not limited to sheds, garages, lean to, storage buildings, carports, pool, but not to include well houses (not to exceed 6’ x 6’), and gazebo or pool house if attached to footprint of pool. Pools - Pools are considered accessory uses if they are above ground or in ground attached by either a deck or solid material such as brick, stone, concrete, etc. attached to the principal structure. 17 October 1, 2012 7 60-5 Unless otherwise specified in this ordinance, accessory buildings may be allowed within five feet of rear and side yard lot lines provided they are five feet or more from the main structure. Proposed 60-5 Accessory structures shall be located at least five feet from any principal structure and side and rear property lines. 60-6 Unless otherwise specified in this ordinance, every principal building hereafter erected or moved shall be located on a separate lot and in no case shall there be more than one principal building and three permitted accessory buildings on all lots under three acres. There shall be allowed one additional accessory building for every acre over three acres. Industrial operations located in the GI district shall be exempted from this provision. 60-6A - Accessory structures shall be placed in the rear or side yard and not the front yard of all lots under ten acres. Parcels of property containing ten acres or larger may place an accessory building in the front yard provided such building is located at least 50 feet from any street right of way line and a minimum of twenty five feet from any side property line. 60-6B -Accessory buildings shall only be allowed on a lot upon which a primary dwelling, multifamily dwelling, business use or industrial use exists. Planning Director, Paula Murphy stated the Planning Board’s recommendations were based on standard zoning ordinance regulations with safety being an issue in the decisions. Ms. Murphy told the group that if the Board of County Commissioners wishes to act on any zoning ordinance changes, the procedures are to refer changes back to the Planning Board for a Public Hearing for citizen input. The Planning Board Public Hearing could be held on November 8, 2012. County Manager, Heidi York asked Ms. Murphy for clarification on grand- fathering related to the ordinance. Ms. Murphy stated if something existed prior to the 1991 Zoning Ordinance adoption date, then it is considered grandfathered. Ms. Murphy noted there are many buildings constructed without permits. Vice Chairman Puryear requested to eliminate Section 60-6A to ease the regulations so that people are not out of compliance. Ms. Murphy noted the drain field in the front yard is the key issue. Commissioners Blalock and Jeffers noted education of the rules to the citizens and sellers. Ms. York suggested preparing a flyer for businesses as well as posting the requirements on the county web site. 18 October 1, 2012 8 It was the consensus of the Board for Mr. Walker to take the feedback given by the Board back to the Planning Board for further discussion as well as the Planning Board to hold a public hearing. NEW BUSINESS: RECYCLING ORDINANCE: Commissioner Blalock stated she had worked with staff to prepare a recycling ordinance for Person County noting the 3-year update to the Solid Waste Plan is currently being reviewed to which a recycling ordinance is one of the goals. Commissioner Blalock stated the state waste reduction goal by 2012 is 40% and suggested making the county’s 10-year goal to match the state waste reduction goal of 40% noting Person County is currently recycling approximately 4% of its waste. Commissioner Blalock illustrated if Person County reduced its waste by 40% that revenues would approximate $1.8 million and advocated the recycling ordinance to achieve the state goals and generate revenue for the county. Commissioner Blalock recommended the Board to schedule a public hearing on November 5, 2012 which is the same date the Solid Waste Plan would be presented and hold a public hearing. Commissioner Blalock noted the purpose is to educate the citizens. Vice Chairman Puryear stated concerns with Section 9 – Enforcement noting he could not support imposing such on the entire population of the county. Vice Chairman Puryear noted costs are a factor for a recycling container and/or disposal service for citizens. Vice Chairman Puryear noted his opposition to the recycling ordinance. Chairman Clayton suggested having the recycling ordinance sent to the Solid Waste Advisory Committee for review and input. Commissioner Jeffers asked the County Attorney, Ron Aycock the process by which fines can be issued for non-compliance. Mr. Aycock stated that an administrative official can not assess a penalty, but by a criminal sanction through the Magistrate for a judicial process. Mr. Aycock stated he would confirm the statute that sets out authority for an administrative official to start the process. Commissioner Jeffers noted his opposition to proceeding with a recycling ordinance without knowing the financial impact to the county and the citizens. County Manager, Heidi York stated the ordinance allows for enforcement, though no staff has been dedicated to enforce the ordinance noting staff resources have not been explored at this time. 19 October 1, 2012 9 Commissioner Kennington stated support of proceeding further with the ordinance noting he also had concerns with the enforcement provision. Commissioner Kennington recommended input from the Solid Waste Advisory Committee prior to a public hearing as well as joint agreement with the City of Roxboro. Mr. Aycock spoke to the impact this proposed recycling ordinance would have on city residents noting general law is that a county ordinance is applicable outside city limits unless the city authorizes enforcement within city limits. A motion was made by Vice Chairman Puryear, seconded by Commissioner Jeffers, to not approve the Recycling Ordinance. A substitute motion was made by Commissioner Kennington, seconded by Commissioner Blalock, and carried 3-2 to submit to the Solid Waste Advisory Committee to study Person County’s recycling and bring back to the Board recommendations on ways to increase recycling to meet the projected state mandate. Vice Chairman Puryear and Commissioner Jeffers voted in opposition to the substitute motion. MEMORANDUM OF AGREEMENT FOR ORANGE PERSON CHATHAM MENTAL HEALTH AUTHORITY RELATED TO THE MERGER WITH PIEDMONT BEHAVIORAL HEALTH TO COVER EXCLUDED LIABILITIES: County Manager, Heidi York presented a Memorandum of Agreement formalizing the transition from Orange, Person and Chatham Mental Health, Developmental Disabilities, and Substance Abuse Authority (OPC) to Piedmont Behavioral Health (PBH). Ms. York stated the transition included some excluded liabilities which are listed in Exhibit A of the Memorandum of Agreement. Ms. York noted PBH took the position that they would not accept responsibility for those records, so staff began to review options, which included and led to the possibility that Orange County Government would assist in the management of the excluded liabilities. The Memorandum of Agreement sets for a transfer of funds, $500,000, from the OPC fund balance to Orange County Government for managing the liabilities, with any balance left over upon the completion of all transitions related to the excluded liabilities reverting to Orange County. Ms. York confirmed there would be no costs to Person County. Ms. York requested the Board to review the Memorandum of Agreement and authorize the Chair to execute noting the agreement requires approval by all three member counties. A motion was made by Commissioner Jeffers, seconded by Vice Chairman Puryear, and carried 5-0 to approve the Memorandum of Agreement authorizing the Chairman to execute. 20 October 1, 2012 10 21 October 1, 2012 11 22 October 1, 2012 12 23 October 1, 2012 13 24 October 1, 2012 14 25 PERSON COUNTY RECREATION AND SENIOR CENTER AND CRITCHER- WILKERSON FIELD CAPITAL PROJECT ORDINANCE: Finance Director, Amy Wehrenberg presented the Board for approval a Capital Project Ordinance for the engineering, design, construction and renovation of a Recreation and Senior Center, as well as design costs associated with the construction of recreational fields on County-owned property ("Critcher-Wilkerson Field"). Per consensus of the Board of Commissioners in the meeting on September 17, 2012, direction was given to move forward with the design phase covering the base plan of the Recreation and Senior Center, the Splash and Therapy Pools, and enclosing the walking track. Also, the Board directed staff that the additional gym (with HVAC) and the Critcher-Wilkerson Field be included in the design plan for purposes of determining the construction costs, which will allow the Board to determine if these add-ons could be included in the final project. Ms. Wehrenberg stated the Board funded capital expenditures of $4.2 million on September 17, 2012. Ms. Wehrenberg stated the approval of this Ordinance allows for the creation of this Project on the County's books in anticipation of preliminary expenses associated with the design phase of the Project in order for the County Manager to execute a contract with the engineering firm responsible for the design phase which is required by law. It is expected that these costs will require adjustments as the final scope of the Project is determined. Ms. Wehrenberg requested the Board to approve the “Person County Recreation and Senior Center and Critcher-Wilkerson Field Project - Capital Project Ordinance” Ms. Wehrenberg confirmed the Board has the authority to stop the project from proceeding at most any time pointing out the county would be at a loss for any amount that is appropriated from Fund Balance noting the intent would be for the county to reimburse the General Fund from the financing for the project. A motion was made by Commissioner Jeffers, seconded by Chairman Clayton, and carried 3-2 to approve the Capital Project Ordinance as presented for the Recreation and Senior Center and Critcher-Wilkerson Project. Ms. Wehrenberg stated the Resolution is set forth by sections in the following: Preamble: The County plans to expend funds for certain improvements involving the creation of a Recreation and Senior Center and potential improvements to the Critcher-Wilkerson property. 1. States the Board's intention to advance funds as necessary from County funds no earlier than August 2, 2012 for these expenditures until installment financing proceeds become available for reimbursement 2. Lists the types of costs that are eligible under the Project, including issuance costs and provisions for these expenditures to be capital-related and non-recurring 3. Establishes the maximum principal expected to be borrowed 4. Describes the process of how the County requests a reimbursement from the proceeds, and the time parameters in which the expenditures can be reimbursed. Commissioner Blalock stated Mr. Riley told her that the judgment was prejudiced because of errors rendered in the Final Decision: 1. Dates were incorrect. 2. Two programs were lumped together as if they were the same. 3. The appellant appealed to the county board the tax assessor’s decision to deny agriculture was in 2010. 4. The decision to deny horticulture was for tax year 2011. Commissioner Blalock stated if the motion passes then Mr. Aycock will file the motion with the Property Tax Commission. County Attorney, Ron Aycock concluded the following facts: 1. Mr. Riley had a full opportunity to participate in the appeal at the Property Tax Commission. The Property Tax Commission accepted Person County’s argument that, in fact, Mr. Riley had not made a case for tax exemption. The allegations provided by Mr. Riley to Commissioner Blalock were, in fact, considered by the Property Tax Commission, and rejected. 2. Mr. Riley properly and timely filed a hand-written Notice of Appeal to the Property Tax Commission but notice was not sufficient to perfect his appeal to the Court of Appeals. Mr. Riley was required to file other documents according to the procedures and policies of the Court of Appeals to which he failed to do so in a timely manner. Mr. Aycock stated, in his opinion, Mr. Riley was foreclosed from further appeal because of failure to file additional documents with the Court of Appeals in a timely basis. Mr. Aycock noted that time has expired for Mr. Riley. Mr. Aycock noted it would be inappropriate for the Board of Commissioners to in effect request its attorney to change position and argue against what was argued at the Property Tax Commission. Mr. Aycock concluded the issue is moot and/or inappropriate. Commissioner Blalock asked Mr. Aycock if it was inappropriate for the Board to make a motion. Mr. Aycock stated he would never tell the Board that they could not make a motion but a passed motion would be ineffective because the time for filing the proper documents in the Court of Appeals has expired without extraordinary legal expense and procedures. 35 October 1, 2012 25 A motion was made by Commissioner Blalock that died for a lack of second for the cases Mr. Riley filed with the Property Tax Commission to be reheard based on the Right to Appeal in Article 24 Review and Enforcement of Orders 105-345c based on the exceptions outlined above. The Person County Board of Commissioners directed staff to investigate Rockingham County’s efforts to use the new granting authority and continue to investigate broadband opportunities. Rockingham County has been in discussions with CenturyLink to provide matching funds to a Federal grant that CenturyLink received. If Rockingham County moves forward with this proposal, the Federal grant and the County grant could cover all of the capital costs for providing highspeed internet to unserved areas of Rockingham County. Staff has identified three providers that may be able to provide highspeed internet to unserved areas of Person County – CenturyLink, ESINC and Charter. Staff will speak to all of these potential providers to ensure that there is interest in the RFP. Before the RFP is released, the state recommends that the county conduct a month-long, county- wide survey to gather greater details on unserved areas of the county. Staff would like to take this opportunity to gather data on overall broadband service in Person County and has included questions for those who have internet service, those who feel that they have inadequate service and those who do not have service. Submitted By: Janet Clayton, Health Director John Hill, Recreation, Arts and Parks Director 62 PERSON COUNTY NON‐SMOKING ORDINANCE    ORDINANCE BANNING SMOKING IN COUNTY FACILITIES AND   ON COUNTY PROPERTY      WHEREAS, on February 25, 2008,  the Person County Board of Health adopted a rule pursuant to then  existing state law banning smoking in certain locations on County and City of Roxboro Property in  Person County;           WHEREAS, on May 19, 2009, the State of North Carolina passed "An Act To Prohibit Smoking In Certain  Public Places And Certain Places Of Employment" amending Chapter 130A of the General  Statutes and thereby authorizing local governments to adopt and enforce ordinances "that are  more restrictive than State law and that apply in local government buildings, on local  government grounds, in local vehicles, or in public places;"    WHEREAS, within said legislation the General Assembly finds "that secondhand smoke has been proven to  cause cancer, heart disease, and asthma attacks in both smokers and nonsmokers. In 2006, a  report issued by the United States Surgeon General stated that the scientific evidence indicates  that there is no risk‐free level of exposure to secondhand smoke;"    WHEREAS, the Person County Board of Health has reviewed this legislation and at its meeting on February  27, 2012 took action requesting that the Person County Board of Commissioners enact an  ordinance further regulating tobacco use in the County;    WHEREAS,      the Person County Recreation Advisory Board has considered the effect of second hand smoke  on participants and spectators at recreation programs and facilities and took action at its board  meeting on March 7, 2012 requesting that the Person County Board of County Commissioners  ban smoking at Recreation events and on certain Recreation and Park Lands.    WHEREAS,   smoking is prohibited in certain county buildings and on certain other county property pursuant  to Health Department Rules and other County Regulations.    WHEREAS, Person County recognizes the health risks of tobacco use and secondhand smoke for non‐ smokers and wishes to minimize the harmful effects of tobacco use among staff and eliminate  secondhand smoke exposure for staff and the public in those facilities and grounds controlled by  Person County. Further Person County is committed to providing a safe and healthy workplace in  County facilities for its employees and the visiting public;    WHEREAS, this Board is of the opinion that it is in the best interests of the citizens and  residents of the County to further prohibiting smoking in certain County  buildings and on certain County grounds.    NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners for the County of Person as  follows:     Section 1 ‐ Authority and definitions    Page 1 of 3 (b)  Definitions.  The following definitions apply:  (1)   "Grounds" ‐ An unenclosed area owned, leased, or occupied by Person County.   (2)   "Person County government building" ‐ A building owned, leased as lessor, or the  area leased as lessee and occupied by Person County.    (3)   "Person County vehicle" ‐ A passenger‐carrying vehicle owned, leased, or  otherwise controlled by Person County and assigned permanently or temporarily  by Person County to Person County employees, agencies, institutions, or facilities  for official Person County business.    (4)   "Smoking or smoke" ‐ The use or possession of a lighted cigarette, lighted cigar,  lighted pipe, or any other lighted tobacco product.     Section 2 ‐ Prohibitions, Notices, Exceptions and Enforcement     (a) Smoking prohibited.  No person shall smoke, carry or possess a lighted cigar, cigarette, pipe  or other lighted smoking equipment or paraphernalia in any Person County  buildings, on Person County grounds, or in Person County vehicles.      (b)   No smoking signs and instructions.  The individual or the individual's designee who is in  charge of Person County buildings, Person County grounds, or Person County  vehicles shall post signs in conspicuous areas of the building, vehicles and/or  grounds.  The signs shall state that "smoking is prohibited" and may include the  international "No Smoking" symbol, which consists of a pictorial representation  of a burning cigarette enclosed in a red circle with a red bar across it.  In  addition, the individual or the individual’s designee in charge of the building,  vehicle and/or grounds shall direct a person who is smoking inside the building,  or on the grounds, or in a vehicle, to extinguish the lighted smoking product.    (c)  Exceptions.  This ordinance does not restrict or prohibit smoking in the following places:     (a) The County Court House Grounds   (b) Recreation Camp Sites  (c) Bushy Fork Grange Grounds  (d) Piedmont Community College  buildings and grounds  (e) County parking lots  (f) Other designated areas which are at least 50 feet from any recreation,  health, and wellness amenity, clearly designated and marked and are  approved by the Person County Recreation Advisory Board. Long for the purchase of the house located at 245 N. Main Street, Roxboro. Known as the Woody House, it is one of the original homes in Roxboro built in 1921 by George W. Kane. The home has 14 rooms and 2/3 basement with approximately 4600 square feet of heated space. The terracotta roof is original and Mr. Woody has recently restored the interior. Mrs. Long is the wife of Curtis Eugene Long who was born and raised in Person County. Signage and a permanent exhibit will be displayed in the home in memory of her husband. The Museum acquired the home on August 28, 2012, and is recorded in the Person County Registry in Book 815, Page 236. This addition will augment and enhance the mission of the non-profit Person County Museum of History: To collect, preserve, and present the artifacts and history of Person County under the supervision of the Board of Directors and to use these collections for exhibitions, educational programs, and related activities for the benefit of Person County citizens and visitors The Museum is requesting the County add this house to the Agreement between the Museum and Person County Government that was signed in April 2012. This Memorandum of Agreement states that the County will be responsible for maintaining the exteriors, the structural integrity of all Museum buildings, for providing property and liability insurance, responsible for HVAC systems, sewer lines, and responsible for all utility costs. The estimated cost of utilities for the Woody House is $2,000 annually. Insurance is less than $1,000 and has already been assumed by the County. The County has recently spent $25,000 on HVAC repairs and painting for the museum. This request will be presented by Ms. Angie Brown and Ms. Claudia Berryhill representing the Museum. Recommended Action: Consider the request to add an additional property to the Memorandum of Agreement between the County and the Museum. That Report includes: 1) Summary of Deficiencies 2) Deficiency Remediation Plan 3) Remediation Cost Estimate The Report is included in the Board’s agenda packet. In summary, their findings include: 1) The structural condition of the building is good, but with fair to poor finishes and thermal envelope (insulation value). The building has no ADA accessibility. The roof will need to be replaced within the next 2 years. 2) Building systems (HVAC, plumbing, electrical) appear to be in good condition and in sound working order, but in desperate need of upgrades to meet modern day standards and required codes.  Replace old coal fired hot water heating system/add air conditioning system  Upgrade toilet facilities to current requirements  Upgrade lighting to current code  Add emergency exit and egress lighting  Upgrade overhead electrical service The Cafeteria Building was generally in better condition than the Classroom Building. The estimated cost of these upgrades is $2,598,548, which includes 30% for Overhead & Profit, and another 30% for contingency/allowances. This does not include the $1,046,068 in the CIP roof plan to replace the shingle roof with a metal roof in FY 2013-2014. The engineering firm recommended that the County also have an exterminator assess the condition of the crawl space under the main building. This was done and the under structure of the building was found to have significant infestations of termites and wood beetles. Although any termite and beetle activity creates damage to the wood, it did not appear that the damage had compromised the structural integrity of the building. Obviously, treatment for termites and beetles was recommended. The estimated cost to treat the entire building is $10,000 for termites and $5,000 for the beetles. Recommended Action: Receive the Report and discuss what action the Board would like to take to bring the Helena facility up to codes, but at the very least, we recommend the termite and beetle treatment to prevent further damage to the building structure, and that we continue to keep this facility in our roofing plan for FY14. elements. The scope of this study is to determine if it is feasible to utilize the building for any  future uses    PROJECT APPROACH    Data collected for this study was based on site measurements of the existing buildings as well as  visual observations. The observations were based on non‐invasive procedures. There was no NOTE: For more information refer to more detailed plan at the end of this report  84     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 7  EXISTING CONDITIONS    ARCHITECTURAL    SITE, GENERAL  The site is an 8‐acre property with seven buildings constructed in different times: four classroom  buildings, gym, concession building with restrooms and cafeteria. The site has a rolling  topography.  There is a playground, basketball court, lighted baseball field and ¼ mile paved  walking track north of the main classroom building. Gravel parking lot is located in front of the  main classroom building. Aluminum canopies connect main classroom building and cafeteria, as  well as student pick‐up/drop‐off area.  The site was originally served by septic system, which was later replaced with city sewer.    OVERVIEW OF BUILDINGS  Only main classroom building and cafeteria are part of this study.  Classroom building was built in 1940’s. It is approx. 24,700 sf building. It is a one story building  with crawl space and a partial basement. Exteriors are brick veneer and asphalt shingle roofing.  Cupola located above main roofs intersection and two ventilation dormers on the north slope of  the roof complete roof design. Structure consists of wood floors, wood studs, and sheathing  boards, ceiling joists, roof rafters and tongue and grove roof deck. Interior walls are plaster over  wood studs with sheathing boards. Acoustical ceiling panels attached to ceiling joists. Exterior  doors are wood with glazing in hollow metal frames with astragals added later. Wood stile and  rail doors with glazing and operable transoms in wood frame are typical for interior. Windows  were originally wood double hung, but panes had been replaced later with single glazed  aluminum. Hardwood flooring is throughout the building, except toilet rooms, where flooring is  ceramic tile and workroom/offices, where flooring is carpet. Concrete, brick and one wood stairs  lead from the building to the ground.   Cafeteria building was a later addition to the property. It was built in approx. 1979. The floor area  is approx. 4,900 sf. and there is a covered porch at the front door. It is, as well, a single story  brick building with asphalt shingle roofing and ventilation dormers. The structure is concrete slab  on grade, CMU walls with brick veneer, wood trusses and wood roof deck. Doors and frames are  hollow metal. Windows are aluminum, double hung. There are metal louvers in north, east and  south walls. Flooring is vinyl composition tile in dining area and bathrooms, and ceramic tile is in  the kitchen. There is a loading dock and a concrete stair at the south of the building.   85     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 8  LIFE SAFETY AND FIRE PROTECTION, GENERAL  There are no accessible exits from the classroom building. All egress doors are pair of 30” wide  doors. The only ramp that leads out from building at south‐east corner is not accessible due to 4”  step and non‐compliant steep slope. Panic hardware requires replacement. Exterior stairs do not  have enough space for wheelchair to be parked for assistance. Handrails are not per current  building code. There are no dead end corridors. Travel distances are within safe limits. There is  no sprinkler system. The smoke detection system is outdated. Boiler room has one exit.  Cafeteria building has one exit directly from dining area.   Exterior lighting condition was not able determine.    ADA COMPLIANCE, GENERAL  There is no ADA compliant parking provided at the property. Classroom building is not  wheelchair accessible from exterior due to the stairs, narrow doors and some thresholds  exceeding 1/2" height. Within the building there are some barriers, such as steps, but in general  the building is leveled and doorways are typically exceeding ADA requirements for width.  Plumbing fixtures do not comply with accessibility, toilet rooms require renovation.    HAZARDOUS MATERIALS, GENERAL  There are several asbestos warning signs posted throughout the classroom building. Assuming  the time of construction, asbestos will be most likely present in vinyl flooring tile and acoustical  ceiling tile. Although hazardous material content was no studied as part of this assessment, it is  probable to find lead paint in the building.        86     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 9  FACILITY ASSESSMENT    ARCHITECTURAL    SITE  Site surface drainage requires special attention. Currently, existing grade at south of the  classroom building is sloping toward the crawl space, causing water to penetrate the building  through foundation vents. Fine grading will be required to provide swale and route run off away  from the building.  Additional onsite stormwater treatment, such as retaining pond and bio‐filtration areas may be  required, depending on county standards. Stromwater management is not a part of the scope  and was not studied in detail. The requirements will need to be verified during renovation, based  on the building occupancy, parking capacity, etc.  Roof drain leaders are mainly broken. East and west roof edges of the classroom building do not  have continuous gutters at the perimeter. It is advised that gutters to be installed at all roof  edges and all roof drains replaced and connected to underground stormwater drain.  Exits are not connected to public way. All required exits will need to be provided with accessible  sidewalks. Some existing sidewalks require repair/ partial replacement due to inaccessible slopes.  There are no handicap spaces provided at parking lot. The number of required spaces will be  determined based on the future building occupancy. Those spaces will have to be paved, striped  and connected to the building via sidewalk. The signage will be necessary for identification.  There are trees and shrubs outgrowth around the classroom building. While some may remain  for decorative purpose, those close to the building, should be removed.  Canopy connecting classroom building and drop‐off area appears to be in fair condition. The  portion of the canopy attached to the building is severely damaged and needs to be replaced.  Remaining canopy may be repainted and used. The section from the classroom building to  cafeteria appears in the worse shape. There are several structural damages; the integral gutter‐ downspout system does not perform correctly causing concrete slab deterioration. It is advised  that this canopy is replaced or removed entirely.    LIFE SAFETY AND FIRE PROTECTION  Occupancy, building area and separations will have to be determined based on future building  occupancy. Location and size of exterior wall openings will have to be verified based on those  87     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 10  findings. There is an existing fire wall separating addition at north‐east of the building. The wall  may need to remain due to the allowable fire area.  Attics in both building required to be separated into 3,000 SF. smoke compartments.  Draftstopping partitions need to be installed in compliance with Building Code and ventilation of  concealed spaces shall be maintained.  There are no exits on grade from the classroom building and only one from cafeteria. All required  exits will have to be brought up to the current code: ramps with guard‐ and handrails need to be  constructed or area of rescue assistance will need to be provided should ramp construction  become infeasible.  Existing stairs in general are in dangerous condition and need to be rebuilt.  There is only one direct exit provided from assembly area in cafeteria building. The second exit is  through intervening space and not accessible.  It is required to provide the second accessible exit  from the building for safe emergency exiting.     ACCESSIBILITY  20% of the future project budget will have to be dedicated to ADA upgrades.  Handicap parking spaces are required as specified above.  The path of travel from parking to and from building exits is required to be paved, 5’ wide  sidewalk with slope less than 1:20. Handrails are required at steeper walking surfaces. Ramps at  building entrances have to have slope not steeper than 1:12 and have guard‐ and handrails  approved by code. If ramp construction is not feasible, area of rescue assistance is required to be  built at each inaccessible exit. The stair width in this case will require to be at least 48”.  Restrooms will have to be accessible with minimum one fixture of each type to be handicap type  and mounted at appropriate height.  Public telephones, if provided, will have to be on accessible route.  Accessible drinking fountains are required to be mounted at 34” to the bubbler and located so  that are not protruding into the required exit corridor width or handicap clearances.  Signage should be mounted at appropriate height and have braille code.     STRUCTURAL  Structurally, classroom building appears to be in good condition with some exceptions. Crawl  space was not accessible during the time of survey to verify foundation walls, wood joist and    88     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 11  subfloor condition. Mostly the floor appeared structurally sound, except Boys and Girls toilet  areas where floor is severely damaged and requires replacement.  Additionally, some sagging  was noted in front of janitor’s closet, due to the water damage and in a several classrooms.   Additional detailed subfloor exploration is required to determine structural stability of all the  floor elements.  Roof rafters, ceiling joist and deck boards in general appear to be in dry condition, except in a  few places where they were damaged due to the roof leakage. The damage is more severe at the  roof intersections, roof elevation changes and at the fire wall roof penetration due to the flashing  failure.  Although the walls were not core drilled to verify the structure, it is assumed that exterior  bearing walls are wood studs with board sheathing and plaster on the interior side and brick  veneer on exterior. Similarly, interior bearing walls are wood studs with wood board sheathing  and plaster. Brick veneer on classroom building has several cracks along the mortar joint and  through brick units. Most severe damage appears at the front entrance at quoins.  These cracks  need to be repaired to avoid future water damage to the building. Epoxy based filler seems to be  sufficient at this level of damage, but future monitoring is required. Several interior walls have  cracks as well, mainly at the locations where roof leaks occurred.  Cafeteria building appears to be good condition.     ARCHITECTURAL  It will be appropriate to classify the classroom building as Type II‐B construction. Architecturally,  the building appears to be in poor condition. Moisture level in the exterior walls is high. Interior  paint is flaking off the walls. Window glazing is broken in multiple locations. Restrooms are in  anti‐sanitary condition.  Building thermal envelope does not meet current energy code requirements. Unless the building  use remains as is – Education – the thermal envelope will need to be improved. Insulation needs  to be added to attic to meet R‐42 criteria. It is advised that all exterior walls will be insulated with  1 1/2” thick rigid insulation and furred out on the interior side with at least 3 1/2” studs and the  space filled with R‐13 insulation. That will meet R‐13 + R‐7.5ci insulation requirement. Additional  R‐38 insulation is required under floor. Foundation vents require to be replaced. While insulation  installation is an additional expense, the new HVAC system, if installed, will be more efficient if  the envelope leakage is eliminated.  Architectural exterior woodwork is in poor condition. It needs to be replaced entirely as wood is  decayed beyond repair. There are polymer based materials available on the modern market that  could be used as molded shapes trim board to replace woodwork.    89     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 12  Existing windows and doors are currently covered with plywood for security. All existing  aluminum windows have single glazing and will need to be replaced with insulating glazing.  Thermally broken aluminum units are recommended. Aluminum frames have longer life span and  better life cycle cost. The upfront expense for this replacement will be offset by future energy  savings. Exterior hollow metal doors and frames are rusted and need to be replaced. Similarly,  aluminum door and frames are highly recommended as they have a good insulation value,  durability and life span. New doors will have to comply with ADA requirement for door opening  width of 32” clear. Currently, all existing interior doors are wood – leaves and frames. All original  building doors are stile and rail type, with exception of later added doors that are flush hollow  core. If the historic look of the building is desired to be preserved these doors should remain in  the building. The paint will need to be stripped and the new coat of paint or stain should be  applied. Some door frames are broken at lock and will require repair or replacement. The  hardware throughout the building needs to be replaced with ADA approved levers. Exit doors  should have push bars. Thresholds should be not higher than 1/2".  Roofing will need to be replaced in the next two years. Several places require repairs  immediately, including flashing replacement, specifically where moisture continues penetrating  the roof.  Hardwood flooring surface is damaged, but boards, with a few exemptions, are in good shape. If  it is desired to keep the flooring, resurfacing and restraining will be required. Places where  structural repairs to the floor are necessary may require flooring replacement.  There is vinyl tile in the media center that most likely has asbestos and will need to be removed  or contained. Carpeting in the office/workroom areas is stained and requires removal.  As plaster on all interior walls is in a critical condition, furring strips and gypsum board should be  applied to the existing walls. Alternately, existing lead paint should be stripped, plaster repaired  and resurfaced, and painted over with lead‐free paint.   Front offices in the building have wood paneling installed later in time that may not comply with  the flame spread index required by Building Code. The panel flame spread index should be  confirmed to comply with the code or the panels have to be removed.  Acoustical ceiling is falling off, stained or damaged. It may remain in the building to support  ceiling insulation, provided that it does not contain asbestos and new suspended system is  installed below.  Cafeteria building appears to be II‐B construction as well. Building is in good condition. Most  likely, the building envelope does not meet current energy code criteria, but if the occupancy  type remains the same – Assembly – it may not require additional thermal treatment.  Finishes in cafeteria building are newer, but in a poor condition. Flooring needs to be replaced in  dining area and restrooms. Exterior doors are rusted and need to be replaced. It is advised to    90     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 13  install aluminum doors as they rust resistant. Aluminum windows, although in good shape, will  continue to contribute to heat loss/ gain in the building. It is advised to replace them with  thermally broken insulated units. Interior walls and doors need to be stripped of paint and  repainted. Ceiling requires replacement. While interior doors may remain, the hardware needs to  be replaced with ADA approved levers and push bars need to be installed on exit doors. Wood  wall paneling, similarly to the classroom building may have flame spread index not complying  with the code requirements and may need to be removed.  Aluminum cladding on the porch wood columns is extremely damaged and requires replacement.  Once cladding removed, wood column condition will have to be evaluated for structural stability.  As specified above, the second exit is required to be provided from the assembly area. It has to  be separated from the existing exit by at least half of the distance of the space diagonal. The exit  through the serving line is not acceptable, the door location and hardware are not code  compliant, and the exit is not accessible.  When the calculations for the new occupancy are performed for plumbing fixture count, it may  appear that there are not enough fixtures in the existing buildings. Additional restrooms may  need to be constructed.     91     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 14  BUILDING SYSTEMS    PLUMBING  The classroom building is served with both city water and city sewer. The observable plumbing  fixtures are old, stained and outdated, but functional; however, there are no fixtures that are in  compliance with current handicap accessibility requirements. The condition of the water and  waste piping could not be determined.  The cafeteria is served by both city water and city sewer. The plumbing fixtures are stained and  outdated and do not meet current accessibility requirements. Like the main building, the  condition of the water and waste piping itself could not be determined    MECHANICAL  The classroom is not provided with air conditioning, but only with heat. The heating system is  provided by a coal‐fired hot water boiler located in the lower level of the northwest wing. The  hot water is distributed throughout the building by piping, which is underneath in the  crawlspace, to radiators on the perimeter walls of each room. The condition of the boiler and  piping could not be determined as it has been idle for quite some time. The building in general  appeared to have little or no insulation provided to protect against the outdoor elements, with  the exception of some insulation above the ceiling tiles in the hallways.  The cafeteria building has both heating and air conditioning and is served by two 7.5‐ton split  system heat pumps which were installed in 1990. The heat pumps appeared to be in working  order. There is exhaust ventilation provided in the toilets which appeared to be in proper  operation, however, their compliance with current code requirements could not be verified.    ELECTRICAL  The classroom building is served with a 120/240 volt three‐phase system with multiple overhead  delivery points to service panels within the building, all from a single pole‐mounted utility  transformer. The main distribution panel, located in the northeast wing, has an 800 amp main  breaker and several branch circuit breakers which feed the panelboards located in the hallways.  An additional delivery serves the library area and the final delivery serves the boiler room.  Overall, the panels, wiring and devices appeared to be in good and fully operable condition. At  least one panel is an outdated fuse panel, with the remaining panels being circuit breaker type.  The presence of melted insulation on the overhead service conductors feeding the building  implies that the conductors are of insufficient size necessary for the electrical demands.   The lighting provided in the interior consists mostly of old T12 style fluorescent fixtures. The  classrooms have pendant mounted fluorescent fixtures and the hallways have grid mounted    92     HELENA SCHOOL: FACILITY ASSESSMENT 2012  MHAworks, Durham NC 15  recessed fluorescent fixtures. It was observed that the building lacked any emergency, exit and  egress lighting and a general fire alarm system.  The electrical system for the cafeteria building consists of a 208/120 volt three‐phase overhead  delivery to a 400amp panel located inside the building. Like the main building, the panel boards  and wiring of the cafeteria building appear to be in adequate condition.   The lighting in the cafeteria building, like that of the main building, consists of outdated T12  recessed fluorescent fixtures.    EQUIPMENT  The cafeteria building maintains a full‐service kitchen, with fully functioning cooking and cleaning  equipment. This equipment is appeared to be all‐electric. There is a complete and working  exhaust hood installed. There also appeared to be an adequate grease trap system located on ARCHITECTURAL  After evaluation of the building conditions, it is established that the classroom building is in good  structural condition but with poor finishes and thermal envelop. Cafeteria building is in good  structural condition and fair finishes and envelope.  That being said, it is possible to reuse both buildings, provided the life safety and accessibility  requirements are met, thermal envelope is improved to meet current code requirements and  finishes upgraded.  The buildings are most suitable to be used by business occupancy type with a single tenant, such  as higher education facility or business offices. Multiple tenants are not recommended as they  will require one hour fire separation between users and that will be additional expense.  Full site demolition and construction of new buildings is not recommended due to the property  location in the Falls Lake watershed jurisdiction: allowed impervious surface is limited.  Additionally, extensive storm water management will be required to be performed on the site.  Prices for similar projects for such improvements are over $1M for a 5‐acre property.  Preserving the historical building for reuse in the community will contribute to the reuse/recycle  program. If desired, it is possible to receive US Green Building Council LEED certification for  reused building.    BUILDING SYSTEMS  Having researched and evaluated the existing conditions of the school (the HVAC, plumbing, and  electrical systems), the following assessments have been made:    The buildings overall appeared to be in good condition and in sound working order, but obviously  in desperate need of upgrades in order to meet modern‐day standard design practices and  required code compliances.  Some of the obvious upgrades for the main building would be to:   • replace the old coal‐fired hot water system with a new forced‐air heating and air  conditioning system;   • upgrade the toilet facilities to meet current accessibility requirements;   • upgrade the lighting systems to meet current energy code requirements; As for the cafeteria building, the only obvious assessments are:  • upgrade the handicap accessibility for the toilet facilities;   • upgrade the lighting systems to meet current energy code requirements;  • upgrade emergency exit and egress lighting;   • given the age of the heat pumps, it must be noted that it is impossible to determine how much  longer they could be expected to remain in good working order, and are not as efficient as new
