10-07-2024 Closed Session Meeting Minutes BOC -Redacted October 7, 2024, Closed Session Page 1 of 2 Person County Board of Commissioners Minutes of a Closed Session DATE: October 7, 2024 MEMBERS OF BOARD OF COMMISSIONERS PRESENT: Chairman Powell, Vice-Chairman Sims, Commissioner Palmer, Commissioner Puryear, and Commissioner Thomas OTHERS PRESENT: County Manager, Katherine Cathey, Clerk to the Board, Michele Solomon, County Attorney, T.C. Morphis, Jr., Economic Development Director, Brandy Lynch Health Director, Janet Clayton, and Environmental Health Supervisor, Bonnie Holt A motion was made by Commissioner Puryear and carried 5-0 to enter into Closed Sessions at 7:36 p.m. Closed Session # 1 per General Statute 143-318.11(a)(3) for the purpose to consult with the county attorney in order to preserve the attorney-client privilege with the following individuals permitted to attend: County Manager Katherine Cathey, Clerk to the Board Michele Solomon, County Attorney T.C. Morphis, Jr., Health Director Janet Clayton, Environmental Health Supervisor Bonnie Holt, and Economic Development Director Brandy Lynch, followed by Closed Session #2 per General Statute 143-318.11(a)(6) for the purpose to discuss personnel with the following individuals permitted to attend: County Manager Katherine Cathey. Chairman Powell called the Closed Sessions to order at 7:37 p.m. CLOSED SESSION #1 October 7, 2024, Closed Session Page 2 of 2 Economic Development Director Brandy Lynch provided an update to the lawsuit with Main Stream Earthworks. She stated that Golden Leaf will allow her to close out the grant. She stated that all bills have been paid. She stated that if she asks for the retainage, Golden Leaf may pay for it. She stated that Golden Leaf expressed concerns about what company is buying the land, what types of jobs, how many employees, pay, etcetera. She stated that she has submitted the Geotech and pictures. County Attorney T.C. Morphis, Jr. went over the estimated litigation costs, which could be in excess of $51K. It was the consensus of the Board to pay up to the $77K retainage to Main Stream Earthworks via settlement instead of proceeding with the litigation. Morphis advised that he would speak with counsel for Main Stream Earthworks and present a settlement offer. County Attorney T.C. Morphis Jr. provided an update on the Human Services Building. He stated that the closing with Brixmor is scheduled for October 8, 2024. He stated that the language in the Memorandum of Understanding (MOU) changed. He stated that in reference to the water line, it was supposed to have two water lines, and two meters. He stated that a new water valve was installed, and no new water line was installed. County Manager Katherine Cathey stated that the County’s water supply is isolated, and that General Services Director Ray Foushee is satisfied with this. No action was taken by the Board on this matter. CLOSED SESSION #2 ADJOURNMENT: A motion was made by Vice-Chairman Sims and carried 5-0 to adjourn the meeting at 9:20 p.m.
