CLOSED SESSION #3
A motion was made by Vice Chairman Sims and carried 5-0 to enter into Closed Session
#3 per General Statute 143-318.11(a)(3) at 7:33pm for the purpose to consult with the county
attorney in order to preserve the attorney-client privilege with the following individuals permitted
to attend: County Manager Katherine M. Cathey, Clerk to the Board Brenda Reaves and County
Attorney Ellis Hankins.
Chairman Powell called the Closed Session #3 to order at 7:33pm.
County Attorney Ellis Hankins provided the Board with a brief update related to the Special
Use Permit appeal filed by Elizabeth Christian, one of the seven property owners for a denied
permit by the Board of Commissioners for a large solar farm. Mr. Hankins stated Ms. Christian
has 200+ acres of the proposed 900-acre solar farm who has petitioned the Court for writ of
certiorari when the developer abandoned the project and did not join the appeal process.
Mr. Hankins stated after 14-months, Ms. Christian filed a motion to continue which the
Court denied. After which, Ms. Christian filed a motion to withdraw the petition for writ of
certiorari. Mr. Hankins stated it is the Court’s writ of certiorari and not Ms. Christians’ to withdraw.
He added he has filed an Order to Dismiss to which they are awaiting Ms. Christian’s consent to
dismiss. Mr. Hankins opined the Court would dismiss the case, but if not, his firm would stand
ready to argue the appeal.
A motion was made by Vice Chairman Sims and carried 5-0 to return to open session at
7:40pm.
