Request
Variance request from Calvin Clayton (applicant) for CHI Construction, Inc. (owner) to approve a
adding a single-family dwelling on TM A69-88, on which an existing commercial building is
located.

Location, Current and Future Land Use
The Subject Property is located on Boston Road at the intersection with Jessie Banks Road. The
property is zoned RC (Rural Conservation) and is in a Future Land Use Rural Area. The adjoining
properties to the North, South, East and West are also zoned RC and in the same Future Land Use
Rural Area. The western portion of the parcel, with Boston Road frontage, has a commercial
building (formerly Clay’s Flower Shop 1978) having an existing septic system and a water meter
for city water. The eastern portion of the parcel, with frontage on Jessie Banks Road, has an
existing septic system and access for city water. On the eastern portion of the lot a single-family
dwelling existed from 1986 until 2019.
Planning Staff Analysis
With the submission of the Variance Application, recorded plat, and site plan, the applicants desire
is to reestablish a single-family dwelling on the property. This item is before the Board of
Adjustment in keeping with the requirements of the Development Review Procedures for Zoning
Variances. The applicant has submitted findings of fact for the required four items with the
Variance Application. A variance from the terms of this ordinance shall be granted by the Board of
Adjustment when a written application demonstrates all the following:
(1) Unnecessary hardship would result from the strict application of the regulation. – Before
purchasing this property I completed my due diligence by confirming with PCEHD, Inspections and
with the “Interim Planner”, albeit a conservation, I was told that this property could be used in the
same manner as it had been used previously. (A home placed where one once was).
(2) The hardship results from conditions that are peculiar to the property, such as location, size, or
topography. – This property has it own address, but shares the total parcel w/5934 Boston Rd. The
business will remain and the home would be placed back where it once was.
(3) That the hardship did not result from actions taken by the applicant or property owner. – The
Property was purchased via Judicial Sale / Bids and upset process. It was sold as one parcel w/2
addresses.
(4) The requested variance is consistent with the spirit, purpose, and intent of the regulation, such
as that public safety is secured and substantial justice is achieved. – The neighborhood would not
be affected, as it embraced this home at this location for years.
In addition to the grounds for granting variances specified by Section15.8-2(3) the Board of
Adjustment may grant a variance when it finds that the grant of the requested variance will cause
no significant hazard, annoyance or inconvenience to the owners or occupants of nearby property,
will not significantly change the character of the neighborhood or reduce the value of nearby
property, will not impose any significant cost burden upon the Person County and will not create
any significant obstacle to implementation of the zoning plan evidenced by this ordinance or the
adopted development plan of Person County.
Staff Recommendation
Based on the above, the Planning and Zoning Department staff recommends that the Board of
Adjustment approve VA-02-26, with the following conditions:
Applicant to obtain Environmental Health Permit, Zoning Permit, and Building Permit for new
single-family home at 65 Jessie Banks Road and applicant to provide As-Built survey after
construction but prior to C/O.
